Công văn 4784/UBND-VX cho phép mua thuốc y tế trong khi chờ kết quả đấu thầu tập trung năm 2013 do thành phố Hồ Chí Minh ban hành

- Pursuant to the Joint Circular No. 01/2012/TTLT-BYT-BTC dated January 19, 2012, of the Ministry of Health and the Ministry of Finance, on guiding bidding of drug purchase in the medical facilities, at point c, Clause 1, Article 23, provided for case of drug purchase permitted to apply form of selecting other contractor as follows: “Drugs which have included in the list of drugs under the plan on drug bidding in year approved by the competent authorities, but have not yet had the bidding result or fail to select the bid winner, and need to buy urgently with the aim to meet demand serving specialized operation in urgent case”;

- Pursuant to the official dispatch No. 3187/BHXH-DVT dated August 12, 2013 of the Vietnam social insurance agency on guiding provision and payment of medical insurance drugs, accordingly, In case where units have not yet had the bidding results of drug purchase as prescribed in the Joint Circular No. 01/2012/TTLT-BYT-BTC dated January 19, 2012, of the Ministry of Health and the Ministry of Finance, the provincial social insurance agencies perform payment of drugs in medical examination and treatment of persons with medical insurance in accordance with guide in the official dispatch No. 653/BHXH-DVT dated February 07, 2013, of the Vietnam social insurance agency. In order to purchase drugs at the price levels in line with the general level of drug prices winning bid in 2013, the provincial social insurance agencies are requested to unify with the health Department in guiding the medical examination and treatment establishments, base on drug prices winning bid in localities in the same region, where have performed bidding according to the Joint Circular No. 01/2012/TTLT-BYT-BTC dated January 19, 2012, of the Ministry of Health and the Ministry of Finance, to purchase and pay the medical insurance drug expenses to the social insurance agencies”.

Pursuant to the Decision No. 4824/QD-BYT dated December 03, 2012, of the Ministry of Health, approving Scheme “The Vietnamese prioritize using medicines made in Vietnam”;

At the request of the Health Department at official dispatch No. 5873/SYT-TCKT dated September 04, 2013, on medical drug purchase, and ensuring requirement to serve patients pending the results of concentrated bidding in 2013;

The People’s Committee of city directs settlement as follows:

1. To approve permission for hospitals and centers without medical beds affiliated the Health Department; hospitals and preventive medical centers affiliated the district-level People’s Committees to purchase medical drugs pending the result of concentrated bidding in 2013 with the content:

a) Medical units are permitted to procure directly according to the biding result in 2013 of the Cho Ray hospital (of the Ministry of Health) with reference of the bidding result in 2013 of some hospitals of other provinces and cities, and hospitals of Ministries, central sectors, which have had results of drug bidding in 2013; concurrently units must review them with prices guides for payment of drugs for medical examination and treatment of persons with medical insurance of the Vietnam social insurance agency.

b) If drugs in need of purchase are not in above cases or the bidding winner at Cho Ray hospital fails to supply fully quantity of drugs in need of procurement, units may make a list of drugs in need of purchase to ensure serve for patients, submit it to the Director of Health Department for consideration and decision on the basis of consulting the social insurance of city. To prioritize and attach special importance to select drugs made in Vietnam for pushing up development of domestic pharmaceutical sector according to scheme “the Vietnamese uses drugs made in Vietnam” of the Ministry of Health.

c) Quantity and value of drugs procured are sufficient for need of use till December 31, 2013 (according to the enclosed list).

d) Funding: includes state budget and other lawful revenues of units.

e) Time for organizing selection of contractors: Finished in September, 2013.

g) The applied form of contracts: Lump-sum contract.

h) Performance duration of contracts: till the end of December 31, 2013.

2. For non-public medical establishments signed contracts of medical examination and treatment for persons with medical insurance with the social insurance agency of city, they may apply the result of selecting contractor of a general hospital at provincial level approved by competent authority to buy drugs under form of direct procurement in accordance with current regulation of law on bidding.

3. To assign the Health Department to coordinate with the Finance Department, the State Treasury of city in, guiding the hospitals, public and non-public medical establishments in city, basing on the list of drugs approved, to conduct drug purchase in accordance with Law on bidding, the Joint Circular No. 01/2012/TTLT-BYT-BTC dated January 19, 2012, of the Ministry of Health and the Ministry of Finance, and the guide of the Vietnam social insurance agency.
