DECISION

ISSUING THE CLASSIFICATION LIST OF BANKING-SECTOR STATE SECRETS

THE PRIME MINISTER

Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to the Law on Amendments and Supplements to the Law on Government Organization and the Law on Organization of Local Governments dated November 22, 2019;

Pursuant to the Law on State Secrets dated November 15, 2018;

Upon the request of the Governor of the State Bank of Vietnam.

HEREBY DECIDES

1. Undisclosed plans and schemes for issuance of new currency.

2. Undisclosed projects, proposals, and results of recall and exchange of old currency.  

3. Undisclosed plans, projects and proposals for designing and making printing plates of specimen currency. 

Article 2. State secrets rated Secret, including:

1. Currency and valuable security designs that have been approved by competent authorities, but have not been made public yet; files of currency and valuable security designs approved by competent authorities; prints, engravings, films, molds, stampings of currency and valuable security; files for creating prints, engravings, films, molds, stampings of currency and valuable security; test printing, test casting, and stamping samples of currency and valuable security approved by competent authorities.

2. Currency printing ink formulas; technical specifications of currency printing inks that have not been made public; technical specifications used in the process of making prints, molds, stampings of currency and valuable security issued by the State Bank of Vietnam; regulations on quality, technical specifications in the process of printing, minting, stamping currency and valuable security issued by the State Bank of Vietnam.

3. Security locks, technical specifications, special anti-counterfeiting features of currency and valuable security issued by the State Bank of Vietnam.

Article 3. State secrets rated Confidential, including:

1. The State Bank's plan to operate the tools for the implementation of the national monetary policy which has not been put into operation.

3. In-country stockpiles of physical gold as part of the State foreign exchange reserves.

4. Self-examination reports on vault safety operations of affiliates of the State Bank of Vietnam: Reports on internal audit, reports on supervisory results of the State Bank of Vietnam regarding vault safety operations and management of the State foreign exchange reserves: The State Bank's inspection records on the State foreign exchange reserve management activities.

5. Absolute data on total revenue, total expenditure, cash surplus and deficit within the State Bank’s system.

6. The amount of money printed, minted and issued.

7. Documents regulating the letters and numbers of currencies and valuable security instruments.

8. Money transfer plans, money orders, schedules, telegrams of transportation of money, precious assets or security instruments (including departure date, time, departing place, arrival place, shipping route, type of vehicle, quantity, value, type of assets) which have not been executed by the State Bank of Vietnam.

9. Data on dispatch, receipt, inventory of cash, precious assets, valuable security instruments which are released by the Reserves, e.g. data on dispatch, receipt of destroyed money, plans to destroy money: reports on money destruction results.

10. Plans to purchase money printing paper, money printing ink, money stamping moulds, money stamping ingots; documents on dispensing of series alphabets for money printing activities.

11. Design documents, locations, plans and proposals for the security of money printing and minting establishments: central currency stockpiles, regional currency stockpiles, currency processing and storage center of the State Bank of Vietnam.

13. Reports of inspection of money printing and minting establishments by the State Bank of Vietnam, containing information about money printing and minting data.

14. Financial statements of the National Currency Printing Factory.

b) Documents of affiliates of the State Bank of Vietnam regarding the act of considering issuance of decisions on placing commercial banks, cooperative banks, people's credit funds under special control;  decisions to put people's credit funds under special control; results of supervision of operations of commercial banks, cooperative banks, people's credit funds put under special control;

c) Documents of the Special Control Board concerning: documents giving commands to commercial banks, cooperative banks, people's credit funds put under special control; reports sent to the State Bank of Vietnam on the organization, operation, implementation of the approved restructuring plans of commercial banks, cooperative banks, people's credit funds put under special control and recommendation for the termination of special control for merger, amalgamation, dissolution or bankruptcy purposes;

d) The State Bank of Vietnam’s documents regarding:

- Decisions to put commercial banks, cooperative banks under special control;

- Petitions or representations submitted to the Government, the Prime Minister to seek their consent to the restructuring of commercial banks, cooperative banks or people's credit funds that are put under special control; Petitions or representations for consent to the termination of special control for merger, amalgamation, dissolution or bankruptcy purposes.

22. Undisclosed information about the restructuring and disposal of bad debts of poor-ranked commercial banks, cooperative banks, people's credit funds in accordance with the law, including:

a) Information, documents about plans and solutions for the restructuring and disposal of bad debts of poor-ranked commercial banks, cooperative banks, people's credit funds;

b) Documents of affiliates of the State Bank of Vietnam regarding consideration and approval of plans and solutions for the restructuring and disposal of bad debts;

c) Documents of the State Bank of Vietnam regarding approval of plans and solutions for the restructuring and disposal of bad debts: statements and reports submitted to the Government, the Prime Minister to seek their decisions on guidelines and approval of plans and solutions for the restructuring and disposal of bad debts.

24. Amounts, maturity periods of special loans, maturity date extension in credit institutions’ loan applications which have not yet been made public: amounts, terms of special loans, or extension of special loan due dates, which have not been publicly disclosed.

25. Information about suspicious transactions transferred by the State Bank of Vietnam to competent anti-money laundering authorities: prevention and control of terrorism financing for the purposes of prevention and decommissioning of weapons of mass destruction.

Article 4. Entry into force

This Decision shall enter into force as of the signature date.

Article 5. Implementation responsibilities

1. The Governor of the State bank of Vietnam shall preside over and cooperate with the Minister of Public Security on guiding and inspecting the implementation of this Decision.

2. Ministers, Heads of Ministry-level agencies, Heads of Governmental bodies, Chairpersons of People’s Committees of centrally-affiliated cities and provinces, organizations and individuals involved, shall be responsible for enforcing this Decision./.
