Decision No. 110/1998/QD-TTg of June 25, 1998, on the payment of yearly dues to international organizations

DECISION

ON THE PAYMENT OF YEARLY DUES TO INTERNATIONAL ORGANIZATIONS

THE PRIME MINISTER

Pursuant to the Law on Organization of the Government of September 30, 1992;
Pursuant to the Ordinance of October 17, 1989 on the Signing and Implementation of International Agreements by Vietnam;
At the proposals of the Minister for Foreign Affairs and the Minister of Finance,

DECIDES:

Article 1.- The international organizations mentioned in this Decision include the United Nations, regional and sub-regional organizations and international professional associations.

Article 2.- The joining in the international organizations in the name of the State, the Government or a branch by the ministries, ministerial-level agencies, agencies attached to the Government, central bodies of socio-political organizations, social organizations and socio-professional organizations (called as the agencies for short) must be permitted by the competent agency and on the basis of the provisions of corresponding international agreements which Vietnam has signed or acceded to.

Article 3.- The Vietnamese agencies which have been permitted by the competent level to join in the international organizations shall have to fully exercise their rights and fulfill their obligations as members of such international organizations, including the duty to pay yearly dues according to the regulations of such international organizations.

Article 4.- The use of the State budget to pay yearly dues to the international organizations shall be only considered and applicable to the ministries, ministerial-level agencies, agencies attached to the Government and socio-political organizations which join non-business or non-commercial organizations and the amount of dues payment must be determined right from the beginning in the written applications submitted for permission to join in such organizations. In the course of accession to and implementation of international agreements, should the concerned international organizations request to increase the yearly dues, the participating agencies shall have to notify the Ministry for Foreign Affairs and the Ministry of Finance thereof to obtain their written opinions, sum up and submit them to the Prime Minister for decision, except for international organizations which require their members to pay yearly dues calculated according to coefficient.

Article 5.- The agencies mentioned in Article 3 of this Decision which join international professional business or service organizations, and the social or socio-professional organizations which join international organizations shall ensure their own funding (from voluntary contributions of their members, or from revenues from business and production activities, after fulfilling the obligations towards the State budget, of enterprises benefiting from the above-mentioned organizations' participation in the international organizations) for the payment of their yearly dues to such international organizations. In some special cases where the participation of these organizations is closely associated with the State's tasks, their yearly dues shall be funded partly with the State budget provided that it is so approved by the Prime Minister on the basis of the proposals of the participating organizations and the written opinions of the Ministry for Foreign Affairs and the Ministry of Finance.

Article 6.- The agencies which are permitted to use the budget allocated by the State for the payment of their yearly dues to international organizations must account them into their annual draft budgets and submit them for approval according to regulations.

Article 7.- The Ministry of Finance shall assume the prime responsibility and coordinate with the agencies permitted to use the State budget for the payment of their yearly dues to international organizations in making the estimates for each field and incorporate them into the overall budget then submit it to the Government for submission to the National Assembly for decision.

Article 8.- Annually, the agencies which participate in international organizations shall have to report to the Prime Minister on their participation in such international organizations and their implementation of international agreements already signed and at the same time notify the Ministry for Foreign Affairs and the Ministry of Finance thereof for monitoring.

Article 9.- The Ministry for Foreign Affairs shall act as a coordinator in assisting the Government to perform the State management over the implementation of international agreements and joining international organizations by Vietnamese agencies; coordinate with the Ministry of Finance and the concerned ministries and branches in supervising the fulfillment of their committed obligations and evaluate the effectiveness of the participation in international organizations by agencies. If the joining of an international organization by a Vietnamese agency is ineffective, the Ministry for Foreign Affairs shall, together with the Ministry of Finance, consider and make recommendation to the Prime Minister to terminate the participation of such agency.

Article 10.- This Decision takes effect 15 days after its signing for promulgation. The previous provisions which are contrary to this Decision are hereby annulled. The ministers, the heads of the ministerial-level agencies, the heads of the agencies attached to the Government, and the leaders of the central bodies of the mass organizations shall have to implement this Decision.
