DECISION

PROMULGATING THE LIST OF DEVICES AND EQUIPMENT SUBJECT TO ENERGY LABELING AND APPLICATION OF THE MINIMUM ENERGY EFFICIENCY, AND THE IMPLEMENTATION ROADMAP

THE PRIME MINISTER

Pursuant to the December 25, 2001 Law on Organization of the Government;

Pursuant to the June 28, 2010 Law on Economical and Efficient Use of Energy;

Pursuant to the Government’s Decree No. 21/2011/ND-CP of March 29, 2011, detailing the Law on Economical and Efficient Use of Energy and measures for its implementation;

At the proposal of the Minister of Industry and Trade,

DECIDES:

1. Household appliances, including tubular fluorescent lamps, compact fluorescent lamps, electromagnetic and electronic ballasts for fluorescent lamps, air conditioners, refrigerators, washing machines, electric cookers, electric fans and television receivers.

2. Office and commercial equipment, including photocopiers, computer monitors, printers and commercial refrigeration cabinets.

3. Industrial equipment, including distribution transformers and electric motors.

4. Means of transport, including passenger cars of 7 seats or less.

Article 2. Roadmap for energy labeling

1. For household appliances and industrial equipment:

a/ Voluntary energy labeling is encouraged to be conducted until the end of December 31, 2012;

b/ Compulsory energy labeling shall be conducted from January 1, 2013.

2. For office and commercial equipment:

b/ Compulsory energy labeling shall be conducted for commercial refrigeration cabinets from January 1, 2014.

3. For means of transport:

a/ Voluntary energy labeling is encouraged to be conducted until the end of December 31, 2014;

b/ Compulsory energy labeling shall be conducted from January 1, 2015.

4. Voluntary energy labeling is encouraged for devices and equipment not on the list specified in Article 1 of this Decision.

Article 3. Roadmap for application of the minimum energy efficiency

1. For household appliance:

Import and manufacture of equipment with an energy efficiency lower than the minimum energy efficiency will be prohibited from January 1, 2014.

2. For industrial, office and commercial equipment:

3. For light bulbs (incandescent lamps):

Import, manufacture and circulation of incandescent lamps with a power output higher than 60W will be prohibited from January 1, 2013.

Article 4. Measures to support the energy labeling and application of the minimum energy efficiency

1. Investing in construction of specialized testing establishments and equipment for examining, testing and certifying energy efficiency of devices and equipment subject to energy labeling according to the roadmap.

2. Training and raising professional skills for managers and technicians and skilled workers engaged in energy efficiency examination and testing for devices and equipment subject to energy labeling.

3. Organizing communication and public information on devices and equipment subject to energy labeling and application of the minimum energy efficiency.

4. Formulating projects to promote the energy labeling for subjects according to the roadmap specified in this Decision.

5. Providing support funds from the national target program for economical and efficient use of energy for establishments changing or innovating the manufacturing of energy-efficient products according to the roadmap of energy labeling and application of the minimum energy efficiency.

Article 5. Organization of implementation

a/ Guide, examine and supervise the energy labeling for devices and equipment subject to energy labeling specified in Clauses 1 and 2, Article 2 of this Decision;

b/ Assume the prime responsibility for, and coordinate with related ministries and sectors in, proposing the Prime Minister to supplement the list of energy-consuming devices and equipment subject to energy labeling and application of the minimum energy efficiency;

c/ Devise and implement measures to support the implementation of the roadmap of energy labeling and application of the minimum energy efficiency specified in Article 4 of this Decision.

2. The Ministry of Transport shall assume the prime responsibility for guiding, examining and supervising the energy labeling for devices and equipment specified in Clause 3, Article 2 of this Decision.

3. Ministry of Science and Technology shall:

a/ Assume the prime responsibility for, and coordinated with related ministries and sectors in, establishing and promulgating national standards on energy efficiency and minimum energy efficiency rate for devices and equipment in conformity with the energy labeling roadmap;

b/ Promulgate energy efficiency standards for devices and equipment on the list of devices and equipment subject to energy labeling and application of the minimum energy efficiency before December 21, 2012;

c/ Revise and promulgate energy efficiency standards and minimum energy efficiency rate once every five years.

4. The Ministry of Finance shall:

b/ Assume the prime responsibility for, and coordinated with related agencies in, guiding procedures for importing devices and equipment subject to energy labeling and application of the minimum energy efficiency.

5. Provincial-level People’s Committees shall direct specialized agencies, local energy-efficient agencies in coordinating with related ministries and sectors in examining and supervising the energy labeling and application of the minimum energy efficiency for local devices and equipment on the list according to the roadmap provided in this Decision.

Article 6. Effect

1. This Decision takes effect on November 1, 2011.

2. Ministries, heads of ministerial-level agencies, heads of government- attached agencies, chairpersons of provincial-level People’s Committees, heads of agencies, units and organizations and concerned individuals shall implement this Decision.-
