DECREE
AMENDMENTS TO REGULATIONS ON INVESTMENT AND BUSINESS CONDITIONS IN INTERNATIONAL TRADE IN GOODS, CHEMICALS, INDUSTRIAL EXPLOSIVES, FERTILIZERS, GAS BUSINESS AND FOOD BUSINESS UNDER THE STATE MANAGEMENT OF THE MINISTRY OF INDUSTRY AND TRADE
The Government’s Decree No. 77/2016/ND-CP dated July 01, 2016 providing amendments to regulations on investment and business conditions in international trade in goods, chemicals, industrial explosives, fertilizers, gas business and food business under the state management of the Ministry of Industry and Trade, coming into force from July 01, 2016, is amended by:
1. The Government’s Decree No. 108/2017/ND-CP dated September 20, 2017 on fertilizer management, which comes into force from September 20, 2017;
2. The Government’s Decree No. 113/2017/ND-CP dated October 09, 2017 elaborating and providing guidelines for implementation of the Law on Chemicals, which comes into force from November 25, 2017;
3. The Government’s Decree No. 08/2018/ND-CP dated January 15, 2018 providing amendments to Decrees on investment and business conditions under the state management of the Ministry of Industry and Trade, which comes into force from January 15, 2018;
4. The Government’s Decree No. 69/2018/ND-CP dated May 15, 2018 providing guidelines for implementation of the Law on Foreign Trade Management, which comes into force from May 15, 2018;
5. The Government’s Decree No. 71/2018/ND-CP dated May 15, 2018 on elaboration of some articles of the Law on management and use of weapons, explosives and combat gears regarding industrial explosives and explosive precursors, which comes into force from July 01, 2018;
6. The Government’s Decree No. 87/2018/ND-CP dated June 15, 2018 on gas business, which comes into force from August 01, 2018;
7. The Government’s Decree No. 17/2020/ND-CP dated February 05, 2020 providing amendments to Decrees on investment and business conditions under the state management of the Ministry of Industry and Trade, which comes into force from March 22, 2020.

Chapter I
INTERNATIONAL TRADE IN GOODS
Article 1. Addition of Clause 11 to Article 9 of the Government’s Decree No. 187/2013/ND-CP dated November 20, 2013, detailing the implementation of the Law on Commerce regarding international goods trading and goods sale, purchase, processing and transit agency activities with foreign countries
“11. Import/export of minerals:
a) Importers/exporters of minerals must be traders defined in the Law on Commerce;
b) With regard to export, import, temporary import for re-export and transit of coals, traders must own or lease business locations, vehicles, loading instruments, warehouses, ports, and measuring instruments to serve the business and meet requirements for technology, safety, environmental hygiene, and fire and explosion prevention in accordance with prevailing laws.”

CHEMICALS
Article 9. Amendments to Points c, d, dd, h and i Clause 1 Article 15 of the Government’s Decree No. 38/2014/ND-CP dated May 06, 2014 on management of chemicals governed by the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on their Destruction
“Article 15. Conditions for production of Schedule 1 chemicals
1. Organizations and individual are not allowed to produce the Schedule 1 chemicals, except for the cases where they are produced to serve the purposes of scientific research, maintenance of national defense and security, prevention and combat of epidemic diseases, and any producer of Schedule 1 chemicals for such purposes must satisfy the following conditions:

Chapter VI
FOOD INDUSTRIES UNDER THE STATE MANAGEMENT OF MINISTRY OF INDUSTRY AND TRADE
Section 1. GENERAL REGULATIONS
Article 24. General requirements to be satisfied by food production and trading establishments [15]
1. Food production and trading establishments that are required to have a certificate of food safety must:
satisfy the food safety conditions for the corresponding type of food production/business as prescribed in Sections 2, 3, 4, 5, 6, 7 Chapter VI of this Decree.
2. Food production and trading establishments that are not required to have a certificate of food safety must:
a) satisfy the food safety conditions for the corresponding type of food production/business as prescribed by the Law on Food Safety;
b) The entities specified in Points a, b, c, d, dd, e, g, h and i Clause 1 Article 12 of the Government’s Decree No. 15/2018/ND-CP dated February 02, 2018 on elaboration of some Articles of the Law on Food Safety must:
send their commitments to competent authorities in charge of managing food safety in the province as appointed by provincial People’s Committees.
c) The entity specified in Point k Clause 1 of Article 12 of the Government’s Decree No. 15/2018/ND-CP dated February 02, 2018 on elaboration of some Articles of the Law on Food Safety must:
send a copy of the Certificate (bearing the certification of the food production and trading establishment) prescribed in Point k Clause 1 Article 12 of the Decree No. 15/2018/ND-CP to competent authorities in charge of managing food safety in the province as appointed by provincial People’s Committees.
Article 25. Eligibility requirements for designated testing establishment and reference testing establishment in food safety under the state management of Ministry of Industry and Trade
1. In order to be designated as a food testing establishment, an entity must:
a) be established under the law or assignment decision of a competent authority;
b) have developed a quality management system that meets the provisions in TCVN ISO/IEC 17025:207 or ISO/IEC 17025:205;
c) have equipment and facilities that meet requirements on testing methods;
d) employ at least 02 testers that are technicians possessing a bachelor’s degree in testing in the same field;
dd) have testing methods updated and certified;
e) have adopted testing norms/assays complying with regulations or corresponding technical regulations and other relevant requirements adopted by the relevant supervisory ministry.
2. In order to be designated as a food reference testing establishment, an entity must:
a) be designated by Ministry of Industry and Trade according to Clause 1 of this Article;
b) have developed a quality management system certified to be conformable with TCVN ISO/IEC 17025:207 or ISO/IEC 17025:205, and that certification of conformity must be valid for at least 01 more year from the date of application for designation;
c) have results of proficiency testing or interlaboratory comparison that meet the requirements for the testing norms/assays registered for reference testing.
Section 2. GENERAL FOOD SAFETY CONDITIONS TO BE SATISFIED BY FOOD PRODUCTION ESTABLISHMENTS
Article 26. Production areas
1. Location and environment:

b) The production line must be arranged according to the “no way back” principle;

b) The restroom’s ventilation system must be designed so that air does not flow to the production area;
c) A change room must be available for employees to change their personal protective clothing.

Article 27. Equipment and device conditions

b) Detergents and disinfectants must be contained in recognizable packages with instructions for use and must not be dropped in the food production area.
Article 28. Conditions to be satisfied by food handlers
1.[55] Food handlers must complete training courses in food safety with certification by owners of food production establishments.
2.[56] Food handlers must meet relevant health requirements; do not contract cholera, dysentery, typhoid, hepatitis A, E, bacterial skin infection, tuberculosis and acute diarrhoea.

4. Food handlers must wear suitable protective clothing, head covering, gloves and masks.
5. People engaged in food handling activities must comply with provisions on hygiene practice: They must keep their fingernails short and clean, and not wear rings, jewelry or watches; they must refrain from the following behavior: eating or chewing, drinking, smoking or spitting in the food production area.
Article 29. Food preservation conditions

4.[61] Raw materials and food products must be packed and preserved at not less than 10 cm, 30 cm and 50 cm from the floor, the wall and the ceiling respectively; they must be stacked in the warehouse at the stacking height recommended by the food producer.

Article 32. Conditions to be satisfied by persons directly selling foods

Article 33. Preservation and transportation of foods

2. Food safety conditions to be satisfied during the transportation of foods:
a) Food containers must be separated from the surroundings, protected from the intrusion of dirt and insects, and appropriate to the amount of transported foods;

c) Equipment for monitoring temperature, humidity, air ventilation and elements effecting the food safety must be available in conformity with technical requirements for preserving each type of foods and those of food producer during the transportation of foods;

9. Raw material and product quality control systems
a) Quality control areas shall be situated separately and conveniently for quality control during the production process; be equipped with essential machinery, equipment and instruments to measure and inspect basic quality criteria of major raw materials and finished products. Microorganism testing sections must be aseptic and isolated from other testing sections;
b) If no quality control section is available, beer production establishments shall outsource the control of basic quality criteria of major raw materials and finished products to inspection and analysis organizations that have suitable professional capacity and qualifications;
c) There must be places for preserving samples and keeping dossiers of preserved samples. Establishments shall comply with regulations on sample preservation and destruction applicable to each type of sample.

1. This Decree comes into force from July 01, 2016.
