ON ESTABLISHMENT OF VIETNAM FUND FOR VACCINATION PREVENTION OF CORONAVIRUS DISEASE 2019
THE PRIME MINISTER
Pursuant to the Law on Government Organization dated June 19, 2015 and Law on Amendments to the Law on Government Organization and Law on Local Government Organization dated November 22, 2019;
Pursuant to the Law on Prevention and Control of Infectious Diseases dated November 21, 2007;
Pursuant to Resolution No. 53/NQ-CP dated May 26, 2021 on establishment of Vietnam Fund for Vaccination Prevention of Coronavirus Disease 2019;
At the request of the Minister of Finance,

The fund shall be managed by the Ministry of Finance. English business name of the fund: Vietnam Fund for Vaccination Prevention of Coronavirus Disease 2019 (VFVC).
The Ministry of Finance shall promulgate the Regulation on organization, operation, management and use of VFVC in a transparent manner.
Article 2. Legal status of VFVC
1. VFVC is a state off-budget financial fund and operates under the Prime Minister's decisions.
2. VFVC has juridical person status and may open accounts at State Treasury and commercial banks as prescribed by law.
The functions of VFVC include management and coordination of its financial and material resources to fund and support the purchase, import, domestic research and production and use of COVID-19 vaccines.
Article 4. Organization and operating rules of VFVC
1. Officials of the Ministry of Finance shall manage VFVC on a part-time basis under the Minister of Finance’s decisions.

2. VFVC shall operate in a non-profit, transparent, economical and efficient manner and use its funds for the intended purposes and as prescribed by law.
3. Financial activities of VFVC are subject to the inspection and audit of finance authority and State Audit Office of Vietnam; VFVC is under the supervision of Vietnam Fatherland Front and the community.
4. VFVC may deposit its idle funds at commercial banks to protect and develop its funds in a safe manner.
1. Receive, manage and use voluntary contributions, sponsorships and assistance in cash and in the form of vaccines from Vietnamese and foreign organizations and individuals and other lawful funding sources to support and fund the purchase, import, domestic research and production and use of COVID-19 vaccines.
2. Cooperate with Vietnam Fatherland Front and relevant regulatory bodies and organizations in mobilizing contributions to VFVC to fund and support the purchase, import, domestic research and production and use of COVID -19 vaccines as per the law.
Article 6. Revenue sources and expenditure of VFVC
1. Revenue sources of VFVC include:
- Voluntary contributions, sponsorships and assistance in cash and in the form of vaccines and other materials from Vietnamese and foreign organizations and individuals;

2. Expenditure: VFVC shall be used to fund and support the purchase, import, domestic research and production and use of COVID-19 vaccines.
3. Power to decide expenditure:
- The Ministry of Health shall take charge and cooperate with the Ministry of Finance in consolidating and proposing the need for purchase, import, domestic research and production and use of COVID-19 vaccines to the Prime Minister, who has the power to decide use of VFVC funds for purchase, import, domestic research and production and use of COVID-19 vaccines as per the law.
- The Ministry of Finance shall pay out VFVC funds for expenditure items approved by the Prime Minister and according to proposals from the Ministry of Health.
Article 7. Requirements for reporting, accounting, settlement and financial disclosure for VFVC
1. VFVC shall meet requirements for reporting, accounting, settlement and financial disclosure according to the Law on Accounting and guidelines of the Ministry of Finance.
2. VFVC shall report on its revenues, expenditure and settlement, which will be included in socio-economic and state budget reports submitted to the Government and National Assembly; publish the amount of money received, list of contributors, expenditure items and remaining funds (if any).
Article 8. Implementation clauses
1. This Decision takes effect from the date on which it is signed.

3. Standing body of the Central Committee of Vietnam Fatherland Front shall take responsibility for mobilizing contributions to VFVC; and exercise supervision to ensure that VFVC is managed and used for the intended purposes in a transparent and efficient manner.
4. Ministers, heads of ministerial-level agencies, heads of Governmental agencies, chairpersons of People’s Committees of provinces and central-affiliated cities and relevant organizations and individuals shall implement this Decision.
