CIRCULAR
PROMULGATING LISTS OF IMPORTS AND EXPORTS OF THE PRINTING AND PUBLISHING INDUSTRIES
Pursuant to the Law on Publishing dated November 20, 2012;
Pursuant to the Law on Foreign Trade Management dated June 12, 2017;
Pursuant to the Government’s Decree No. 17/2017/ND-CP dated February 17, 2017 defining functions, tasks, entitlements and organizational structure of the Ministry of Information and Communications;
Pursuant to the Government’s Decree No. 195/2013/ND-CP dated November 21, 2013 on elaboration of the Law on Publishing;
Pursuant to the Government’s Decree No. 69/2018/ND-CP dated May 15, 2018 on elaboration of the Law on Foreign Trade Management;
Pursuant to the Government’s Decree No. 60/2014/ND-CP dated June 19, 2014 on printing;
Pursuant to the Government’s Decree No. 25/2018/ND-CP dated February 28, 2018 on amendments to some Articles of the Government’s Decree No. 60/2014/ND-CP dated June 19, 2014 on printing;
At the request of the Director of the Authority of Publication, Printing and Distribution,
The Minister of Information and Communications hereby promulgates a Circular on lists of imports and exports of the printing and publishing industries.
Article 1. Lists of imports and exports of the printing and publishing industries
Lists of imports and exports of the printing and publishing industriesare promulgated together with this Circular, including:
1. Appendix 01: List of commodities classified by HS codes and methods for management of imports and exports of the printing industry.
2. Appendix 02: List of commodities classified by HS codes and methods for management of imports and exports of the publishing industry.
Article 2. Implementation clause
1. This Circular comes into force from February 12, 2019 and supersedes the following Circulars:
a) Circular No. 16/2015/TT-BTTTT dated June 17, 2015 of the Minister of Information and Communications;
b) Circular No. 41/2016/TT-BTTTT dated December 26, 2016 of the Minister of Information and Communications;
2. The Chief of Office, Director of Authority of Publication, Printing and Distribution, heads of affiliates of the Ministry of Information and Communications; authorities, organizations and individuals participating in or related to import and export of commodities of the printing and publishing industries are responsible for the implementation of this Circular.
3. Difficulties that arise during the implementation of this Circular should be promptly reported to the Authority of Publication, Printing and Distribution affiliated to the Ministry of Information and Communications for consideration./.

2. Procedures and applications for issuance of import license to the commodities on the List specified in Section I.1 shall comply with Articles 27 and 28 of the Government’s Decree No. 60/2014/ND-CP dated June 19, 2014 (whose Articles are amended by the Government’s Decree No. 25/2018/ND-CP dated February 28, 2018).
3. Upon import of the printing commodities of headings 84.40, 84.41 and 84.42 and commodities of heading 84.43 specified in the Circular No. 65/2017/TT-BTC dated June 27, 2017 of the Ministry of Finance that are not included in the List in Section I.1, the import license issued by the Ministry of Information and Communications is required.
II. EXPORTS
Upon export of the commodities on the List in Section I.1, the export license issued by the Ministry of Information and Communications is not required./.

2. Procedures and applications for confirmation of registration of import of publications for business purpose regarding commodities on the List in Section I.1 shall comply with Article 39 of the Law on Publishing and Circular No. 23/2014/TT-BTTTT dated December 29, 2014 of the Minister of Information and Communications.
3. Procedures and applications for issuance of import license to publications imported for non-business purpose regarding commodities on the List in Section I.1 shall comply with Article 41 of the Law on Publishing and Circular No. 23/2014/TT-BTTTT dated December 29, 2014 of the Minister of Information and Communications.
4. Regarding the commodities on the List in Section I.1, which are not required to obtain the import license as prescribed in Clauses 1 and 2 Article 42 of the Law on Publishing, management methods specified in this Circular shall not be adopted.
5. The import of commodities on the List in Section I.1, which contain contents in breach of regulations laid down in Clause 1 Article 10 of the Law on Publishing shall be prohibited in any form.
II. Exports
1. The commodities on the List in Section I.1 which have been published and sold legally in Vietnam are allowed to be exported abroad as prescribed in Article 43 of the Law on Publishing and are not required to obtain the export license issued by the Ministry of Information and Communications.
2. The export of commodities on the List in Section I.1, which contain contents in breach of regulations laid down in Clause 1 Article 10 of the Law on Publishing shall be prohibited in any form./.
