CIRCULAR
INSTRUCTIONS FOR EXPORT OF MINERALS USED AS BUILDING MATERIALS
Pursuant to the Government’s Decree No. 81/2017/ND-CP dated July 17, 2017 defining the functions, tasks, powers and organizational structure of the Ministry of Construction;
Pursuant to the Government’s Decree No. 09/2021/ND-CP dated February 09, 2021 on management of building materials;
Pursuant to the Prime Minister's Directive No. 38/CT-TTg dated September 29, 2020 continuing enhancement of state management of exploration, mining, processing, use and export of minerals;
At the request of the Director General of Building Materials Department;
The Minister of Construction hereby promulgates a Circular providing instructions for export of minerals used as building materials.
Article 1. Scope and regulated entities
1. This Circular provides instructions for list, technical specifications and indicators and origin of minerals used as building materials for export.
2. This Circular applies to foreign and domestic organizations and individuals whose activities involve export of minerals used as building materials in Vietnam (except for the delivery of building minerals used as building materials from domestic market into a free trade zone or a customs-controlled area for construction, repair and maintenance of work structures).
Article 2. Definitions
For the purposes of this Circular, the terms below shall be construed as follows:
1. “mineral processing” refers to the process of separate or combined adoption of mechanical, physical and chemical methods for changing properties of mined minerals with the aim of generating mineral products whose technical specifications and indicators serve intended purposes and commercial value is higher than the unprocessed ones.
2. “stone blocks used as stone slabs” refer to natural stones quarried from quarries of igneous, sedimentary or metamorphic rocks at pits so as to generate stone products in blocks with flat surfaces and a volume of ≥ 0. 4 m3.
3. “stone slabs” refer to various types of stones processed from natural stone blocks into tiling or paving slabs (conformable with TCVN 4732:2016 Natural stone facing slabs) used for facing buildings.
4. “building stones” refer to various types of stones quarried from natural stone quarries (included in the of minerals used as normal building materials in accordance with regulations of law on minerals), and worked and processed into products used in buildings.
5. “stone sculptures” refer to objects made of stones quarried from natural stone quarries and sculpted into sculptures of non-standard dimensions.
Article 3. Origin, list, and technical specifications and indicators of minerals used as building materials for export
1. Minerals used as building materials for export which have legal origin comprise those mined under an effective mining license, effective salvage mining license or effective enclosed mining decision issued by a competent authority in accordance with regulations of law on minerals.
2. List, technical specifications and indicators of minerals used as building materials for export are provided in the Appendix I hereof (except for minerals that are temporarily imported - re-exported, involved in merchanting trade transactions and in transit).
Article 4. Effect
This Circular comes into force from August 28, 2021 and supersedes the Circular No. 05/2018/TT-BXD dated June 29, 2018 and Circular No. 05/2019/TT-BXD dated October 10, 2019 of the Minister of Construction.
Article 5. Responsibility for implementation and implementary organization
1. The Ministry of Construction shall organize, provide guidance on and supervise the implementation of this Circular; concurrently cooperate with relevant ministries in carrying out periodic or unscheduled inspections of compliance with laws during export of minerals used as building materials by local governments.
2. Provincial People’s Committees shall direct competent authorities to carry out periodic or unscheduled inspections of export of minerals used as building materials as prescribed by law, and shall on an annual basis (or at the request of competent authorities) submit reports on export of minerals using the form in the Appendix II hereof before January 30 to the Ministry of Construction, which will submit a consolidated report to the Prime Minister.
3. Every exporter of minerals shall submit an annual report (or ad hoc report at the request of a competent authority) to the Department of Construction for submission to the People’s Committee of the province (where the exporter conducts export activities) according to the form in the Appendix II hereof before January 15.
4. Difficulties that arise during the implementation of this Circular should be promptly reported to the Ministry of Construction for consideration and resolution./.
