Decision 20/2021/QD-TTg on the list and regulations on the management and use of supplies, means and specialized equipment for natural disaster prevention and control promulgated by the Prime Minister

DECISION

ISSUING THE LIST AND REGULATIONS ON USE AND MANAGEMENT OF DEDICATED DISASTER PREVENTION AND CONTROL SUPPLIES, VEHICLES AND EQUIPMENT

Pursuant to the Law on Government Organization dated June 19, 2015; the Law on Amending and Supplementing certain Articles of the Law on Government Organization and the Law on Local Government Organization dated November 22, 2019;

Pursuant to the Law on Disaster Prevention and Control dated June 19, 2013; the Law on Amendments and Supplements to certain Articles of the Law on Disaster Prevention and Control, and the Law on Dykes dated June 17, 2020;

Pursuant to the Law on Management and Use of Public Property dated June 21, 2017;

At the request of the Minister of Agriculture and Rural Development;

The Prime Minister issues the Decision on the list and regulations on use and management of dedicated disaster prevention and control supplies, vehicles and equipment.

Article 1. Scope

1. This Decision prescribes the list, use and management of the state’s dedicated disaster prevention and control supplies, vehicles and equipment.

2. Disaster prevention and control supplies, vehicles and equipment that are not covered herein shall be managed and used in accordance with applicable laws.

Article 2. Regulated entities   

This Decision shall apply to agencies, organizations and individuals involved in use and management of the State’s dedicated disaster prevention and control supplies, vehicles and equipment.

Article 3. List of dedicated disaster prevention and control supplies, vehicles and equipment   

1. Dedicated disaster prevention and control supplies, vehicles and equipment  are means of transport, supplies and equipment  having special structure, properties and functions that are directly used for performing the tasks of preventing and controlling natural disasters of agencies and organizations.

2. The list of dedicated disaster prevention and control supplies, vehicles and equipment shall be specified in the Appendix hereto.

Article 4. Sources for the formation of dedicated disaster prevention and control supplies, vehicles and equipment   

Dedicated disaster prevention and control supplies, vehicles and equipment are formed from the state budget and other legitimate funding sources.

Article 5. Use and management of dedicated disaster prevention and control supplies, vehicles and equipment   

1. Dedicated disaster prevention and control supplies, vehicles and equipment must be managed and used in accordance with laws on use and management of public property. Agencies, organizations and individuals tasked with using and managing dedicated disaster prevention and control supplies, vehicles and equipment shall be responsible for using them for prevention and control of natural disasters according to the assigned functions and duties as well as laws.

2. Dedicated disaster prevention and control supplies, vehicles and equipment  shall be used for activities of prevention, response to and mitigation of consequences of natural disasters; may be used for other tasks of agencies and organizations according to the regulations on management and use issued by competent persons, but must be always ready when a natural disaster occurs.

3. Based on the actual situation, agencies and organizations shall provide training, drilling and instructions for use of dedicated disaster prevention and control supplies, vehicles and equipment according to technical requirements and for right purposes. 

4. During the process of using, preserving and storing dedicated disaster prevention and control supplies, vehicles and equipment , agencies, organizations and individuals tasked with use and management of them must carefully check the technical condition, the status of maintenance, repair, and reporting to competent authorities to seek their decisions on the situations in which dedicated disaster prevention and control supplies, vehicles and equipment  are lost, damaged, or consumed during the task performance process.

5. When being mobilized for use to respond to emergencies arising from natural disasters, means and equipment specially used for disaster prevention and control shall be given priority in accordance with laws.

6. The Commanding Committees for Natural Disaster Prevention and Control, Victim Search and Rescue at all levels shall direct or advise competent persons to take charge of operating and mobilizing dedicated disaster prevention and control supplies, vehicles and equipment  according to their delegated authority and disaster situations.

7. Annually, the Commanding Committees for Natural Disaster Prevention and Control, Victim Search and Rescue at all levels shall take charge of inventorying, keeping track of and assessing the current state of dedicated disaster prevention and control supplies, vehicles and equipment of agencies and organizations within their respective remit to serve the purposes of leading the supervision of natural disaster prevention and control, and reporting to the superior commanding committees.

8. Annually, the Standing Offices of the Commanding Committees for Natural Disaster Prevention and Control, Victim Search and Rescue shall preside over and cooperate with the Office of the National Committee for Response to Natural Disasters, Search and Rescue in reviewing and synthesizing reports on the current state of dedicated disaster prevention and control supplies, vehicles and equipment  submitted by the Commanding Committees for Natural Disaster Prevention and Control, Victim Search and Rescue in provinces, Ministries and central authorities to serve the purposes of supervision of disaster prevention and control activities nationwide, and reporting to the Head of the National Committee for response to natural disasters.

9. Heads of agencies and organizations assigned to use and manage dedicated disaster prevention and control supplies, vehicles and equipment shall be responsible for issuing regulations and implementing these regulations on use and management of dedicated disaster prevention and control supplies, vehicles and equipment in accordance with law.

Article 6. Responsibilities of agencies and organizations

1. Ministries, central and local authorities:

a) Issuing standards and norms of dedicated disaster prevention and control supplies, vehicles and equipment to be used of agencies and organizations with the management under laws on use and management of public property;

b) Proactively allocating funds, approving and organizing the implementation of plans for procurement of dedicated disaster prevention and control supplies, vehicles and equipment of agencies and organizations under their management in accordance with their respective functions and duties, and the provisions of law;

c) Taking charge of inventorying, keeping track of and assessing the current state of dedicated disaster prevention and control supplies, vehicles and equipment of agencies and organizations within their respective management to serve the purposes of leading the supervision and operation of natural disaster prevention and control on an annual basis, and reporting to the superior Commanding Committees for Natural Disaster Prevention, Control, Victim Search and Rescue;

d) Annually, the Commanding Committees for Natural Disaster Prevention and Control, Victim Search and Rescue in provinces, ministries and central authorities shall prepare review reports on the current state of dedicated disaster prevention and control supplies, vehicles and equipment of agencies and organizations within their respective remit for submission to the National Commanding Committee for Natural Disaster Prevention and Control, and the National Committee for Emergency and Natural Disaster Response, Victim Search and Rescue for preparation of the general review report.

2. The Standing Office of the National Commanding Committee for Natural Disaster Prevention and Control shall synthesizing review reports on the current state of dedicated disaster prevention and control supplies, vehicles and equipment submitted by ministries, central and local authorities before March 31 each year to serve the purposes of administering and supervising disaster prevention and control activities of the National Commanding Committee for Natural Disaster Prevention and Control.

3. The Ministry of Agriculture and Rural Development - the standing body of the National Commanding Committee for Natural Disaster Prevention and Control:

a) Integrating proposals of ministries, central and local authorities into the final report submitted to the Prime Minister to seek his approval of any possible adjustment or supplementation of the List of dedicated disaster prevention and control supplies, vehicles and equipment;

b) Issuing usage and distribution standards and norms of funds, approval and implementation of plans for purchase of dedicated disaster prevention and control supplies, vehicles and equipment for the purposes of administration and supervision by the National Commanding Committee for Natural Disaster Prevention and Control according to their appropriate functions and duties, and provisions of laws.

4. Agencies authorized to play standing roles in performing natural disaster prevention and control, search and rescue activities under the control of ministries, central and local authorities shall organize the formulation of plans for procurement of dedicated disaster prevention and control supplies, vehicles and equipment necessary for natural disaster prevention and control activities, and submit them to competent authorities to seek their approval in accordance with the provisions of law.

Article 7. Entry into force

This Decision shall commence as of July 20, 2021.

Article 8. Implementation responsibilities

Ministers, Heads of Ministry-level agencies, Heads of Governmental bodies, and Presidents of People’s Committees of centrally-affiliated cities and provinces, and Head of the National Commanding Committee for Natural Disaster Prevention and Control, shall be responsible for implementing this Decision.

APPENDIX

LIST OF DEDICATED DISASTER PREVENTION AND CONTROL SUPPLIES, VEHICLES AND EQUIPMENT
