CIRCULAR

ON LIST OF TELECOMMUNICATIONS ENTERPRISES, GROUP OF TELECOMMUNICATIONS ENTERPRISES WITH DOMINANT POSITION ON MARKET FOR THE IMPORTANT TELECOMMUNICATION SERVICES

Pursuant to the Telecommunications Law of November 23, 2009;

Pursuant to the Law on Competition dated December 03, 2004;

Pursuant to the Decree No.187/2007/ND-CP of December 25, 2007 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Information and Communications;

Pursuant to the Decree No.50/2011/ND-CP of June 24, 2011 of the Government amending the Decree No.187/2007/ND-CP of December 25, 2007 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Information and Communications;

Pursuant to the Decree No.25/2011/ND-CP of April 06, 2011 of the Government detailing and guiding the implementation of a number of Articles of the Law on Telecommunications;

At the request of the Director of Department of Telecommunications,

The Minister of Information and Communications issues the Circular on List of telecommunications enterprises, group of telecommunications enterprises with dominant position on market for the important telecommunication services.

Article 1. Scope of governing

This Circular issues the List of telecommunications enterprises, group of telecommunications enterprises with dominant position on market for the important telecommunication services that the State needs to take competition management (in the Appendix attached).

Article 2. Application subjects

1. State management agencies related to the management of rates of telecommunication services.

2. Telecommunications enterprises.

Article 3. Implementation provisions

1. This Circular takes effect from January 01, 2013 and replaces the Decision No.1622/QD-BTTTT dated October 29, 2008 of the Ministry of Information and Communications on the issue of the list of services and enterprises or groups of telecommunications enterprises with dominant market share.

2. The chief of Office of the Ministry, Director of Department of Telecommunications, the heads of the agencies, units under to the Ministry, the Directors of Departments of Information and Communications of the provinces and cities directly under the Central Government, the General Directors, Directors of the telecommunications enterprises and relevant organizations and individuals shall implement this Circular.

3. In the course of implementation, if any problems arise, please report them to the Ministry of Information and Communications for consideration and settlement./.
