DECISION
SETTING UP, AND DEFINING THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF, VIETNAMS CULTURAL CENTER IN FRANCE
THE PRIME MINISTER
Pursuant to the December 25, 2001 Law on Organization of the Government;
Pursuant to the Governments Decree No. 178/2007/ND-CP of December 3, 2007, defining the functions, tasks, powers and organizational structures of ministries and ministerial-level agencies;
Pursuant to the Governments Decree No. 185/2007/ND-CP of December 25, 2007, defining the functions, tasks, powers and organizational structure of the Ministry of Culture, Spoils and Tourism;
Pursuant to the 1993 Ordinance on overseas representative offices of the Socialist Republic of Vietnam;
Pursuant to the Governments Decree No. 183/CP of November 18, 1994. detailing the implemen-tation of the Ordinance on overseas representative offices of the Socialist Republic of Vietnam;
At the proposal of the Minister of Culture. Sports and Tourism.
DECIDES:
Article 1. To set up. and define the functions, tasks and powers of. Vietnams Cultural Center in the Republic of France
1. To set up Vietnams Cultural Center in the Republic of France.
2.Vietnams Cultural Center in the Republic of France, referred to as the Vietnams Cultural Center in France for short, is a non-business cultural unit and overseas representative office of the Ministry of Culture. Sports and Tourism, functioning to organize activities of cultural exchange, communication and tourism in order to increase the understanding of French and European people about Vietnam and its people; provide information on socio-economic situations, undertakings, guidelines, policies and laws of the Vietnamese State, promote tourism and support sport activities.
3. Vietnams Cultural Center in France has the legal person status, its own bank account and seal; its transaction name in French is Centre Culturel du Vietnam en France, abbreviated to CCV.
Article 2. Tasks and powers
Vietnams Cultural Center in France has the following tasks and powers:
1. To propose the Minister of Culture. Sports and Tourism:
a/ To decide on long-term and annual plans on the operation and development of Vietnams Cultural Center in France;
b/ To promulgate or submit to competent authorities for promulgation incentive mechanisms and policies in support of other socio-cultural operations in Europe, suitable to each period and time, and big national anniversaries;
c/ Todecide on the Regulation on organization, operation and management of Vietnams Cultural Center in France.
2. To organize activities of:
a/ Culture, arts, education, science-technology, and promotion of trade, investment, tourism, cuisine, sport, oriental medicine and other activities that need to be promoted in Europe:
b/ Introduction of ancient and present-day Vietnam in all aspects of social life;
c/ Research and organization of cultural, sport and tourism exchanges between Vietnam and France and other European countries;
d/ Teaching and organizing training courses of, Vietnamese language and arts, preserving Vietnamese language in the Vietnamese community in France.
3. To organize the following activities in support of Vietnam-related cultural operations in Europe:
a/ Cultural programs in Europe with the participation of domestic units and overseas Vietnamese;
b/ Visits to study European cultures for Vietnamese researcher delegations;
c/ Seminars, talks, exchanges and dialogues on Vietnamese and foreign cultures, arts, tourisms, economics, investment and social sciences;
d/ Reporting to the Minister of Culture, Spoils and Tourism on the situation and major cultural and an events relating to Vietnam and activities of Vietnamese communities in European countries.
4. To implement investment projects to upgrade and repair its office building; to hire domestic and foreign units, organizations and individuals to provide consultancy on, and participate in. the upgrade, building and operation of Vietnams Cultural Center in France under the direction of the Minister of Culture. Sports and Tourism and in compliance with treaties and agreements between the Socialist Republic of Vietnam and the Republic of France.
5. To learn experience in activity organization of France - or Vietnam-based cultural institutions of other countries for organization and operation of Vietnams Cultural Center in France.
6. To coordinate with concerned agencies in implementing the foreign relation communication tasks in France and Europe.
7. To coordinate with administrations of all levels of the Republic of France in studying demands for communication and cultural activities in France and other European countries, propose and organize the operation of overseas Vietnams Cultural Centers, including mechanisms, policies, organizational structures, and forms and contents of activities.
8. To manage the organizational apparatus and payroll; to implement the wage and bonus regimes and other regimes and policies for cadres and civil servants of Vietnams Cultural Center in France in accordance with law.
9. To manage and use material and technical foundations, finance and assets of Vietnams Cultural Center in France according to state regulations.
10. To comply with the laws of Vietnam and the Republic of France, treaties and international agreements concerning the organization and operation of Vietnams Cultural Center in France.
11. To report to the Minister of Culture, Sports and Tourism and competent state agencies according to the reporting regimes prescribed by law.
12. To perform other tasks and exercise other powers assigned by the Minister of Culture, Sports and Tourism or prescribed by law.
Article 3. Organizational structure and payroll
1. Vietnams Cultural Center in France has five staff members, including:
a/ The director:
b/ A deputy director:
c/ A specialist in charge of culture and arts, tourism promotion and sport activities;
d/ A specialist in charge of library, Internet space and communication, cum cashier;
e/ An accountant cum administrative clerk.
2. Based on the nature and requirements of work, the director may sign labor contracts for two positions: one in charge of training and monitoring courses and a driver cum guard. In addition, depending on requirements and contents of activities, the director may sign labor contracts for seasonal jobs.
3. The director shall be nominated by the Minister of Culture, Sports and Tourism and appointed by the Minister of Foreign Affairs, and is entitled to diplomatic privileges and immunities according to law.
Article 4. Operation mechanism and funds
1. Vietnams Cultural Center in France is subject to the Minister of Culture, Sport and Tourisms direct management of professional operations and the Vietnamese Embassy in Frances political guidance of foreign-relation communication.
2. The Ministry of Culture, Spoils and Tourism shall coordinate with the Ministry of Foreign Affairs and concerned ministries and branches in formulating and promulgating according to their competence, or submitting to competent authorities for promulgation, mechanisms and policies in support of the organization and operation of Vietnams Cultural Center in France.
3. Vietnams Cultural Center in France shall adopt the financial mechanism applicable to Vietnams overseas representative offices under the guidance of the Ministry of Finance.
4. Funds for the operation of Vietnams Cultural Center in France include:
a/ State budget annually allocated according to estimates approved by competent authorities:
b/ Lawful revenues from non-business and service activities according to state regulations;
c/ Other lawful revenues (if any).
Article 5. Implementation effect and responsibilities
1. This Decision takes effect 15 days after its publication in CONG BAO.
2. The Minister of Culture. Spoils and Tourism, ministers, heads of ministerial-level agencies, heads of government-attached agencies, presidents of provincial/municipal Peoples Committees, the director of Vietnams Cultural Center in France, and concerned agencies, organizations and individuals shall implement this Decision.
