CIRCULAR
GUIDELINES FOR FORMULATING LOCAL NATURAL DISASTER MANAGEMENT PLANS
Pursuant to the Law on Natural Disaster Management dated June 19, 2013;
Pursuant to the Law on Amendments to the Law on Natural Disaster Management and the Law on Dikes dated June 17, 2020;
Pursuant to the Government’s Decree No. 15/2017/ND-CP dated February 17, 2017 defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;
At the request of the Director General of the Vietnam Disaster Management Authority;
The Minister of Agriculture and Rural Development hereby promulgate a Circular on guidelines for formulating local natural disaster management plans.
Chapter I
GENERAL
Article 1. Scope
This Circular provides guidelines for formulating local natural disaster management plans as set out in Article 15 of the Law on Natural Disaster Management amended by Clause 10 Article 1 of the 2020 Law on Amendments to the Law on Natural Disaster Management and the Law on Dikes.
Article 2. Regulated entities
This Circular applies to organizations and individuals whose activities involve formulation of local natural disaster management plans.
Article 3. Procedures for formulating a natural disaster management plan
1. Review and collect documents; conduct basic data investigation and survey.
2. Determine and assess risks and propose solutions.
3. Formulate a draft of the natural disaster management plan; seek opinions of agencies and units concerned; receive, respond to and revise the draft.
4. Promulgate the natural disaster management plan: a People’s Committee shall approve and promulgate its plan.
Chapter II
LOCAL NATURAL DISASTER MANAGEMENT PLANS
Section 1. PROVINCIAL NATURAL DISASTER MANAGEMENT PLANS
Article 4. Contents of a provincial natural disaster management plan
1. Legal bases for formulating a plan: Law on Natural Disaster Management; Law on Amendments to the Law on Natural Disaster Management and the Law on Dikes; Law on Irrigation; National Strategy for Natural Disaster Management; legal documents elaborating laws and relevant documents.
2. Purposes and requirements: conformity with policies of the Communist Party, Government and provincial People's Council, natural disaster management strategy, planning and plan at superior level; forecasts, warnings; actual situation and resources of the province.
3. Natural, demographic, socio - economic and infrastructural characteristics, including:
a) Natural characteristics: geographical location, topographical and geological characteristics, meteorological, hydrographic and oceanographic characteristics.
b) Demographic, socio - economic and main infrastructural characteristics prescribed in Article 5 hereof.
4. Assessing the natural disaster management as prescribed in Article 6 hereof.
5. Determining and assessing disaster risks, including determining common types of natural disasters; scope, method and contents of the assessment prescribed in Article 7 hereof.
6. Natural disaster management measures, including preparedness, response, recovery and reconstruction measures suitable for levels of disaster risks; integrated flood management plan for provincial river basins and other related plans prescribed in Article 8 hereof.
7. Integrating natural disaster management contents: determining measures and methods for integrating natural disaster management contents into socio - economic development planning and plans under the guidance of the Ministry of Planning and Investment.
8. Determining resources and schedule every year and every 05 years as prescribed in Article 9 hereof.
9. Determining responsibilities of organizations and individuals for implementing, inspecting and supervising the implementation of the natural disaster management plan as prescribed in Article 10 hereof.
Article 5. Provincial demographic, socio - economic and infrastructural characteristics
1. Demographic and socio - economic characteristics:
a) Demographic characteristics including total population, population density and distribution, vulnerable subjects, ethnic minorities, percentage of poor households, near-poor households, number of households in areas at high risk of natural disaster effects requiring relocation; residential housing characteristics (permanent, semi-permanent, less-permanent, simple-permanent) and distribution by district-level administrative units; level of culture, education and health, ethnicity and customs.
b) Socio - economic characteristics including main economic sectors affected by natural disasters (agriculture, forestry, fishery, industry, commerce, tourism and services), local socio - economic development orientations.
2. Infrastructural characteristics:
Generally producing statistics on and assessing main infrastructure within the scope of management, including: traffic, irrigation and natural disaster management systems; power network, communications, radio and television systems; water drainage system, drinking water supply system, environmental remediation system; systems of schools, hospitals and industrial parks; rescue roads and other infrastructure. Contents of general statistics and assessment of the whole province or central-affiliated city with respect to the natural disaster-hit areas therein shall have district-specific details.
Article 6. Assessment of natural disaster management
1. Legal documents and policies on natural disaster management: assess level of implementation of laws and policies; plan to provide resources and operating conditions for Command Centers for Natural Disaster Management and forces in charge of natural disaster management.
2. Natural disaster management and search and rescue command systems at all levels and cooperation regulation: describe organizational structures of Command Centers for Natural Disaster Management; human resources and capacity of full-time and part-time forces for natural disaster management of standing natural disaster management authorities at all levels; infrastructure and equipment of Standing Offices of provincial- and district-level Command Centers for Natural Disaster Management; regulations on assigning tasks to members and regulations on cooperation between agencies concerned.
3. Early warning and forecasting: Assess the early warning and forecasting carried out locally through central government authorities, hydro-meteorological forecasting agencies and forecasting and warning agencies of the province and region with respect to the detailedness, reliability, adequacy, continuity, promptness, ease of understanding and news broadcasting tools.
4. Vehicles, materials and equipment serving natural disaster management: produce statistics on and assess the status, lists, quantity, quality, location of storage and organizations and individuals assigned to perform management thereof. Conduct general assessment of regulations on management and use thereof, current capacity and demand thereof in the future.
5. Natural disaster response and search and rescue: assess key forces’ capacity for natural disaster response and search and rescue in the province; participation by other civil organizations and individuals. The assessment shall focus on quantity, capacity, equipment and vehicles of these forces.
6. Natural disaster management information and communication: Assess the status of local information and communication systems; methods of natural disaster management information dissemination and communication. Assess the province’s capacity for applying and managing natural disaster management database.
7. The community’s capacity and awareness of natural disaster management:
Conduct general assessment of awareness of and skills in response to natural disasters and training in natural disaster management in the province.
8. Infrastructure serving natural disaster management: Assess the system of works serving natural disaster management (meteorological, hydrographic, oceanographic and seismic observatories, disaster warning stations, dikes, dams, reservoirs, embankments, works serving prevention of inundation, droughts, saltwater intrusion, landslides, land subsidence and flashfloods, and lightning protection works, storm shelters for boats, evacuation houses, works serving forest fire prevention fighting and other works serving natural disaster management); electric power system, communication system, radio and television broadcasting system; traffic system serving search and rescue.
9. Assess the integration of natural disaster management contents in industry distribution and development and socio - economic development programs, projects, planning and plans: instructional documents; integration results, advantages and disadvantages; proposals and recommendations.
10. Assess post-natural disaster recovery and reconstruction: assistance in natural disaster relief and recovery (producing statistics on and assessing damage and demands); results of implementation of assistance policy and use of emergency resources for infrastructure repair, life stabilization and sustainable livelihood; execution of projects on establishment of settlements in natural disaster-hit areas.
11. Assess financial resources for natural disaster management in the province, direct or indirect investment (through the integration contents), including budget for recurrent expenditure, budget for development investment expenditure, state budget reserves, financial reserve fund, ODA funding, financial assistance from foreign organizations, disaster management fund and other legal sources.
Article 7. Determination and assessment of natural disaster risks
1. Determine common types of natural disasters based on the disaster risk zoning specified in Table 1 of Appendix I enclosed herewith and disaster alert map of the Ministry of Natural Resources and Environment under Point b Clause 1 Article 17 of the Law on Natural Disaster Management.
2. Assess natural disaster risks
a) Scope of assessment:
Spatial scope: carry out disaster risk assessment by local administrative units; time scope: carry out assessment of risks of future climate-change disasters (based on the latest climate change scenario published by the Ministry of Natural Resources and Environment), the series of collected data on the intensity of natural disasters and damage over the last 05 to 10 years and statistics on historical and major natural disasters that occurred before;
b) Methods and contents of assessment, in the following order of priority:
Assessing intensity of each type of local typical natural disaster according to regulations on levels of natural disaster risks promulgated by the Prime Minister and according to actually measured data and calculation results; assessing vulnerability of each affected subject such as humans, housing and some major economic sectors (agriculture, handicrafts, industry, commerce and tourism), infrastructure (traffic, construction, electric power, communication, irrigation, natural disaster management, health, education and culture infrastructure); general assessment of level of risk of each type of natural disaster affecting each subject due to the impact of climate change on socio - economic activities within the scope of management.
3. Making local disaster risk maps at scales of around 1:5.000 to 1:50.000 and in conformity with the maps of local administrative units; making maps at a scale larger than 1:5.000 in the case of areas frequently hit by natural disasters and highly populated areas; describing level of risk of each type of natural disaster using different colors (light blue: small risk, light yellow: medium risk, orange: significant risk, red: extreme risk and purple: catastrophic).
Article 8. Natural disaster management contents and measures
1. Determining natural disaster management contents and measures suitable for levels of natural disaster risks and specific types of natural disasters in order to reduce disaster risks, focusing on dangerous areas and vulnerable subjects, specifically: prevention and mitigation measures (structural measure and non-structural measures); natural disaster response measures and natural disaster relief and recovery measures.
2. Focusing on formulating integrated flood management plan for provincial river basins; strong typhoon and super typhoon preparedness plans; flash flood and land slide prevention plans; drought and saltwater intrusion prevention plans; plans for prevention of flood or flow-induced riverbank erosion or coastal erosion.
3. Specific measures tailored for several types of natural disasters mentioned in the Appendix II enclosed herewith. Basic measures for provincial natural disaster management mentioned in the Appendix III enclosed herewith.
Article 9. Resources and annual and 05-year schedules for implementation of the natural disaster management plan
1. Human and financial resources for implementation of the natural disaster management plan are set out in Articles 6 and 8 of the Law on Natural Disaster Management amended by Clauses 3 and 5 Article 1 of the Law on Amendments to the Law on Natural Disaster Management and the Law on Dikes.
2. Annual and 05-year schedules for implementation of the natural disaster management plan: Rely on the list of natural disaster management tasks, programs, schemes and projects to consider implementing them in the order of priority, carry out investment phasing and determine resources for implementation; annually review, update and make additions to the provincial natural disaster management plan. Provide funding for implementing annual and 05-year plans.
Article 10. Responsibilities of organizations and individuals for implementing, inspecting and supervising implementation of the natural disaster management plan
Determine contents of specific tasks and delegate responsibilities to organizations and individuals for implementing, inspecting and supervising the implementation of the natural disaster management plan.
1. Organize performance of the assigned tasks specified in the natural disaster management plan; schedule and resources for performance thereof.
2. Formulate an annual implementation plan to fulfill the objectives of the 05 year plan; review, assess and adjust the annual and 05-year natural disaster management plans.
3. Implement, supervise and assess the implementation of the provincial natural disaster management plan; review, report and supervise the implementation of the annual and 05-year plans.
Section 2. DISTRICT-LEVEL NATURAL DISASTER MANAGEMENT PLANS
Article 11. Contents of a district-level natural disaster management plan
1. Legal bases for formulating a plan: Law on Natural Disaster Management; Law on Amendments to the Law on Natural Disaster Management and the Law on Dikes; Law on Irrigation; legal documents elaborating laws and relevant documents.
2. Purposes and requirements: conformity with the provincial natural disaster management plan; policies of the district-level People's Council; actual situation and resources of the district.
3. Natural, demographic and socio-economic, including:
a) Natural characteristics: geographical location; topographical and geological characteristics; meteorological, hydrographic and oceanographic characteristics.
b) Demographic, socio-economic and infrastructural characteristics prescribed in Article 12 hereof.
4. Natural disasters occurring in the district:
a) Common types of natural disasters: producing statistics on and assessing intensity, frequency and time of the natural disasters;
b) Impact radius, affected fields, areas at high risk of natural disaster effects;
c) Statistics on damage caused by natural disasters in the district;
d) Assessing the natural disaster management at district level as prescribed in Article 13 hereof.
5. Natural disaster management contents and measures prescribed in Article 14 hereof.
6. Preparing materials, vehicles, equipment and necessities for natural disaster management according to the district’s approved annual natural disaster response plan, including quantity; agencies and units assigned to make preparation; location of storage in readiness in the event of a natural disaster.
7. Integrating natural disaster management contents into socio - economic development planning and plans under the guidance of the Ministry of Planning and Investment.
8. Proposed resources and schedule for implementation prescribed in Article 15 hereof.
9. Responsibility for organizing implementation prescribed in Article 16 hereof.
Article 12. District-level demographic, socio - economic and infrastructural characteristics
1. Demographic and socio - economic characteristics:
a) Demographic characteristics including total population, population density and distribution, especially vulnerable subjects, ethnic minorities, percentage of poor households, near-poor households, number of households in areas at high risk of natural disaster effects requiring relocation; residential housing characteristics (permanent, semi-permanent, less-permanent, simple-permanent) and distribution by commune-level administrative units; level of culture, education and health, ethnicity and customs;
b) Socio - economic characteristics including main economic sectors affected by natural disasters (agriculture, forestry, fishery, industry, commerce, tourism and services), local socio - economic development orientations.
2. Infrastructural characteristics:
Generally producing statistics on and assessing main infrastructure within the scope of management, including: traffic and irrigation systems; power network, communications, radio and television systems; water drainage system, drinking water supply system, environmental remediation system; systems of schools, hospitals, health centers and other infrastructure.
Article 13. Assessment of natural disaster management at district level
1. Natural disaster management and search and rescue command systems, including establishing and consolidating the district-level Command Center for Natural Disaster Management; formulating natural disaster response plans and instructional documents.
2. Forces, vehicles, materials, equipment and necessities serving natural disaster management: quantity; agencies and units deploying and storing; location of storage; quality and useful life thereof.
3. Natural disaster management information and communication
Assess the status of local shared and separate information, communication and disaster warning systems; methods of natural disaster management information dissemination and communication.
4. The community’s capacity and awareness of natural disaster management
Conduct general assessment of awareness and skills of the people and community, and training in natural disaster management in the district.
5. Status of works serving natural disaster management in the district: produce statistics on and assess the capacity and level of resistance of these works.
6. Financial resources for natural disaster management in the district, direct or indirect investment (through the integration contents), including budget for recurrent expenditure, budget for development investment expenditure, state budget reserves, financial reserve fund, ODA funding, financial assistance from foreign organizations, disaster management fund and other legal sources.
Article 14. Natural disaster management contents and measures
1. Natural disaster management contents and measures must be suitable for each type of natural disaster and levels of risks of common natural disasters in the district and focus on vulnerable subjects, including building works serving natural disaster management in the district as assigned; organizing dissemination of information and communication to raise community awareness of natural disaster management; organizing determination of dangerous areas hit by various types of natural disasters in the district; formulating plans to respond to levels of risks of common natural disasters in the district; formulating an annual plan to keep watch for natural disaster management; formulating plans to organize natural disaster management skills training and drills.
2. Basic measures for district-level natural disaster management mentioned in the Appendix IV enclosed herewith.
Article 15. Proposed demands for resources and annual and 05-year schedules for implementation of the natural disaster management plan
1. List of works serving natural disaster management as assigned to annual and 05-year plans: name of project, location, expected total investment capital, expected time of implementation and provision of annual capital.
2. Demands for human and financial resources for every year and every 05 years for performance of tasks: training in raising community awareness of natural disaster management; reviewing and determining dangerous areas hit by various types of natural disasters in the district; formulating plans to respond to levels of risks of common natural disasters in the district; funding for procurement of specialized equipment serving command over natural disaster management.
Article 16. Responsibilities for organizing implementation of the natural disaster management plan
Determine contents of specific tasks and delegate responsibilities to organizations and individuals for implementing, inspecting and supervising the implementation of the district-level natural disaster management plan.
1. Organize performance of specific tasks and schedule therefor specified in the natural disaster management plan; resources for performance thereof.
2. Formulate an annual implementation plan to fulfill the objectives of the 05 year plan; review, assess and adjust the annual and 05-year natural disaster management plans.
3. Implement, supervise and assess the implementation of the district-level natural disaster management plan; review, report and supervise the implementation of the annual and 05-year plans.
Section 3. COMMUNE-LEVEL NATURAL DISASTER MANAGEMENT PLANS
Article 17. Contents of a commune-level natural disaster management plan
1. Legal bases for formulating a plan: Law on Natural Disaster Management; Law on Amendments to the Law on Natural Disaster Management and the Law on Dikes; Law on Irrigation; district-level natural disaster management plan; legal documents elaborating laws and relevant documents.
2. Purposes and requirements: conformity with the district-level natural disaster management plan; policies of the commune-level People's Council; actual situation and resources of the commune.
3. Natural, demographic and socio-economic, including:
a) Natural characteristics: geographical location; topographical and geological characteristics; meteorological, hydrographic and oceanographic characteristics;
b) Demographic, socio-economic and infrastructural characteristics under management prescribed in Article 18 hereof.
4. Assessing the natural disaster management at commune level as prescribed in Article 19 hereof.
5. Natural disaster management contents and measures prescribed in Article 20 hereof.
6. Preparing materials, vehicles, equipment and necessities for natural disaster management according to the commune’s approved annual natural disaster response plan, including quantity of materials and equipment; agencies and units assigned to make preparation; location of storage and contracted unit in readiness in the event of a natural disaster.
7. Proposed demands for resources and annual and 05-year schedules for implementation of the natural disaster management plan: Rely on the approved natural disaster management scheme and plan, natural disaster developments and materials and resources distributed to the commune in order to determine the demand for assistance and annual schedule for implementing the plan.
8. Responsibility for organizing implementation prescribed in Article 21 hereof.
Article 18. Commune-level demographic, socio - economic and infrastructural characteristics
1. Demographic and socio - economic characteristics:
a) Demographic characteristics including total population, population density and distribution, vulnerable subjects, ethnic minorities, percentage of poor households, near-poor households, number of households in areas at high risk of natural disaster effects requiring relocation; residential housing characteristics (permanent, semi-permanent, less-permanent, simple-permanent); level of culture, education and health; ethnicity and customs;
b) Socio – economic characteristics including main economic sectors affected by natural disasters (agriculture, forestry, fishery, industry, commerce, tourism and services), local socio - economic development orientations.
2. Infrastructural characteristics: producing statistics on and assessing main infrastructure within the scope of management, including: traffic and irrigation systems; power network, communications, radio and television systems; water drainage system, drinking water supply system, environmental remediation system; systems of schools and health centers and other infrastructure.
Article 19. Assessment of natural disaster management at commune level
1. Natural disaster management and search and rescue command systems, including establishing and consolidating the commune-level Command Center for Natural Disaster Management; establishing and consolidating voluntary forces in charge of natural disaster management.
2. Forces, vehicles, materials, equipment and necessities serving natural disaster management: quantity; agencies and units deploying and storing; location of storage thereof.
3. Natural disaster management information and communication
Assess the status of local shared and separate information, communication and disaster warning systems; methods of natural disaster management information dissemination and communication.
4. The community’s capacity and awareness of natural disaster management
Conduct general assessment of awareness and skills of the people and community, and training in natural disaster management in the commune.
Article 20. Natural disaster management contents and measures
1. Organizing dissemination of information in order to raise community awareness of natural disaster management as follows:
Broadcast news bulletins on natural disaster management; disseminate documents to the people and community; broadcast warning bulletins and bulletins providing instructions on natural disaster management skills in areas under management.
2. Formulating plans to respond to levels of disaster risks and types of natural disasters according to local disaster developments, and human resources, materials and equipment serving natural disaster management.
3. Keeping watch and updating information on disaster developments
Keep watch for natural disaster management according to the regulations of the Ministry of Agriculture and Rural Development on hours of work and hours of rest for employees performing extraordinary jobs in the field of natural disaster management.
4. Determining dangerous areas under management according to the occurrence of natural disasters in the commune, especially historical disasters and topographical and geological characteristics of the areas under management.
5. Preparing places for evacuation: According to the local actual situation, locations of dangerous areas, number of households to be evacuated and evacuation capacity to select places, formulate a plan and make preparations for evacuation when requested.
6. Organizing natural disaster management training and drills, executing the project on raising community awareness of community-based disaster risk management, including organizing natural disaster management skills training and drills under the guidance; organizing natural disaster response training; organizing natural disaster response drills according to the approved plan; organizing training in community awareness raising and community-based disaster risk management.
Article 21. Responsibility for organizing implementation of the natural disaster management plan
The commune-level People’s Committee shall determine contents of specific tasks to implement the natural disaster management plan; organize review and adjustment of the 05-year natural disaster management plan; formulate an annual implementation plan to fulfill the objectives of the 05 year plan; delegate responsibilities to members of the commune-level Command Center for Natural Disaster Management and relevant organizations and individuals performing tasks according to the commune-level natural disaster management plan.
Chapter III
IMPLEMENTATION
Article 22. Responsibility and funding for formulating and updating local natural disaster management plans
1. Every provincial People’s Committee shall:
a) Direct the Department of Agriculture and Rural Development to preside over and cooperate with relevant Departments and units in organizing data collection and analysis, drafting and submitting to the provincial People's Committee the 05-year natural disaster management plan and annual plan for implementation thereof for approval; preside over and cooperate with relevant units in making a disaster risk map and described levels of disaster risks with respect to each specific type of disaster.
b) Direct other Departments and agencies to, within their jurisdiction, cooperate with the Department of Agriculture and Rural Development in formulating, reviewing and proposing adjustments to the local natural disaster management plan.
2. Every district-level People’s Committee shall:
a) Direct the specialized division assigned to perform state management of natural disaster management to: preside over and cooperate with relevant divisions in organizing data collection and analysis, drafting and submitting to the district-level People's Committee the 05-year natural disaster management plan and annual plan for implementation thereof for approval; preside over and cooperate with relevant divisions in formulating plans to respond to common types of natural disasters occurring in the district; supervise and inspect the formulation of the commune-level natural disaster management plan under its management; formulate an annual plan to keep watch for natural disaster management; preside over determining dangerous areas hit by various types of natural disasters in the district; cooperate with the district-level Military Command and relevant divisions in formulating plans to organize natural disaster management skills training and drills.
b) Direct relevant divisions and units concerned to, within their jurisdiction, cooperate with specialized divisions assigned to perform state management of natural disaster management in formulating, implementing and updating adjustments to the local natural disaster management plan.
3. Every commune-level People’s Committee shall:
a) Direct officials assigned to perform state management of natural disaster management to: preside over and cooperate with relevant organizations and individuals in collecting and analyzing data, drafting and submitting to the commune-level People’s Committee the 05-year natural disaster management plan and annual plan for implementation thereof for approval; cooperate finance and accounting officials in proposing demands for resources and funding for implementation of the plan.
b) Direct other officials and agencies, within their jurisdiction, cooperate in formulating, updating and adjusting the local natural disaster management plan.
4. During the formulation, updating and adjustment of local natural disaster management plans, agencies assigned to preside over implementing them may hire sufficiently competent consultants to assist in the implementation.
5. Local natural disaster management plans shall be formulated and approved every 05 years corresponding to the socio - economic development plan and updated and adjusted every year.
6. Funding for formulating and reviewing local natural disaster management plans includes state budget, provincial disaster management fund and other legal funding sources.
Article 23. Reporting of results of implementation of natural disaster management plans
1. After a natural disaster management plan is approved, a People's Committee shall notify the superior People’s Committee and Command Center for Natural Disaster Management. The provincial People’s Committee shall report the natural disaster management plan to the Ministry of Agriculture and Rural Development and Ministry of National Defense for consolidation and direction.
2. The People’s Committee shall organize implementation and report result of implementation of its annual natural disaster management plan. A report on result of implementation of the natural disaster management plan shall include:
a) Developments and effects of natural disaster occurring locally;
b) Direction and implementation of the natural disaster management plan;
c) Results and schedule for performance of specific tasks in the natural disaster management plan; list of natural disaster management tasks, programs, schemes and projects provided in the Appendix V hereof;
d) Assessment of advantages, disadvantages and causes;
dd) Propositions.
3. Data collection period and report submission deadline:
a) With respect to an annual report, the data collection period begins from December 15 before the reporting year to December 14 of the reporting year.
b) Every People's Committee of province or central-affiliated city shall submit a written report to the Ministry of Agriculture and Rural Development and National Steering Committee for Natural Disaster Management by December 25 of the reporting year;
c) The provincial People’s Committee shall, according to actual situation and requirements of the report, determine an appropriate deadline for report submission by the district- and commune-level People’s Committees.
Article 24. Transitional clause
Any local natural disaster management plan approved prior to the effective date of this Circular shall continue to be implemented according to the approved plan and annually assessed, updated and supplemented in accordance with regulations of this Circular.
Article 25. Effect

2. Difficulties that arise during the implementation of this Circular should be promptly reported to the Ministry of Agriculture and Rural Development for consideration./.
