DECISION

APPROVING PROPOSAL FOR STRENGTHENED MANAGEMENT OF PLASTIC WASTE IN VIETNAM

THE PRIME MINISTER

Pursuant to the Law on Government Organization dated June 19, 2015; the Law on Amending and Supplementing certain Articles of the Law on Government Organization and the Law on Local Government Organization dated November 22, 2019;

Pursuant to the Law on environmental protection dated June 23, 2014;

Pursuant to the Law on Environmental Protection dated November 17, 2020;

Pursuant to the Resolution No. 36-NQ/TW dated October 22, 2018 of the 8^th meeting of the Communist Party’s XII^th Central Committee regarding the Strategy for the sustainable development of the marine economy of Vietnam by 2030 and scheduled for 2045;

Pursuant to the Prime Minister’s Decision No. 491/QD-TTg dated May 7, 2018 on approval of revision of the National Strategy for comprehensive solid waste management by 2025 and scheduled for 2050;

Pursuant to the Government's Resolution No. 01/NQ-CP dated January 1, 2019 on key tasks and measures for implementation of the Socio-economic Development Plan and the 2019 State Budget Estimate;

Pursuant to the Government’s Resolution No. 09/NQ-CP dated February 3, 2019 related to the Government’s regular meeting held in January 2019;

Pursuant to the Prime Minister’s Decision No. 1746/QD-TTg dated December 4, 2019 regarding the National Action Plan for management of ocean plastic waste;

Pursuant to the Prime Minister’s Directive No. 33/CT-TTg dated August 20, 2020 regarding the strengthened management of reuse, recycling, disposal and minimization of plastic waste;

At the request of the Minister of Natural Resources and Environment,

HEREBY DECIDES

Article 1.Approving the Proposal for the strengthened management of plastic waste in Vietnam (hereinafter referred to as Proposal), including the following main contents:

I. OBJECTIVES

a) Strengthening management of plastic waste from the central to local level, contributing to the successful implementation of the national strategy for comprehensive solid waste management by 2025, scheduled for 2050, approved by the Prime Minister in the Decision No. 491/QD-TTg dated May 7, 2018; the Decision No. 1746/QD-TTg dated December 4, 2019 on the National Action Plan for ocean plastic waste management; the Directive No. 33/CT-TTg dated August 20, 2020 on the strengthened management of reuse, recycling, disposal and reduction of plastic waste.

b) Contributing to designing a circular economy model in Vietnam with the orientation towards reducing the use of non-biodegradable disposable plastic products and plastic bags; increasing the reuse, recycling and disposal of plastic waste.

2. Specific objectives

a) Completing mechanisms, policies and legal or regulatory frameworks regarding: Plastic waste management; production and consumption of non-degradable plastic bags used in daily life; disposable plastic products used in daily life (including plastic cups, bowls, plates, spoons, forks, straws, packaging/disposable food containers, food wrap, single-use plastic tableware...).

b) By 2025, striving to use 100% of eco-friendly plastic bags and packaging at commercial centers, supermarkets for domestic or household purposes to replace non-biodegradable plastic bags; ensure the collection, reuse, recycling and disposal of 85% of the generation of plastic waste; reduce 50% of plastic waste in the sea and ocean; strive to reach 100% of tourist resorts, tourist accommodation establishments and hotels that do not use non-biodegradable plastic bags and single-use plastic products; gradually reduce the production and use of non-degradable plastic bags and disposable plastic products in daily life.

c) Raising awareness of the production, consumption and disposal of non-biodegradable plastic waste, plastic bags and single-use plastic products in daily life amongst agencies, organizations, businesses, communities and people.

II. MISSIONS AND SOLUTIONS

1. Conducting investigation and survey into the generation, collection and disposal of plastic waste, and improving policies and regulations regarding plastic waste management.

a) Conducting investigation and survey into the generation, collection, recycling and disposal of plastic waste

- Surveying and evaluating the production and importation of products and goods containing microplastics and the impacts of microplastics on the environment.

- Investigating and surveying the current state of the generation, collection, recycling and disposal of plastic waste, and recommending measures for improvement of management efficiency.

- Investigating, making statistics of, classifying and evaluating the generation, collection, disposal and management of plastic waste released from activities on Vietnam's seas and islands.

- Assessing the collection of import and export duties levied on plastic products; the collection of environmental protection tax on the production of non-degradable plastic bags.

b) Formulating and completing policies and regulations on management of plastic waste

- Formulating and implementing policies to promote the development of the circular economy in the field of production and consumption of plastic products; regulating recycling responsibilities of manufacturers and importers of plastic products and plastic packaging.

- Completing mechanisms and policies to limit the use of non-biodegradable plastic bags and disposable plastic products. Studying and proposing a roadmap for the reduced production and import of single-use plastic products, non-biodegradable plastic packaging and products and goods containing microplastics.

- Reviewing and perfecting incentive and support mechanisms and policies for the production of eco-friendly products, substitutes for non-degradable disposable plastic products and plastic bags; encouraging the reuse and recycling of plastic waste for use in production of goods, production of building materials and reuse of plastic waste in traffic construction projects.

- Studying and proposing a roadmap for increasing environmental protection tax for non-degradable plastic bags; adding environmental protection tax for disposable plastic products for domestic uses.

- Developing synchronous policies for segregation, collection, recycling and disposal of plastic waste at source in conformity with respective local conditions in order to strengthen the reuse and recycling of plastic waste.

- Reviewing and completing legislative regulations on management of ocean plastic waste; management of plastic waste released from aquaculture and fishing production activities.

2. Carrying out training, communication and international cooperation activities related to plastic waste management.

- Promoting training and communication activities to raise awareness of the harmful effects of plastic products, plastic bags and disposable plastic products to the environment, ecosystem and human health; raising awareness, changing from the habit of using non-biodegradable disposable plastic products and plastic bags to the habit of using eco-friendly products.

- Persuading and encouraging enterprises producing and distributing non-degradable disposable plastic products and plastic bags to switch to producing and distributing environmentally friendly products.

- Organizing training, coaching activities, raising awareness and changing the habit of discharging plastic waste, fishing gear and plastic products into the sea and ocean environment amongst businesses, coastal residents, fishermen, seafarers and sea tourists.

- Setting up a network of promoters providing instructions about the separation, segregation, collection, recycling, disposal and management of waste in general and plastic waste in particular at localities. Providing training and coaching courses on specialized knowledge about and professional skills in information and communication relating to environmental protection and plastic waste management for public officers, reporters and editors of media and press agencies and public officers involved in grassroots-level communication and public relation activities. Giving compliments and rewards in a timely manner to organizations and individuals involved in helpful activities, solutions and initiatives relating to plastic waste management. 

- Designing school syllabuses appropriate in terms of formats and contents in the management of non-biodegradable plastic waste, plastic bags and disposable plastic products for integration into curriculums at all educational levels.

- Strengthening international cooperation, attracting foreign organizations and individuals to participate in training, research, technology transfer, information and experience sharing in order to improve the efficiency of plastic waste management and disposal activities in Vietnam.

- Strengthening participation and supervision roles of socio-political organizations and press agencies in the implementation of mechanisms and policies to limit the use of non-degradable plastic bags and disposable plastic products.

3. Studying and applying technologies, carrying out models and activities of management of plastic waste and manufacturing of environmentally friendly products.

- Uniformly planning and running the model of shopping centers and supermarkets that do not use plastic bags or use eco-friendly plastic bags to replace non-degradable plastic bags nationwide; creating and expanding models of waste recycling organizations and movements against plastic waste.

- Consistently planning and running the model of tourist sites, tourist accommodation and service establishments nationwide, especially those in coastal areas, that do not use non-degradable disposable plastic products and plastic bags.

- Designing programs and plans for collection of plastic waste floating in the environment (including collection, recycling and disposal of plastic waste discharged into river basins, coasts, beaches, tourist sites, ship locks and coastal fish markets).

- Strengthening the inspection and supervision of compliance with regulations on collection and disposal of plastic waste released from marine tourism, shipping, aquaculture and fishing activities; minimizing abandoned, lost or discarded fishing gear.

- Conducting the inspection and supervision of collection of the environmental protection tax levied on the production and consumption of non-degradable plastic bags under the management local authorities; ensuring collection of correct and sufficient environmental protection tax.

- Studying and applying advanced and modern technologies for the collection, recycling and disposal of plastic waste; technologies for recycling of plastic waste into fuels, materials, for construction and transportation purposes, and other plastic products.

- Increasing investment in and development of technologies for production of environmentally friendly products to replace plastic products; researching, designing and manufacturing best plastic packaging and products to minimize the norms of plastic materials/products.

- Improving the capacity of key laboratories to meet the requirements as to research, testing, evaluation and quality certification of packaging products replacing plastic products, and biodegradable and eco-friendly plastic bags, that meet Vietnamese regulations.

- Applying information technology in activities of monitoring and managing the production, collection, transportation, recycling and disposal of plastic waste; promoting the development of the waste recycling, disposal and management market; setting up and updating the plastics management database, and integrating it into the national environment database.

- Strengthening the examination and inspection for sanctioning of organizations and individuals that violate legislation on environmental protection in the production and distribution of plastic products, and the collection, transportation and disposal of waste, including plastic waste.

III. PROPOSAL IMPLEMENTATION BUDGET AND PERIOD

1. Budget

- Costs and expenses for implementation of the Proposal are covered by the state budget and other funds (e.g. corporate equity and funds borrowed from credit institutions and international grants or aids).  

- Costs and expenses for performing tasks to enable state management activities, such as reviewing and perfecting organizational systems, mechanisms, policies and regulations of laws; formulating technical standards and regulations; training and developing human resources; developing markets; carrying out propaganda and awareness raising activities, etc. are covered by the state budget according to annual plans and programs of ministries, central and local authorities.

- Funds for implementation of investment activities and development of technologies for manufacturing of environmentally friendly products and equipment used for plastic waste treatment are mobilized from enterprises, domestic and foreign loans, partial grants or aids from the Vietnam’s Environmental Protection Fund and local Environmental Protection Funds, local Development Investment Funds, public-private partnerships (PPP) and other legitimate capital.

IV. IMPLEMENTATION ASSIGNMENTS

1. Ministers, Heads of Ministry-level agencies, Governmental bodies and Presidents of People’s Committees of centrally-affiliated cities and provinces shall, within their respective remit, proactively formulate plans and carry out missions under their authority delegated by the Government; sending annual performance review reports to the Ministry of Natural Resources and Environment for its preparation of a general report for submission to the Prime Minister.

2. Ministry of Natural Resources and Environment

a) Take charge of examining, inspecting and supervising the implementation of the Proposal nationwide.

b) Reviewing, studying, proposing the promulgation or, under its delegated authority, promulgating regulations on plastic waste management; studying and proposing a roadmap to limit the production and importation of non-biodegradable disposable plastic products, plastic packaging, products and goods containing microplastics in the Decree specifying implementation of a number of articles of the Environmental Protection Law; proposing regulations on recycling responsibilities of manufacturers and importers of plastic products and plastic packaging; proposing regulations on eco-labels for environmentally friendly plastic bags and products according to regulations.

c) Studying, formulating and issuing regulations or guidelines for the implementation of environmental regulations in the production of environmentally friendly products and goods containing microplastics and plastic bags.

d) Undertaking the implementation of the Prime Minister’s Decision No. 1746/QD-TTg dated December 4, 2019, issuing the National Action Plan on management of ocean-based plastic waste by 2030; the Prime Minister’s Directive No. 33/CT-TTg dated August 20, 2020 on strengthening of management, reuse, recycling, disposal and reduction of plastic waste.

dd) Cooperating on studying, applying and transferring technologies for recycling of plastic waste and manufacturing of eco-friendly products in place of non-degradable plastic bags and disposable plastic products. Providing instructions about certification and granting certificates of Vietnam’s eco-labels for environmentally friendly plastic bags and other eco-friendly products in accordance with law. Taking charge of and providing guidance on the implementation of recycling responsibilities of manufacturers and importers of plastic products and plastic packaging in accordance with law.

e) Guiding the implementation of the State's incentive policies for investment projects on construction of plastic waste recycling facilities and projects on manufacturing of environmentally friendly products in place of non-degradable plastic bags and disposable plastic products.

h) Conducting the examination and inspection of organizations and individuals that violate legislation on environmental protection in terms of waste management in general and plastic waste in particular.

i) Conducting training, communication and awareness raising activities for manufacturers, importers, distributors, consumers and related agencies on reduction, recycling, reuse and disposal of plastic waste. Expanding communication and awareness raising campaigns involving organizations and individuals in reduction and management of plastic waste throughout provinces and centrally-affiliated cities.

k) Seeking, disseminating and offering environmental rewards to models, solutions and initiatives related to the reduction, separation, segregation, collection, recycling and disposal of plastic waste; studying criteria for reduction, separation, segregation and collection of plastic waste and taking them into consideration for the assessment and ranking of environmental protection performance results of provinces and centrally-run cities.

l) Developing a roadmap and guidelines for sorting of household solid waste and plastic waste at source to suit local infrastructure and conditions in order to reuse and recycle plastic waste in at the greatest extent and in an efficient manner; piloting state-of-the-art technological models, plastic waste  management and disposal models in Vietnam.

m) Undertaking activities of international cooperation in sustainable production and consumption; acting as the lead agency specializing in promoting bilateral and multilateral cooperation in plastic waste management (effecting the National Plastic Action Partnership in Vietnam with the World Economic Forum; reducing ocean plastic waste in Vietnam with WWF...); acting as the lead agency for participation in international conventions and treaties related to waste and ocean plastic waste management.

n) Step by step developing the circular economy in line with the net zero emissions target; using modern technologies for the production of plastic products; optimizing the use of raw materials and fuels in the production of plastic products; maximally reusing and recycling plastic waste into raw materials and fuels for industrial and domestic uses; supporting the construction and formation of the waste recycling market; building, updating the plastic management database and integrating it into the national environmental database.

3. Ministry of Finance

a) Reviewing and completing financial mechanisms and policies for reduction in the use of non-degradable plastic bags and single-use plastic products; encouraging investment in production and consumption of environmentally friendly products; studying and providing competent authorities with recommendations about adjustment in the environmental protection tax rate applied to non-degradable plastic bags and addition of the environmental protection tax on single-use plastic products for household use at the appropriate time.

b) Conduct the examination of the collection of environmental protection tax levied on the production of non-degradable disposable plastic products and bags.

a) Guiding production facilities to change the design of plastic packaging and plastic products with a view to minimizing the norm of plastic materials/plastic products; supporting and encouraging production facilities to gradually increase the proportion of recycled plastic materials contained in merchandise.

b) Commanding or carrying out activities of persuading manufacturers, commercial centers, supermarkets, outlet or retail stores to register participation in the movement against plastic waste; directing the process of constructing a model of commercial centers, markets and supermarkets that do not use non-degradable disposable plastic products and plastic bags.

c) Proposing mechanisms and policies to boost the production and consumption of recycled plastic products, and the industry of manufacturing plastic products using plastic scrap together with the development of the environmental industry.

d) Acting as the lead agency and cooperating with the Ministry of Natural Resources and Environment in assessing the demands for plastic scrap for use as raw materials in domestic production activities, and the demands for plastic scrap imported from foreign countries, as a basis to revise the list of scrap or waste permitted for import over time periods of development of our country.

5. Ministry of Science and Technology

a) Continuing to invest in and improve the capacity of key laboratories to meet the requirements as to research, testing and evaluation of eco-friendly products replacing non-degradable plastic bags and disposable plastic products.

b) Implementing scientific research programs and projects on recycling and disposal of plastic waste to turn them into raw materials and fuels; manufacturing of environmentally friendly alternatives to disposable plastic products and non-biodegradable plastic bags.

c) Acting as the lead agency and cooperating with the Ministry of Natural Resources and Environment in researching, receiving and transferring advanced and modern technologies for recycling and disposal of plastic waste.

6. Ministry of Information and Communications

b) Cooperating with the Ministry of Natural Resources and Environment in propagating and disseminating regulations on environmental protection, regulations on the reduction and disposal of plastic waste, and the harmful effects of plastic waste on the environment and people through various methods of press and grassroots-level communication systems to raise public awareness and sense of responsibility.

7. Ministry of Education and Training

a) Designing school syllabuses appropriate in terms of formats and contents in the management of non-biodegradable plastic waste, plastic bags and disposable plastic products for integration into curriculums at all educational levels.

b) Providing instructions about arranging activities of reducing, sorting and collecting plastic waste into criteria for evaluation of a green - clean - beautiful - safe school to be applied nationwide.

8. Ministry of Agriculture and Rural Development

a) Effectively implementing the national target program on construction of new rural areas which is supplemented with criteria for management and disposal of plastic waste. Providing complete guidance on implementation and recognition of conformance to environmental standards of communes and districts according to current regulations.

b) Planning and implementing activities of reducing the generation, collection, recycling, disposal and management of plastic waste in agricultural, forestry and fishery production activities.

c) Providing directives on inspecting, supervising and providing instructions about the management of discarded fishing gear in aquaculture and fishing activities.

9. Ministry of Planning and Investment

b) Controlling and restricting investment of state capital in projects on manufacturing of disposable plastic products and non-degradable plastic bags.

c) Directing the implementation of public-private partnerships in plastic waste reduction, recycling and disposal activities.

d) Taking charge of and cooperating with the Ministry of Natural Resources and Environment, and the People's Committees of provinces and centrally run cities in reviewing and implementing the proposals for establishment of industrial parks specializing in the waste recycling and plastic waste recycling industry.

10. Ministry of Health

a) Directing the implementation of activities of reduction, separation, segregation, reuse, recycling and disposal of plastic waste at medical facilities, pharmacies and pharmaceutical manufacturing facilities.

b) Promulgating quality regulations relating to recycled plastic products used as food packaging and plastic beverage bottles to ensure that they do not adversely affect human health.

c) Increasing investment, research and application of new and modern technologies in the development of environmentally friendly products and materials to replace disposable plastic products and non-degradable plastic bags in the health industry.

11. Ministry of Culture, Sports and Tourism 

a) Planning and carrying out activities and movements against non-biodegradable plastic bags and single-use plastic products at tourist resorts, tourist accommodation establishments and hotels nationwide.

12. People’s Committees of centrally-affiliated cities and provinces

a) Cooperating with ministries and central authorities to implement mechanisms, policies, laws and solutions on plastic waste management within their respective remit. Reviewing, amending, supplementing existing regulations and formulating new regulations on the reduction, reuse, recycling and disposal of plastic waste to suit current regulations and actual local conditions; providing instructions about the development of regulatory mechanisms, local regulations and conventions aimed at involving the community in plastic waste management and environmental protection activities; regulations on management of fast food delivery services with a view to minimizing the use of plastic packaging; promoting the use of boxes and packaging made from reusable or environmentally friendly materials.

b) Having solutions to restricting the investment in construction of new facilities producing disposable plastic products and non-degradable plastic bags for domestic use within their remit.

c) Putting forward plans and roadmaps to reduce and gradually ban the use of non-biodegradable plastic bags at commercial centers, supermarkets and open markets; requiring supermarkets, commercial centers and convenience stores to publicly announce the selling prices of plastic bags to customers; directing the synchronous implementation of solutions to sorting, collecting, recycling and disposing of plastic waste for urban centers and concentrated rural residential areas; expanding the scope of collection, transportation and disposal of domestic solid waste in rural and mountainous communes within their remit.

d) Allocating annual local environmental funds to support the collection and disposal of plastic waste; developing and implementing good practice models of management of waste discharged from the use of single-use plastic products and non-biodegradable plastic bags to suit local characteristics; reviewing, making statistics of and publishing a list of organizations and individuals manufacturing disposable plastic products, non-degradable plastic bags, biodegradable plastic bags and environmentally friendly products within their remit.

dd) Cooperating with the Ministry of Planning and Investment and the Ministry of Natural Resources and Environment to check and allocate vacant land for and propose the establishment of industrial parks and clusters for recycling of waste and plastic waste in accordance with legislative regulations.

e) Commanding tourist resorts, tourist accommodation establishments and hotels not to use non-degradable plastic bags and disposable plastic products within their remit; directing the collection and disposal of plastic waste floating in the environment (on rivers, streams, canals, channels, coasts, beaches, coastal fishing ports, marine reserves).

g) Implementing prescribed incentive policies for investment projects on construction of plastic waste recycling and disposal facilities, and projects on manufacturing of environmentally friendly products in place of non-degradable plastic bags and disposable plastic products.

h) Actively seeking and calling for involvement of all economic sectors in investment in the waste sorting, collection, transportation and disposal within their jurisdiction; providing instructions about and implementing the sorting of domestic solid waste and plastic waste at source to suit specific natural and socio-economic conditions of each locality.

k) Conducting the examination and supervision of the collection of environmental protection tax levied on the production of disposable plastic products and non-degradable plastic bags within their jurisdiction.

l) Strengthening the inspection, examination and supervision of plastic waste collection, transportation and disposal entities within their jurisdiction; taking measures to oversee and sanction commercial centers, supermarkets and convenience stores that provide free plastic bags to customers within their remit.

Article 2.This Decision shall enter into force from the signature date.

Article 3.Minister of Natural Resources and Environment, Ministers, Heads of Ministry-level agencies, Heads of Governmental bodies, Chairpersons of People’s Committees of centrally-affiliated cities and provinces, other organizations and individuals involved shall be responsible for implementing this Decision.
