GUIDELINES FOR CERTIFYING CONFORMITY OF GASOLINE, DIESEL FUEL OILS AND BIOFUELS WITH QCVN 1:2009/BKHCN, CIRCULAR NO. 14/2012/TT-BKHCN AND CIRCULAR NO. 30/2014/TT-BKHCN

Pursuant to the Government’s Decree No. 83/2014/ND-CP dated September 03, 2014 on petrol and oil trading;
Pursuant to the Prime Minister’s Decision No. 27/2014/QD-TTg dated April 04, 2014 defining the functions, tasks, powers and organizational structure of the Directorate for Standards, Metrology and Quality;
Pursuant to the Circular No. 20/2009/TT-BKHCN dated September 30, 2009 of the Minister of Science and Technology on promulgation of National Technical Regulation on gasoline, diesel fuel oils and biofuels (QCVN 1:2009/BKHCN), Circular No. 14/2012/TT-BKHCN dated July 12, 2012 of the Minister of Science and Technology on amendments to Article 1 of the Circular No. 20/2009/TT-BKHCN dated September 30, 2009 of the Minister of Science and Technology on promulgation and implementation of “National Technical Regulation on gasoline, diesel fuel oils and biofuels” and Circular No. 30/2014/TT-BKHCN dated October 15, 2014 of the Minister of Science and Technology on promulgation of National Technical Regulation amending some provisions of National Technical Regulation on gasoline, diesel fuel oils and biofuels (QCVN 1:2009/BKHCN) promulgated together with the Circular No. 20/2009/TT-BKHCN dated September 30, 2009 of the Minister of Science and Technology;

HEREBY DECIDES:
Article 1.“Guidelines for certifying conformity of gasoline, diesel fuel oils and biofuels with QCVN 1:2009/BKHCN, Circular No. 14/2012/TT-BKHCN and Circular No. 30/2014/TT-BKHCN” are promulgated together with this Decision.
Article 2.This Decision comes into force from the day on which it is signed and supersedes the Decision No. 400/QD-TDC dated March 25, 2010 of the Directorate for Standards, Metrology and Quality.
Article 3.The Department of Conformity Assessment, designated certification bodies and relevant organizations are responsible for the implementation of this Decision./.

FOR CERTIFYING CONFORMITY OF GASOLINE, DIESEL FUEL OILS AND BIOFUELS WITH QCVN 1:2009/BKHCN, CIRCULAR NO. 14/2012/TT-BKHCN AND CIRCULAR NO. 30/2014/TT-BKHCN
(Promulgated together with the Decision No. 2150/QD-TDC dated November 18, 2014 of the Director General of the Directorate for Standards, Metrology and Quality)
1. Purposes and scope
1.1. This document provides guidelines for certifying conformity of gasoline, diesel fuel oils and biofuels with QCVN 1:2009/BKHCN, Circular No. 14/2012/TT-BKHCN and Circular No. 30/2014/TT-BKHCN.
1.2. This document applies to:
a) Certification bodies designated to certify conformity of gasoline, diesel fuel oils and biofuels with QCVN 1:2009/BKHCN, Circular No. 14/2012/TT-BKHCN and Circular No. 30/2014/TT-BKHCN (hereinafter referred to as “certification bodies”).
b) Traders producing, preparing and importing gasoline, diesel fuel oils and biofuels within the scope of QCVN 1:2009/BKHCN.
2. Bases
2.1. Government’s Decree No. 83/2014/ND-CP dated September 03, 2014.
2.2. Circular No. 28/2012/TT-BKHCN dated December 12, 2012 of the Minister of Science and Technology (hereinafter referred to as “Circular No. 28/2012/TT-BKHCN”).
2.3. Circular No. 15/2009/TT-BKHCN dated June 02, 2009 of the Ministry of Science and Technology (hereinafter referred to as “Circular No. 15/2009/TT-BKHCN”).
2.4. National Technical Regulation on gasoline, diesel fuel oils and biofuels QCVN 1:2009/BKHCN promulgated together with the Circular No. 20/2009/TT-BKHCN dated September 30, 2009 of the Minister of Science and Technology (hereinafter referred to as “QCVN 1:2009/BKHCN”).
2.5. Circular No. 14/2012/TT-BKHCN dated July 12, 2012 of the Minister of Science and Technology (hereinafter referred to as “the Circular No. 14/2012/TT-BKHCN”).
2.6. Circular No. 30/2014/TT-BKHCN dated October 15, 2014 of the Minister of Science and Technology (hereinafter referred to as “the Circular No. 30/2014/TT-BKHCN”).
2.7. Other documents:
a) TCVN 6776:2013 Unleaded gasolines - Specifications.
b) TCVN 5689:2013 Diesel fuel oils (DO) - Specifications.

g) ISO/TS 29001:2010 Petroleum, petrochemical and natural gas industries - Sector-specific quality management systems - Requirements for product and service supply organizations.
h) Decision No. 1518/QD-TDC dated October 17, 2007 and Decision No. 904/QD-TDC dated July 22, 2008 of the Director General of theDirectorate for Standards, Metrology and Quality.
If standards and documents specified in this Section are amended or replaced, guidelines of the Directorate for Standards, Metrology and Quality shall be adhered to.
3. Terms and definitions
3.1. Preparation methods:
a) “in-tank method” refers to a preparation method where compositions of materials are pumped from different tanks/silos into a common tank/silo at a defined rate, then the mixture of compositions is stirred and/or pumped using a circulator pump to achieve uniformity.
b) “in-line method” refers to a preparation method where compositions of materials are pumped from different tanks/silos into a common tank and directly mixed in the same line before being pumped into a tank truck or silo without stirring and/or use of a circulator pump.
3.2. Batch of products:
a) Produced/prepared gasoline, diesel fuel oils and biofuels:
A batch means an amount of gasoline, diesel fuel oils or biofuels that have the same name and quality, are produced/prepared under the same condition (regarding equipment, technology, sources of materials, rate of compositions of materials/formula) and contained in one or multiple storage facilities (such as vaults, silos, tank trucks, etc.) at the same location.
b) Imported gasoline, diesel fuel oils and biofuels:
A batch means an amount of imported gasoline, diesel fuel oils or biofuels that have the same name and quality, are under the same sale contract, transported on the same vehicle produced/prepared and included in the same import documentation.
3.3. Representative sample means an amount of gasoline, diesel fuel oils or biofuels that is collected in an appropriate manner that shows quality characteristics of the whole volume of gasoline, diesel fuel oils or biofuels in the produced, prepared or imported batch.
In case a batch is contained in multiple storage facilities, samples shall be taken from at least 02 randomly selected facilities.
The term “mẫu điển hình” specified in QCVN 1:2009/BKHCN shall be construed as “mẫu đại diện” (“representative sample”).
3.4. Production/preparation traders specified in this document refer to traders that produce gasoline and oil or traders that prepare gasoline and oil or traders that produce and prepare gasoline and oil.
4. General principles
4.1. Certifying conformity by a producer/preparing facility
4.1.1. Regarding a trader that produces/prepares gasoline, diesel fuel oils and biofuels in a stable manner
a) The conformity of gasoline, diesel fuel oils and biofuels with QCVN 1:2009/BKHCN, Circular No. 14/2012/TT-BKHCN and Circular No. 30/2014/TT-BKHCN shall be certified according to Method 5 “Test representative sample and assess the production/preparation process; carry out supervision by testing the sample collected from the place of production or on the market in association with assessment of the production/preparation process” specified in the Circular No. 28/2012/TT-BKHCN.
This method is adopted when the trader producing/preparing gasoline and oil has equipped a competent testing laboratory as prescribed in the Decree No. 83/2014/ND-CP to test quality of gasoline and oil according to national technical regulation (in case a testing laboratory is being developed as prescribed in Article 12 of the Decree No. 83/2014/ND-CP, the trader shall conclude a contract to hire a competent testing laboratory to test quality of gasoline and oil the trader prepares); has undertaken to follow procedures specified the certification program at the request of the certification body; and has developed and effectively applied a management system to control product quality. A management system shall, inter alia, include the following:
- Regulations on frequency of periodically collecting samples of materials and finished products; and regulations on collection of samples of all criteria according to QCVN 1:2009/BKHCN, Circular No. 14/2012/TT-BKHCN and Circular No. 30/2014/TT-BKHCN for at least 01 first batch of products after one of the following occurs:
+ Change of input materials;
+ Availability of non-conforming products;
+ Change of preparation formula (including rate or compositions of materials used);
+ Change of production/preparation equipment and technology;
+ Repair and maintenance of production/preparation equipment and technology.
- Regulations on control of product quality within the distribution system of the trader (including gasoline and oil general agent, agent, retail franchisee and retail station).
- Regulations on tracing of products in case of customers’ complaints about product quality or at the request of competent authorities.
b) Supervision by a certification body shall be carried out on a periodic or unscheduled basis:
- Regarding the trader producing/preparing gasoline and oil adopting in-tank method, supervision of representative sample testing and production process shall be periodically carried out every 03 months or shorter (the periodic supervision period shall be adjusted but shall not be longer 06 months if the supervision results, after a year from the issue date of certificate, show that product quality is still maintained and there is not any non-conforming products sold on the market) and every 12 months or shorter respectively.
- Regarding the trader producing/preparing gasoline and oil adopting in-line method, supervision of representative sample testing and production process shall be periodically carried out every 03 months or shorter (the periodic supervision period shall be adjusted but shall not be longer than 06 months if the supervision results, after a year from the issue date of certificate, show that product quality is still maintained and there is not any non-conforming products sold on the market) and every 06 months or shorter respectively.
- The collection of representative samples from the place of production/preparation and on the market for periodic supervision purpose shall be rotated.
- Unscheduled supervision shall be carried out if change of technology or equipment affects product quality or any customer or competent authority files complaints about violations related to quality of certified products. In this case, the trader shall handle non-conforming products discovered, find the cause and take appropriate remedial actions and precautions.
c) The gasoline and oil production/preparation by the trader will be considered unstable if the results of representative sample testing (certification or periodic and/or unscheduled supervision) show that the representative samples fail to conform to requirements in QCVN 1:2009/BKHCN, Circular No. 14/2012/TT-BKHCN and Circular No. 30/2014/TT-BKHCN two consecutive times or there is evidence for failure to effectively maintain the quality management system. In this case, the certification body shall terminate the certification or suspend the Certificate according to the Method 5 issued to the trader. The certification of conformity of gasoline and oil products of the trader shall be resumed as prescribed in Clause 4.1.2 Section 4 of this document (including the case in which the trader changes the certification body).
4.1.2. Regarding a trader that has just started its production/preparation of gasoline, diesel fuel oils and biofuels or produces/prepares gasoline, diesel fuel oils and biofuels in an unstable manner
a) Regarding the trader produces/prepares gasoline and oil using in-tank method:
The certification of gasoline, diesel fuel oils or biofuels shall be carried out using method 7 set forth in the Circular No. 28/2012/TT-BKHCN, including testing of representative samples, assessment of conformity of each batch before being sold in the market within at least 06 months from the date on which the trader starts its production/preparation of gasoline, diesel fuel oils and biofuels or produces/prepares gasoline, diesel fuel oils and biofuels in an unstable manner (according to Point c Clause 4.1.1 Section 4 of this document).
If, after 06 months, the trader fails to prove the stability of the production/preparation process and the assessment result indicates the application and effective maintenance of the quality management system, the certification body shall certify conformity using method 5 according to Clause 4.1.1 Section 4 of this document.
b) Regarding the trader produces/prepares gasoline and oil using in-line method:
The certification of gasoline, diesel fuel oils or biofuels shall be carried out using method 7 set forth in the Circular No. 28/2012/TT-BKHCN, including testing of representative samples, assessment of conformity of each batch before being sold in the market of at least 09 consecutive batches from the date on which the trader produces/prepares gasoline, diesel fuel oils and biofuels in an unstable manner (according to Point c Clause 4.1.1 Section 4 of this document). If the results of testing of samples from 01 of every 09 batches show that such samples fail to conform to QCVN 1:2009/BKHCN, Circular No. 14/2012/TT-BKHCN and Circular No. 30/2014/TT-BKHCN, the certification body shall request the trader to handle the unsatisfactory batch, take corrective actions and keep applying the conformity assessment method until the 09 consecutive batches conform to QCVN 1:2009/BKHCN, Circular No. 14/2012/TT-BKHCN and Circular No. 30/2014/TT-BKHCN.
After the 09 consecutive batches have their conformity certified using method 7 and the assessment results indicate that the trader has established, applied and effectively maintained the quality management system, the certification body shall certify conformity using method 5 according to Clause 4.1.1 Section 4 of this document.
4.2. Certifying conformity by an importer
The conformity of imported gasoline, diesel fuel oils or biofuels with QCVN 1:2009/BKHCN, Circular No. 14/2012/TT-BKHCN and Circular No. 30/2014/TT-BKHCN shall be certified using method 7 set forth in the Circular No. 28/2012/TT-BKHCN, including testing of representative samples, assessment of conformity of imported batch.
4.3. Rules for recognizing conformity assessment results and using testing laboratories
4.3.1. The certification body may consider recognizing results of conformity assessment carried out by a competent certification body or inspection body in the exporting country (at the place of export). These bodies shall satisfy requirements specified in respective standards. To be specific:
a) Regarding the certification body: satisfy requirements specified in TCVN 7457:2004 (ISO/IEC Guide 65) or TCVN ISO/IEC 17065:2013 (ISO/IEC 17065:2012);
b) Regarding the inspection body: satisfy requirements specified in TCVN ISO/IEC 17020:2012 (or ISO/IEC 17020:2012).
4.3.2. The certification body may consider using a competent testing laboratory for certification. The testing laboratory shall satisfy requirements specified in TCVN ISO/IEC 17025:2007 (ISO/IEC 17025:2005) and relevant regulations on conformity assessment.
4.3.3. Before recognizing conformity assessment results or using testing laboratories for conformity certification, the certification body shall report information about the certification body to the Directorate for Standards, Metrology and Quality.
When necessary, the Directorate for Standards, Metrology and Quality shall inspect the recognition of conformity assessment results and use of testing laboratories by the certification body as well as competence of the conformity assessment body before or after being recognized or used.
4.3.4. When recognizing conformity assessment results or using a testing laboratory, every certification body shall take responsibility for final conformity results.
5. Sampling and sample testing
5.1. Sampling
Sampling methods are provided in the Decision No. 1518/QD-TDC dated October 17, 2007 and Decision No. 904/QD-TDC dated July 22, 2008 of the Directorate for Standards, Metrology and Quality. To be specific:
5.1.1. Regarding imported and produced/prepared gasoline and oils, collect mixed samples from storage facilities (vaults, storage tanks, tank trucks, etc.).
5.1.2. Regarding gasoline and oils sold on the market, collect spot samples from a designated location in storage facilities (vaults, storage tanks, etc.) or from pipes (pumps) in a given period of time.
5.2. Sample testing
Representative samples shall be tested at a testing laboratory that is competent to test criteria according to QCVN 1:2009/BKHCN, Circular No. 14/2012/TT-BKHCN and Circular No. 30/2014/TT-BKHCN. The use of testing laboratories designated by the Directorate for Standards, Metrology and Quality is encouraged.
Criteria to be tested and respective test methods are set forth in QCVN 1:2009/BKHCN, Circular No. 14/2012/TT-BKHCN and Circular No. 30/2014/TT-BKHCN.
5.3. Utilization of test data results
Representative sample test data shall be utilized according to TCVN 6702:2013 (ASTM D 3244-07a).
6. Assessment of production process
6.1. Assessment of conformity with general provisions
A trader that produces/prepares gasoline and oil shall:
a) satisfy requirements specified in Section 2 Chapter II of the Government’s Decree No. 83/2014/ND-CP;
b) have legal status (an enterprise registration certificate in which the gasoline and oil production/preparation is registered);
c) have its plan for production, preparation or sale of gasoline and oil certified;
d) have its application for use of uncommon additives used to produce and prepare gasoline and oil (if used);
dd) issue standards applied to finished gasoline, diesel fuel oils or biofuels.
6.2. Assessment of quality management system
a) Every certification body shall assess the application of quality management system by traders according to TCVN ISO 9001 or ISO/TS 29001;
b) If a trader has the effective certificate that the quality management system for the production/preparation of gasoline and oil has conformed to ISO 9001 or ISO/TS 29001 (because the certification body has registered its certification services with the Directorate for Standards, Metrology and Quality in accordance with regulations of the law on product and goods quality), the certification body is not required to assess the trader’s entire quality management system. However, the certification body should consider minimum quality assurance requirements, including:
- Competence;
- Test and measurement equipment;
- Technical documents, standards and procedures for inspection, testing procedures;
- Qualifications of technicians and staff engaged in production;
- Approval for formula/rate of compositions of materials used for production/preparation and control of changes of formula, results of inspection and testing proving conformity of products according to the approved formula;
- Regulations on self-inspection and testing of product quality according to applicable standards, QCVN 1:2009/BKHCN, Circular No. 14/2012/TT-BKHCN and Circular No. 30/2014/TT-BKHCN include:
+ Regulations on inspection, testing and archiving documents about quality of input materials used (gasoline blend stock, naphtha, fuel ethanol, diesel fuel blend stock, biodiesel fuel blend stock additives, etc.)
+ Regulations on maximum tolerances of components of input materials and confirmation of such tolerances;
+ Product quality control plan;
+ Regulations on control of used input material flow monitors.
7. Certification of conformity of gasoline, diesel fuel oils or biofuels during production or preparation thereof
7.1. Certification of conformity according to method 5
7.1.1. Application
The application for certification of conformity of gasoline, diesel fuel oils or biofuels during production or preparation thereof shall be prepared by the trader under the guidance of the certification body.
7.1.2. Assessment of production process
Production process shall be assessed according to the requirements specified in Section 6 of this document.
7.1.3. Testing of representative samples
Representative samples shall be tested according to the requirements specified in Section 5 of this document. The sample collection form is provided in the Appendix 1 of this document.
The conformity of a representative sample shall be concluded as follows:
a) If all tested criteria conforms to QCVN 1:2009/BKHCN, Circular No. 14/2012/TT-BKHCN and Circular No. 30/2014/TT-BKHCN, it shall be concluded that the representative sample is conformable;
b) If at least 01 tested criterion fails to conform to QCVN 1:2009/BKHCN, Circular No. 14/2012/TT-BKHCN and Circular No. 30/2014/TT-BKHCN, it shall be concluded that the representative sample is unconformable; In this case, the certification body shall send a notification that the quality of the representative sample fails to conform to QCVN 1:2009/BKHCN, Circular No. 14/2012/TT-BKHCN and Circular No. 30/2014/TT-BKHCN so that the trader takes corrective actions, recall and recycle products in a given period of time. After corrective actions are complete, the trader shall notify the certification body in writing. If the result of the second test shows that the representative sample remains unconformable, the conformity by the trader shall be certified according to Clause 4.1.2 Section 4 of this document.
7.1.4. Issuance of Certificate
The gasoline, diesel fuel oils or biofuels shall be issued with the Certificate of conformity with QCVN 1:2009/BKHCN, Circular No. 14/2012/TT-BKHCN and Circular No. 30/2014/TT-BKHCN if the two following requirements are satisfied:
a) If all tested criteria of the representative sample collected from a batch conform to QCVN 1:2009/BKHCN, Circular No. 14/2012/TT-BKHCN and Circular No. 30/2014/TT-BKHCN;
b) The result of production process assessment shows that it is conformable with requirements.
The certificate is valid for 03 years from the date on which it is signed, provided that the trader complies with all post-certification monitoring requirements. The form of the certificate is provided in the Appendix 3 of this document.
7.1.5. Post-certification monitoring and re-certification
Within the effective period of the issued certificate, the certification body shall carry out monitoring according to Clause 4.1.1 Section 4 of this document.
The monitoring of management system and testing of representative samples shall be carried out according to Sections 5 and 6 of this document.
The certification body shall, according to monitoring results, maintain or suspend or invalidate the certificate issued to the trader. If the certificate is invalidated, the conformity of gasoline and oil produced/prepared by the trader shall be certified according to Clause 4.1.2 mentioned above.
If the certificate is suspended, the certification body shall apply method 7 to each batch of gasoline and oil produced/prepared by the trader. The time limit for suspending the certificate is no more than 03 months. If the trader fails to complete corrective actions within the aforementioned time limit, the certification body shall consider and issue a decision on invalidation of the certificate.
Three (03) months before the expiration date of the certificate, the certification body shall notify the trader for applying for re-certification. The re-certification procedures are specified in Clauses 7.1.1 ÷ 7.1.4 of this Clause.
7.2. Certification of conformity according to method 7
7.2.1. Application
The application for certification of conformity of gasoline, diesel fuel oils or biofuels during production or preparation thereof shall be prepared by the trader under the guidance of the certification body.
7.2.2. Instructions on conformity certification are provided in Clause 4.1.2 Section 4 of this document.
If conformity of each batch is certified using method 7, the certification body shall issue the certificate to the batch if it complies with QCVN 1:2009/BKHCN, Circular No. 14/2012/TT-BKHCN and Circular No. 30/2014/TT-BKHCN. Otherwise, the certification body shall request the trader in writing to take corrective actions, recall and recycle products in a given period of time. After corrective actions are complete, the trader shall notify the certification body in writing.
The certificate is valid for each batch. The form of the certificate is provided in the Appendix 5 of this document.
8. Certification of conformity of imported gasoline, diesel fuel oils or biofuels
8.1. Application
The trader that imports gasoline, diesel fuel oils or biofuels shall prepare an application for certification of conformity. An application includes:
- A certificate of conformity (according to the form promulgated by the certification body).
- Copy of import documentation (contracts, invoices, bills of lading, etc.).
- Other quality-related documents (if any), including:
+ Sample testing results.
+ Lashing Certificate
+ Certificate of Origin (C/O).
+ Certificate of Quality (CQ).
8.2. Testing of representative samples
The collection of representative samples and testing of samples of imported gasoline, diesel fuel oils or biofuels shall be carried out according to Section 5 of this document.
The certification body shall prepare a sample collection form according to Appendix 2 of this document.
If the result of the first testing of representative sample shows that the representative sample fails to conform QCVN 1:2009/BKHCN, Circular No. 14/2012/TT-BKHCN and Circular No. 30/2014/TT-BKHCN, the certification body shall collect representative sample for the second testing. The result of the second testing shall be the final result.
8.3. Conclusion on conformity of a batch
The conformity of a batch shall be concluded as follows:
