BAN HÀNH DANH MỤC THUỐC THIẾT YẾU TÂN DƯỢC LẦN VI

Căn cứ Luật Dược số 34/2005/QH11 ngày 14 tháng 6 năm 2005;

Căn cứ Nghị định số 63/2012/NĐ-CP ngày 31 tháng 08 năm 2012 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Y tế;

Theo đề nghị của Cục trưởng Cục Quản lý dược;

Bộ trưởng Bộ Y tế ban hành Thông tư Ban hành Danh mục thuốc thiết tân dược lần VI như sau:

Điều 1. Danh mục thuốc thiết yếu lần VI

Ban hành kèm theo Thông tư này "Danh mục thuốc thiết yếu tân dược lần VI”.

Điều 2. Nguyên tắc xây dựng Danh mục thuốc thiết yếu tân dược lần VI

1. Kế thừa Danh mục thuốc thiết yếu Việt Nam lần thứ V, đồng thời tham khảo Danh mục thuốc thiết yếu hiện hành của Tổ chức Y tế thế giới, các hướng dẫn điều trị của Bộ Y tế Việt Nam và căn cứ vào các tiêu chí lựa chọn thuốc cụ thể;

2. Phù hợp với chính sách, pháp luật về dược, thực tế sử dụng và khả năng bảo đảm cung ứng thuốc của Việt Nam;

3. Danh mục thuốc thiết yếu tân dược được sửa đổi, bổ sung để bảo đảm an toàn cho người sử dụng, một số loại thuốc có thể bị loại bỏ khỏi Danh mục nếu có những tác dụng có hại nghiêm trọng được phát hiện;

4. Các thuốc đưa vào Danh mục thuốc thiết yếu tân dược dưới tên chung quốc tế, không đưa tên riêng chế phẩm.

Điều 3. Tiêu chí lựa chọn thuốc đưa vào Danh mục thuốc thiết yếu tân dược

1. Bảo đảm hiệu quả, an toàn cho người sử dụng;

2. Sẵn có với số lượng đầy đủ, có dạng bào chế phù hợp với điều kiện bảo quản, cung ứng và sử dụng;

3. Phù hợp với mô hình bệnh tật, phương tiện kỹ thuật, trình độ của thầy thuốc và nhân viên y tế trong cơ sở khám bệnh, chữa bệnh;

4. Giá cả hợp lý;

5. Đa số là đơn chất, nếu là đa chất phải chứng minh được sự kết hợp đó có lợi hơn khi dùng từng thành phần riêng rẽ về tác dụng và độ an toàn. Trường hợp có hai hay nhiều thuốc tương tự nhau phải lựa chọn trên cơ sở đánh giá đầy đủ về hiệu lực, độ an toàn, chất lượng, giá cả và khả năng cung ứng.

Điều 4. Hướng dẫn thực hiện Danh mục thuốc thiết yếu tân dược

1. Danh mục thuốc thiết yếu tân dược là cơ sở để:

a) Xây dựng thống nhất các chính sách của Nhà nước về : Đầu tư, quản lý giá, vốn, thuế, các vấn đề liên quan đến thuốc phòng bệnh, chữa bệnh cho người nhằm tạo điều kiện có đủ thuốc trong Danh mục thuốc thiết yếu phục vụ công tác bảo vệ, chăm sóc và nâng cao sức khoẻ nhân dân.

b) Cơ quan quản lý nhà nước xây dựng chủ trương, chính sách trong việc tạo điều kiện cấp số đăng ký lưu hành thuốc, xuất khẩu, nhập khẩu thuốc.

c) Các đơn vị ngành Y tế tập trung các hoạt động của đơn vị trong các khâu : Xuất khẩu, nhập khẩu, sản xuất, cung ứng, phân phối, tồn trữ, sử dụng thuốc thiết yếu an toàn, hợp lý, hiệu quả nhằm đáp ứng nhu cầu bảo vệ và chăm sóc sức khỏe nhân dân.

d) Các trường chuyên ngành y dược tổ chức đào tạo, giảng dạy, hướng dẫn sử dụng thuốc cho các học sinh, sinh viên.

đ) Các cơ sở kinh doanh thuốc bảo đảm thuốc thiết yếu trong Danh mục với giá cả phù hợp; hướng dẫn sử dụng thuốc an toàn, hợp lý, hiệu quả.

e) Xây dựng Danh mục thuốc thuộc phạm vi thanh toán của quỹ Bảo hiểm y tế.

g) Hội đồng thuốc và điều trị xây dựng danh mục thuốc sử dụng trong bệnh viện đáp ứng nhu cầu điều trị trình Giám đốc bệnh viện phê duyệt.

2. Hướng dẫn sử dụng Danh mục thuốc thiết yếu tân dược :

a) Sử dụng phù hợp với :

+ Phạm vi hoạt động chuyên môn của giấy phép hoạt động đối với với cơ sở khám bệnh, chữa bệnh;

+ Danh mục kỹ thuật của cơ sở khám bệnh, chữa bệnh đã được cấp có thẩm quyền phê duyệt theo quy định.

b) Các thuốc có ký hiệu (*) có phạm vi bán lẻ đến tủ thuốc của trạm y tế và đại lý bán thuốc của doanh nghiệp.

c) Các thuốc có ký hiệu (**) là thuốc dự trữ, hạn chế sử dụng, chỉ sử dụng khi các thuốc khác trong nhóm điều trị không có hiệu quả và phải được hội chẩn (trừ trường hợp cấp cứu).

d) Thuốc Methadon có ký hiệu (***) được sử dụng trong các cơ sở y tế được phép triển khai chương trình điều trị nghiện chất dạng thuốc phiện bằng thuốc thay thế; đối tượng sử dụng thuốc và thời gian sử dụng thuốc phải tuân thủ theo “Hướng dẫn điều trị thay thế nghiện các chất dạng thuốc phiện bằng thuốc Methadon” do Bộ Y tế ban hành.

e) Các trường hợp khác:

- Các thuốc điều trị đặc hiệu bệnh phong, tâm thần, động kinh, vô sinh, lao, HIV/AIDS, sốt rét và vắc xin tiêm chủng sử dụng thuốc theo hướng dẫn của các chương trình y tế.

- Đối với các thuốc an thần, thuốc chống động kinh, thuốc chống trầm cảm, trong trường hợp xã, phường có triển khai chương trình sức khoẻ tâm thần cộng đồng thì được phép sử dụng thuốc theo quy định của chương trình đó.

- Các thuốc kháng vi- rút có tác dụng tạm thời làm chậm lại sự phát triển của vi- rút, đồng thời cải thiện các triệu chứng bệnh. Các thuốc này gây phản ứng có hại khác nhau và người bệnh khi điều trị bằng các thuốc này cần có sự theo dõi thận trọng từ các thầy thuốc và nhân viên y tế có trình độ thích hợp.

Điều 5. Điều khoản thi hành

1. Thông tư này có hiệu lực thi hành kể từ ngày 10 tháng 02 năm 2014. Bãi bỏ Quyết định số 17/2005/QĐ- BYT ngày 01 tháng 7 năm 2005 của Bộ trưởng Bộ Y tế về việc ban hành Danh mục thuốc thiết yếu Việt Nam lần V (phần Danh mục thuốc thiết yếu tân dược) kể từ ngày Thông tư này có hiệu lực.

2. Cục Quản lý dược, Cục Quản lý khám chữa bệnh, Vụ Bảo hiểm y tế, các đơn vị thuộc và trực thuộc Bộ Y tế, các đơn vị y tế ngành, Sở Y tế các tỉnh, thành phố trực thuộc Trung ương, Tổng công ty dược Việt Nam, các doanh nghiệp sản xuất, kinh doanh dược phẩm có trách nhiệm thực hiện Thông tư này.

Trong quá trình thực hiện nếu có vấn đề vướng mắc, đề nghị các cơ quan, tổ chức, cá nhân kịp thời phản ánh về Bộ Y tế (Cục Quản lý dược) để xem xét, giải quyết./.

Ghi chú:

- Dạng muối, acid tổ hợp được đặt trong ngoặc đi cạnh tên hoạt chất chính ghi tại cột (2) được hiểu là các muối, acid tổ hợp này không tính trong nồng độ, hàm lượng ghi tại cột (5) mà chỉ là dạng muối hoặc acid tổ hợp với hoạt chất chính được sử dụng trong bào chế. Nồng độ, hàm lượng ghi tại cột (5) sẽ tính theo dạng của hoạt chất chính ở ngoài ngoặc.

Ví dụ:

+ STT 25 - Dexamethason phosphat (natri): hàm lượng dung dịch tiêm ghi tại cột (5) là 4mg/ml sẽ tính theo Dexamethason phosphat nhưng dạng muối sử dụng trong bào chế là Dexamethason natri phosphat.

+ STT 86 - Cefotaxim (natri): hàm lượng bột pha tiêm ghi tại cột (5) là 250mg, 500mg, 1g sẽ tính theo cefotaxim nhưng dạng muối sử dụng trong bào chế là Cefotaxim natri.

- Dạng muối, acid tổ hợp đi cạnh tên hoạt chất chính ghi tại cột (2) không đặt trong ngoặc được hiểu là nồng độ, hàm lượng ghi tại cột (5) sẽ tính theo cả muối hoặc acid tổ hợp với hoạt chất chính.

Ví dụ:

+ STT 10 - Ephedrin hydroclorid: nồng độ dung dịch tiêm ghi tại cột (5) là 30mg/ml sẽ tính theo Ephedrin hydroclorid.

+ STT 392 – Sulfacetamid natri: nồng độ thuốc nhỏ mắt ghi tại cột (5) là 10% sẽ tính theo Sulfacetamid natri.

CIRCULAR

PROMULGATING THE FOURTH LIST OF ESSENTIAL WESTERN MEDICINES

Pursuant to the Pharmacy Law No. 34/2005/QH11 dated June 14, 2005;

Pursuant to Government’s Decree No. 63/2012/ND-CP dated August 31, 2012, defining the functions, tasks, powers and organizational structure of the Ministry of Health;

At the proposal of Director of the Drug Administration of Vietnam;

The Minister of Health promulgating the fourth list of essential western medicines as follows:

Article 1. The fourth list of essential medicines

To promulgate together with this Circular “the fourth list of essential western medicines".

Article 2. The principles to elaborate the fourth list of essential western medicines

1. To take over the fifth list of Vietnam essential medicines, with reference of the existing list of essential medicines of World Health Organization, cure guides of the Ministry of Health and based on specific criteria in medicine selection;

2. In conformity with policy and law on pharmacy, practical use and ability to ensure the medicine supply of Vietnam;

3. The list of essential western medicines is amended and supplemented to ensure safety for users, some kinds of medicine may be removed from the list if they detect adversely effects;

4. Medicines are put into list of essential western medicines under international common names, not use private name of preparations.

Article 3. Criteria to select medicines to put into the list of essential western medicines

1. To ensure efficiency and safety for users;

2. To be available in adequate amounts and in dosage forms appropriate to conditions of preservation, supply and use;

3. To be suitable with disease model, technological means, qualification of physicians and health officers in medical examination and treatment establishments;

4. Sensible price;

5. Majority is element, in case of compound, it must prove that such combination is more useful than use of each separate element regarding effect and safety. If there are two or more similar medicines, they must be selected on the basis of assessing sufficiently the efficiency, safety, quality, price and supply ability.

Article 4. Guide on implementation of the list of essential western medicines

1. The list of essential western medicines is basis to:

a) To elaborate the State’s unified policies on: Investment, price management, capital, tax, matters involving curative medicine to human aiming to facilitate to have sufficient medicines in list of essential medicines in serve of protection, care and raising people’s health.

b) State management agencies may formulate guidelines, policies in facilitating to issue the medicine circulation registration number, medicine export and import.

c) Units in Health sector concentrate on their activities in stages: The safe, sensible and efficient export, import, production, supply, distribution, storage and use of essential medicines aiming to meet demand of people's protection and healthcare.

d) Schools specialized in Health, pharmacy organize the training, teaching and guide of medicine use for pupils and students.

dd) Establishments trading in medicine ensure to have essential medicines in the list at a sensible price; guide on safe, sensible and effective medicine usage.

e) To elaborate list of medicines in payment scope of medical insurance fund.

g) The medicine and medical treatment council may elaborate list of medicine used in hospital to meet demand of medical treatment and submit to director of hospital for the approval.

2. Guide on use of the list of essential western medicines:

a) Use in line with:

+ The specialized operational scope in operation permit, for medical examination and treatment establishments;

+ Technical list of medical examination and treatment establishments which have been approved by competent authorities under regulations.

b) Medicines with symbol (*) have retail scope at medical stations and medicine sale agents of enterprises.

c) Medicines with symbol (**) are reserve medicines limited for use, only used when other medicines in medical treatment group are not effective and required specialist diagnostic (except for case of first aid).

d) Methadone medicines with symbol (***) are used in medical establishments allowed to implement program on addiction treatment of opium substances by alternative drugs; objects using medicines and time of medicine usage must comply with “The medical treatment guide to alternate addition of opium substances by methadone medicines” promulgate by the Ministry of Health.

e) Cases:

- Special curative medicines for leprosy, mental illness, seizures, infertility, tuberculosis, HIV / AIDS, malaria and vaccines are used in accordance with guide of health programs.

- For sedatives, antiepileptic drugs, antidepressants, in case where communes, wards implement community mental health program, they are allowed using in accordance with regulation of that program.

- Antiviral medicines have effect to temporarily delay development of virus, and improve symptoms. These medicines cause various adverse reactions and during being treated with these medicines, patients need careful supervision from physicians and health officers with suitable qualification.

Article 5. Implementation provisions

1. This Circular takes effect on February 10, 2014. To annul Decision No. 17/2005/QD- BYT dated July 01, 2005, of Minister of Health, on promulgating the fifth list of Vietnam’s essential medicines (part list of essential western medicines) from the effective day of this Circular.

2. The Drug Administration of Vietnam, the medical examination and treatment management Department, medical insurance department, units of and affiliated the Ministry of Health, units of health sector, the principal/municipal Services of Health, Vietnam Pharmaceutical Corporation, enterprises producing and trading in pharmaceutical products shall implement this Circular.

In the course of implementation, any arising problems should be reported timely to the Ministry of Health (the Drug Administration of Vietnam) for consideration and settlement.

- Salts, acid complexes put in brackets or near name of main active ingredients in column (2) are construed that these salts, acid complexes are not included in concentration, content in column (5), they are only forms of salts, acid complexes with main active ingredients used in preparation. Concentration, content in column (5) will be calculated according to form of main active ingredient out of brackets.

Example:

+ STT 25 - Dexamethason phosphat (natri): Content of injection solution in column (5) is 4mg/ml which is calculated according to Dexamethason phosphate but salt form used in preparation is Dexamethason natri phosphate.

+ STT 86 - Cefotaxim (natri): Content of powder mixed in ampoule in column (5) is 250mg, 500mg, 1g which are calculated according to cefotaxim but salt form used in preparation is Cefotaxim natri.

- Forms of salt, acid complex along to name of main active ingredient in column (2) not in brackets are construed that concentration, content in column (5) is calculated according to both salt or acid complex of main active ingredient.

Example:

+ STT 10 – Ephedrin hydrogen: Concentration of injection solution in column (5) is 30mg/ml which is calculated according to Ephedrin hydrogen.

+ STT 392 – Sulfacetamid natri: Concentration of eye drop medicine in column (5) is 10% which is calculated according to Sulfacetamid natri.
