DECISION

ON THE SUPPLEMENT, REPLACEMENT OF THE INFORMATION COLLECTION FORM AND THE APPENDIX ON THE CLASSIFICATION OF OUTSTANDING LOANS IN THE REGULATION ON THE CREDIT INFORMATION ACTIVITY ISSUED IN CONJUNCTION WITH THE DECISION NO.1117/2004/QD-NHNN DATED 08 SEPTEMBER 2004 AND THE DECISION NO. 1003/2005/QD-NHNN DATED 8 JULY 2005 OF THE GOVERNOR OF THE STATE BANK

THE GOVERNOR OF THE STATE BANK

- Pursuant to the Law on the State Bank of Vietnam in 1997 and the Law on the amendment, supplement of several Articles of the Law on the State Bank of Vietnam in 2003;
- Pursuant to the Law on Credit Institutions in 1997 and the Law on the amendment, supplement of several Articles of the Law on Credit Institutions in 2004;
- Pursuant to the Decree No. 52/2003/ND-CP dated 19 May 2003 of the Government providing for the function, assignment, authority and organizational structure of the State Bank of Vietnam;
- Upon the proposal of the Director of the Credit Information Center,

DECIDES:

Article 1. To supplement, replace the information collection form in the Regulation on credit information activity issued in conjunction with the Decision 1117/2004/QD-NHNN dated 8/9/2004 of the Governor of the State Bank as follows:

1. To supplement norm 14 - being resident or nonresident and nationality to Form K1A applicable to enterprise customer

2. To supplement norm 8 - being resident or nonresident to Form K1B applicable to private customer

3. To replace Form K4A, K4B by Form K4 - Report on loan security assets issued in conjunction with this Regulation.

Article 2. To supplement to the Appendix on the classification of outstanding loans (attached to Form K3 Report on the customers outstanding loans) in the Decision No.1003/2005/QD-NHNN dated 08 July 2005 of the Governor of the State Bank as follows:

Note: Column (4) and column (5) reflect accounts which are recorded according to the Decision No. 29/2006/QD-NHNN dated 10 July 2006 on the amendment, supplement, cancellation of several accounts in the Accounts System of Credit Institutions issued in conjunction with the Decision No. 479/2004/QD-NHNN dated 29/4/2004 and the Decision No. 807/2005/QD-NHNN dated 1/6/2005 of the Governor of the State Bank.

Article 3. This Decision shall be effective after 15 days since its publication in the Official Gazette.

Article 4. The Director of Administrative Department, Heads of units of the State Bank, the Director of the Credit Information Center, Managers of the State Bank branches in provinces, cities under the central Governments management, Chief of Representative Office in Hochiminh City, the Chairperson of the Board of Directors, General Directors (Directors) of credit institutions, related organizations, individuals shall be responsible for the implementation of this Decision.

Note:

- Subjects of application: CIs, Transaction Departments, branches of CI, units engaging in credit activity which belong to the CI

- Time for sending report: After 3 working days at the latest since customer has relation of loan security asset arisen or since there is information of the change in pledge, mortgage and pledge relief.

(2) Type of asset shall be stated under the number sign as follows:

1. Land use right and assets tied to land

2. Means of transport

3. Valuable papers (bonds, share certificates, bills, term bonds, deposit certificate, commercial paper, other papers which can be valued in money)

4. Machinery, equipment, production line, materials, fuels, consumer commodity, other goods, metal- ware, precious stone

5. Assets to be registered with the ownership, other use right (right arising from copyright, industrial property, right to claim debts, right to be issued, right to make capital contribution to enterprise, right to exploit natural resource, other asset related right, profit and rights arising from pledged assets)

6. Other assets

(3) Code of loan security assets granted by the CI must be unique, not coincisive in the CI

(4) Description of asset: Based on the description of security assets stated in the off-balance sheet accounts of CIs
