APPROVING ACTION PLAN FOR MANAGEMENT OF MARINE PLASTIC WASTE IN FISHERY SECTOR, PERIOD OF 2020 – 2030

Pursuant to Decree No. 15/2017/QD-TTg dated February 17, 2017 of the Government administering functions, tasks, powers and organizational structures of the Ministry of Agriculture and Rural Development;

Pursuant to Decision No. 1746/QD-TTg dated December 4, 2019 of Prime Minister on national action plan regarding management of marine plastic waste until 2030;

Pursuant to Decision No. 1777/QD-BNN-TCTS dated May 20, 2020 of Minister of Agriculture and Rural Development assigning “Action plan for management of maritime plastic waste until 2030”;

At request of General Director of Directorate of Fisheries.

Article 2.Assign Directorate of Fisheries to take charge and cooperate with relevant agencies, entities, and local governments in implementing and submitting reports to Ministry of Agriculture and Rural Development on a periodic and irregular basis.

Article 3.This Decision comes into effect from the date of signing.

Article 4.Chief of the Ministry Office, General Director of Directorate of Fisheries, Director of Planning Department, Director of Science, Technology and Environment Department, Director of Financial Department, and heads of relevant entities are responsible for implementation of this Decision./.

MANAGEMENT OF MARITIME PLASTIC WASTE, PERIOD OF 2020-2030

1. General objectives

Reduce maritime plastic waste in fishery sector in order to gradually manage maritime plastic waste by approaching from headwaters to the ocean, circular economy and green economic growth; raise awareness and social responsibilities of agriculture community, fishery community, and enterprises for plastic waste, and successfully achieve objectives of National strategy for general management of solid waste.  

2. Specific objectives:

a) Period of 2021 - 2025

- Raise awareness of relevant parties regarding reducing plastic wastes in fishery sector:

+ At least 70% of farmers and fisherman in coastal areas, concentrated culturing areas, and fishery management personnel are publicized and trained regarding management and reduction of plastic waste;

+ At least 80% of management personnel of marine sanctuaries are trained and publicized regarding management and action for reducing plastic waste.

- Reduce use of materials and specialized equipment made of single-use plastic:

+ At least 10% of fishery vessels and fishery facilities replace several materials and specialized equipment with environmentally friendly materials or multiple-use plastic;

+ At least 30% of small-scale fishery processing facilities replace 30% of single-use plastic bag with environmentally friendly materials or multiple-use plastic.

- Increase percentage of collection, classification, reuse, and processing of plastic waste from fishery activities:

+ At least 50% of fishery vessels collect plastic waste, transport to shore in collection areas, and transport to processing entities;

+ At least 70% of fishery culturing facilities in fishery culturing areas collect and classify plastic waste in order to transport to entities capable of processing;

+ At least 50% of small fishery culturing facilities collect and classify plastic waste in facilities before transporting to entities capable of processing;

+ 100% of export processing facilities and at least 50% of small processing facilities collect and classify plastic waste before transporting to processing entities;

+ At least 70% of fish ports collect and classify plastic waste, and transport to processing entities.

- 100% of marine sanctuaries develop supervision plans and organize collection, classification of plastic waste and transport to processing entities.

- Developed database on marine plastic waste in fishery.

+ Reduce porous floats by 50% in aquaculture;

+ At least 80% of small-scale fishery processing facilities replace 30% of single-use plastic bag with environmentally friendly materials or multiple-use plastic.

- In case percentage of collection, classification, reuse, and processing of plastic waste from fishery activities:

+ 100% of fishery vessels collect plastic waste, transport to shore in collection areas, and transport to processing entities;

II. PRIMARY TASKS AND MEASURES

1. Raise awareness, responsibilities and change habits of fishery community and relevant parties

a) Primary contents

- Develop and implement communication and education to raise awareness regarding management of plastic waste in coastal fishery community, especially fishermen, farmers, and enterprises engaging in fishery sector, depending on specific sector;

- Organize training to improve capacity of personnel specialized in fishery from central to local governments, associations, professional unions, and relevant social organizations regarding regulations and law on waste management in general, and plastic waste in specific;

- Diversify methods of publicizing and integrating popularization regarding plastic waste when publicizing environmental protection in agricultural extension and fishery extension courses;

- Perform functions of youth organizations, woman’s organizations, profession associations, etc. in order to regularly organize cleaning of maritime environment, coastal environment, concentrated aquaculture areas, fish ports, and marine sanctuaries;

- Publicize and promote application of 5R (5R - Renew, Refuse, Reduce, Reuse, Recycle) in fishery production and coastal fisherman community;

- Multiply model “Say no to nylon bags and single-use plastic products” in marine sanctuaries.

b) Period and responsibilities for implementation

- Implementation period: 2021 – 2030.

- Responsibilities for implementation

+ Directorate of Fisheries shall take charge composing documents for publicizing and training personnel; develop communication schemes to raise awareness in management of marine plastic waste in fishery sector; cooperate with coastal provinces/cities to publicize legislative documents, action plans, raise awareness and capacity for managing plastic waste for local officials, fisherman community, enterprises, social organizations, etc.;

+ Local governments shall take charge organizing and composing materials for instances of publicizing and training officials of all levels, fisherman community, enterprises, social organizations, and organizations aiming to clean marine environment;

2. Develop and complete legislative documents regarding management of marine plastic waste in fishery

a) Primary contents

- Review and amend legislative documents on management of waste in general and plastic waste in specific to ensure implementation of obligations under agreements and international agreements (Marpol, London, Basel…);

- Review and amend technical regulations applicable to fishing vessels, culturing facilities, and processing facilities to reduce the use of materials and specialized equipment made of single-use plastics with low useful life;

- Review and amend regulations on imposing administrative penalties for disposing plastic waste when conducting fishery activities;  

- Conduct research and develop policies incentivizing investment in scientific and technological research for solutions for manufacturing substitute materials for plastic and nylon in fishery sector;  

- Develop policies assisting and encouraging enterprises, organizations, and individuals engaging in fishery sectors to collect and use green products, exchange, reuse, and process plastic waste; preferential treatment for island communes regarding taxes, fees, etc. to encourage collection, reuse, and processing of plastic waste;

- Conduct research and develop policies on extended liabilities of manufacturers of materials and specialized equipment using plastic in fishery manufacturers;

- Develop policies assisting owners of fishing vessels, aquaculture households, small processing facilities in replacing materials, specialized equipment, packaging materials on fishing vessels, and in fishery culturing and processing, etc. with environmentally friendly materials, multi-use materials, biodegradable materials;

- Responsibilities for implementation

+ Ministry of Agriculture and Rural Development and Directorate of Fisheries shall take charge and cooperate with ministries, local governments, domestic and foreign international organizations, relevant enterprises in reviewing and amending national technical regulations, conducting research to develop preferential treatment, policies on extended liabilities of manufacturers in fishery and manufacturing of plastic materials, specialized equipment in fishery;

+ Local governments, education institutions, and research institutes shall review and amend local technical regulations; propose preferential and incentivize policies in local administrative divisions.  

3. Reduce plastic waste, collect, classify from sources, reuse, recycle, and gradually replace specialized plastic materials in fishery

a) Primary contents

- Investigate and assess use, emission of nylon bags, single-use plastic products on fishing vessels, fish ports, and fishery processing facilities;

- Assess and research possibility of removing materials and specialized equipment made of single-use plastic, reduce production of plastic waste in extraction, culturing, and processing fishery;

- Organize commitment of owners of fishing vessels, aquaculture facilities at sea regarding not disposing plastic waste into the ocean and collecting plastic waste in order to transfer to processing entities;

- Develop effective and flexible models of increasing private sector involvement in collecting, classifying, exchanging domestic plastic waste in fish ports, aquaculture areas, processing zones depending on conditions and customs of local farmers and fishermen;

- Develop teams of vessels for extracting and culturing fisheries (on land and at sea), small processing facilities, and community management model utilizing materials, specialized equipment and fishery packaging made from environmentally friendly materials or multi-use plastic and collect, exchange, classify plastic waste in sea waters aiming to satisfy new rural development, develop civilized and clean fishing villages, and develop craft village tourism services;

- Develop and implement scheme for collecting missing, discarded fishery tools at sea in sanctuaries, aquatic resource protection zones, and other sea waters;

- Develop, implement plans for supervising, and organize collection, classification of plastic waste in marine sanctuaries;

- Increase private sector involvement and public-private collaboration in recycling and reusing environmentally-friendly materials, and promote circular economy, green growth;  

- Conduct pilot implementation of extending liabilities of manufacturers of materials and specialized equipment made of plastic in fishery.

b) Period and responsibilities for implementation

- Implementation period: 2021 – 2030.

+ Directorate of Fisheries shall take charge and cooperate with local governments in organizing inspection and supervising development, implementation of Action plan for management of marine plastic waste in fishery sector;

+ Directorate of Fisheries shall take charge of schemes for: collecting missing, discarded fishing equipment at sea; controlling, supervising plastic waste for fishing vessels and fish ports according to Marpol convention; collecting missing, discarded fishing equipment at sea in sanctuaries, aquatic resource protection zones and other sea waters; investigating and assessing use, emission of nylon bag, single-use plastic products on fishing vessels, fish ports, and fishery processing facilities, etc. Local governments, associations, professional associations, enterprises, education institutions, institutes, international organizations and non-governmental organizations are responsible for cooperating with Directorate of Fisheries in implementing the schemes;

+ Directorate of Fisheries shall take charge and cooperate with local governments, associations, professional associations, enterprises, education institutions, institutes, international organizations and non-governmental organizations in pilot implementing extended liabilities of manufacturers in fishery and manufacturers of plastic materials and specialized equipment in fishery;

+ Local governments shall cooperate with domestic and foreign organizations in mobilizing fishermen to commit to collecting plastic waste and protect the environment in order to replace specialized equipment, develop organizations for collecting, processing wastes, multiplying models for collecting, replacing, reusing, and recycling, community management models, and private sector involvement models for collecting, exchanging, and classifying plastic waste in coastal areas;

+ Marine sanctuaries shall develop plans for supervising and organize collection, classification of plastic waste in marine sanctuaries.

4. Conduct scientific research, apply, develop, transfer technology relating to management of marine plastic waste in fishery

a) Primary contents

- Conduct research for replacing materials and specialized equipment in extracting, culturing, and processing fisheries to reduce the use of single-use plastic or improve useful life depending on profession, product type, natural properties;

- Conducting research, apply pressing, cutting, etc. technologies to reduce volume and easily contain plastic waste on vessels after extracting fisheries;

- Conduct research on impact of micro plastic on fishery production chains;

- Investigate and assess to serve developing and updating database on management of marine plastic waste in fishery.

b) Period and responsibilities for implementation

- Implementation period: 2021 – 2030.

- Responsibilities for implementation: Directorate of Fisheries shall take charge and cooperate with local governments, associations, professional associations, enterprises, education institutions, institutes, international organizations and non-governmental organizations.

5. Increase international cooperation

a) Primary contents

- Increase researching, exchanging experience in managing, using, renovating fishing equipment and specialized equipment in fishery production with environmentally friendly materials to reduce production of plastic waste;

- Share information, organize regional and international conferences regarding management of marine plastic waste;

- Propose schemes and projects to mobilize financing of developed countries and international organizations regarding technical and financial matters for reducing plastic waste of fishery.

b) Period and responsibilities for implementation

- Implementation period: 2021 – 2030.

- Responsibilities for implementation: Ministry of Agriculture and Rural Development and Directorate of Fisheries shall take charge for implementation.

III. ORGANIZATION FOR IMPLEMENTATION

Within the objectives, tasks and lists of priority tasks of Action plan for management of marine plastic waste in fishery sector, period of 2020 – 2030, entities and organizations affiliated to Ministry of Agriculture and Rural Development shall cooperate with entities affiliated to ministries, sectors, local governments, relevant agencies and organizations in developing details and funding estimates of priority tasks and requesting competent authority to approve to serve as the basis for identifying and allocating funding; propose and implement activities for Plan execution. 

1. Responsibilities of entities and local governments

a) Directorate of Fisheries:

- Act as standing entity, take charge, and cooperate with entities and agencies affiliated to ministries, domestic and foreign organizations in developing and implementing activities in order to execute Action plan for management of marine plastic waste in fishery sector, period of 2020 – 2030;

- On an annual basis, supervise and assess implementation of the Action plan and submit reports to the Minister on Plan execution results on a periodic basis;

- Organize a conference for concluding 5 years of implementing the Action plan in 2025 and a conference for concluding the total Action plan for management of marine plastic waste in fishery sector, period of 2020 – 2030 in 2030.  

b) People’s Committees provinces and cities

- Direct Department of Agriculture and Rural Development to advise development specific plans of local governments; periodically organize of supervision of implementation in local administrative divisions and submit reports on Plan implementation results to Ministry of Agriculture and Rural Development and People’s Committees of provinces on an annual basis; propose amendment to regulations, law, and policies relating to Plan execution;

- Direct People’s Committees of all levels, relevant agencies, social and occupational organizations to regularly organize popularization and education regarding awareness, responsibilities of fisherman community regarding environmental protection, and individuals with good achievements; develop sample models in the community and conclude to duplicate;  

- Direct People’s Committees of all levels to develop systems for collecting, classifying, transporting, processing plastic waste in fish ports, coastal residential areas, aquaculture areas, etc. depending on local conditions;

- Allocate funding from local government budget while requesting private sector involvement and financing of enterprises and international organizations, publicize, develop systems for collecting, processing plastic waste, develop models, and implement incentive and preferential policies issued by local governments.

c) Departments of Agriculture and Rural Development of provinces and central-affiliated cities:

- Develop action plan for management of marine plastic waste in fishery, which includes advising local government budget for plan execution, and request People’s Committees of provinces and cities to approve funding;

d) Department of Planning-Finance:

Take charge appraising projects and topics relating to implementation of Action plan for management of marine plastic waste in fishery sector, period of 2020 – 2030, and provide advice regarding allocation of funding for Action plan implementation.

dd) Department of Science, Technology, and Environment:

Direct proposal of projects and topics of scientific research serving management, research, and transfer of advanced technologies in extracting, culturing, processing, and reducing plastic waste in fishery sector.

e) Education institutions and fishery research institutes:

Take charge developing and implement scientific research topics and projects; conduct research and renovate extraction, culturing, and processing technologies in order to reduce plastic waste in fishery sector; cooperate with authorities of Ministry of Agriculture and Rural Development in extending relationship with domestic and foreign partners in order to introduce advanced technologies to fishery production and reduce plastic waste.

g) Marine sanctuaries:

Actively develop and implement supervision of plastic waste, allocate adequate human resources for collection, classification, and processing of plastic waste in marine sanctuaries.  Integrate supervision of plastic waste in general activities of national parks and marine sanctuaries.

2. Expenditure on implementation

- State budget allocated from annual recurrent expenditure estimate of the Ministry and local governments, other relevant topics, projects shall conform to regulations and law on state budget;
