Decision No. 827/QD-NHNN of April 14, 2011, on the correction of Appendixes 1, 2, 3 issued in conjunction with the Circular 21/2010/TT-NHNN Dated 08/10/2010 of the State Bank of Vietnam providing for the statistic reporting applicable to units of the state bank and credit institutions, foreign bank’s branches

DECISION

ON THE CORRECTION OF APPENDIXES 1, 2, 3 ISSUED IN CONJUNCTION WITH THE CIRCULAR 21/2010/TT-NHNN DATED 08/10/2010 OF THE STATE BANK OF VIET NAM PROVIDING FOR THE STATISTIC REPORTING APPLICABLE TO UNITS OF THE STATE BANK AND CREDIT INSTITUTIONS, FOREIGN BANK’S BRANCHES

- Pursuant to Law on State Bank of Viet Nam No. 46/2010/QH12 dated 16/6/2010;
- Pursuant to Law on Credit Institutions No. 47/2010/QH12 dated 16/6/2010;
- Pursuant to Law on Statistics No. 04/2003/QH11 dated 17/6/2003;
- Pursuant to the Decree No. 96/2008/ND-CP dated 26 August 2008 of the Government providing for the function, duty, authority and organizational structure of the State Bank;
- Pursuant to Decree No. 100/2010/ND-CP dated 28/9/2010 of the Government on the official gazette;
- Pursuant to Decision No. 22/2007/QD-NHNN dated 28/5/2007 of the Governor of State Bank on issuing the regulation on archive activities;
In consideration of the proposal of the Director of the Monetary Forecasting and Statistics Department,

DECIDES

Article 1. The correction of the Appendix issued in conjunction with Circular No 21/2010/TT-NHNN dated 08/10/2010 of Governor of State Bank of Viet Nam providing for the statistic reporting applicable to State Bank’s Units, Credit Institutions, foreign bank’s branches should be carried out as follows:

1. Correcting the norm 4 of norm group 4E.2 “ Applicable to SBV’s branches in provinces and cities” as follows: “ Making an entry to the issuance reserve fund in the period the type of money xxx eligible for circulation due to transfer from other provinces”

2. Correcting the norm 9 of norm group 6B “Applicable to joint stock CIs” as follows : “Address of shareholder being an individual and related persons in the xxth biggest family of the CI”.

3. Correcting the norm 8 of norm group 7A.1 “Credit, deposit relationship among CIs” as follows : “Outstanding of deposit at CI xxx in type of money xx overdue”.

4. Correcting the norm 10 of norm group 8C : “ Applicable to foreign bank’s branches” as follows : “Outstanding of guarantee commitment of the xxxxth customer whose outstanding guarantee over the own capital of the foreign bank’s branch accounts for 15% upward”.

Article 2: The correction of the Appendix 2 issued in conjunction with Circular No 21/2010/TT-NHNN dated 08/10/2010 of Governor of State Bank of Viet Nam providing for the statistic reporting applicable to State Bank’s Units, Credit Institutions, foreign bank’s branches should be carried out as follows :

1. Correcting at the column named “Code of norms”, the row 1I at the Item I as follows: “ 1H”.

2. Correcting at the column named “Code of norms”, the row 8A.3 at the Item I as follows: “ 8A.5”

3. Correcting at the column named “Code of norms”, the row 8A.4 at the Item I as follows: “ 8A.8”

4. Correcting at the column named “Code of norms”, the row 8A.6 as follows: To remove the symbol “X” in the column named “ SBV’s branches in provinces and cities”

5. Correcting the Item II as follows: To remove the symbol “Ö” in the column named “Finance leasing company”, the row 6A in the column named “Code of norms”.

Article 3: Correcting the Appendix 3 issued in conjunction with the Circular No. 21/2010/TT-NHNN dated 08/10/2010 of Governor of State Bank of Viet Nam providing for the statistic reporting applicable to State Bank’s Units, Credit Institutions, foreign bank’s branches should be carried out as follows:

1. Correcting on the guidance of the drawing up of statistic norms at the first symbol v at the point I in the norm group 1 “ Credit” of Part 3 as follows :

“v Norms of this group (except for norms of group 1G) shall only reflect the outstanding credit of CIs to individuals, organizations being Residents of Vietnam, that are not subject to the area of non-financial institutions, area of households and area of non-profit institutions for serving households. Outstanding credit of this group shall exclude outstanding credit of CIs to organizations which are not CIs as stipulated in Paragraph 12 Part 2 of this Appendix (this item shall be reported in norms of group 7D) and other CIs.”

2. Correcting the symbol “v” on the guidance of the drawing up of norms “ Domestic capital mobilization” at the point 2 in the norm group 2 “ Capital mobilization” in the Part 3 as follows :

“v Norms of this group shall reflect the capital mobilization situation of CIs from Vietnamese residents subject to the non-financial institutions area, households area and not-for-profit institutions serving households in the form of: deposit receiving (demand deposits, term deposit, savings deposits and other deposits), issuing valuable papers (deposit certificates, bills, bills of exchange, bonds). Outstanding of capital mobilization of this group shall exclude outstanding of capital mobilization of CIs from organizations which are not credit institutions as provided for in Paragraph 12 Part 2 of this Appendix (this item shall be reported at the norms of group 7C), the SBV and other CIs.”

3. Correcting on the guidance of the drawing up of statistic norms 4A “Cash collection, payment” at the point 4 in the norm group 4 “Payment and treasury” of part 3 as follows:

“v Calculation unit: VND million.

To list the total amount of cash collection, payment in VND through the bank fund at the end of the final working day of the reporting period. Not to list the collection, payment items between the SBV and the CIs, among the CIs of the same system and among CIs of different systems in this norm.”

4. Correcting on the guidance of the drawing up of statistic norms 5.A.2 “Payment of foreign currency” at the point 5 in norm group 5 “Foreign exchange activity” of Part 3 as follows :

“v Calculation unit: USD 1000. Other foreign currencies shall be converted into USD.

+ Norm 1: Shall list the total value of foreign currencies remitted from overseas to Vietnam to individuals who are residents of Vietnam through authorized CIs in the reporting period by specific codes of countries as stipulated on Table 11 in Appendix 05 of this

+ Norm 2: Shall list the total value of foreign currencies remitted from overseas to Vietnam that the CIs have already paid in foreign currency to the beneficiary individuals being who are residents in the reporting period.”

5. Correcting on the guidance of the drawing up of statistic norms 5.A.3 “Export, import of foreign currency in cash” at the point 5 in norm group 5 “Foreign exchange activity” of Part 3 as follows:

“v Calculation unit: USD 1000. Other foreign currencies shall be converted into USD.

+ Norm 1: Shall list the total amount of foreign currency imported by the CIs to Vietnam through the border gate of Vietnam in the reporting period.

+ Norm 2: Shall list the total amount of foreign currency exported by the CIs to overseas through the border gate of Vietnam in the reporting period.”

Article 4: Implementation organization

1. This Decision shall be effective from its signing date.

2. Director of Administrative Department, Director of Monetary Forecasting and Statistics Department, Heads of units of the State Bank, General Directors (Directors) of credit institutions shall be responsible for the implementation of this Circular.
