VỀ VIỆC ĐIỀU ƯỚC QUỐC TẾ CÓ HIỆU LỰC

Thực hiện quy định tại Khoản 3, Điều 47 của Luật Ký kết, gia nhập và thực hiện điều ước quốc tế năm 2005, Bộ Ngoại giao trân trọng thông báo:

Thỏa thuận về tạo thuận lợi cho nhân viên, phương tiện giao thông, thiết bị thi công, vật liệu xây dựng và nhiên liệu phục vụ cho việc thi công xây dựng cầu Long Bình - Chrey Thom giữa Chính phủ nước Cộng hòa xã hội chủ nghĩa Việt Nam và Chính phủ Hoàng gia Cam-pu-chia, ký tại Thành phố Hồ Chí Minh ngày 27 tháng 12 năm 2013, có hiệu lực kể từ ngày 27 tháng 12 năm 2013.

Bộ Ngoại giao trân trọng gửi bản sao Thỏa thuận theo quy định tại Điều 68 của Luật nêu trên./.

ARRANGEMENT

BETWEEN THE SOCIALIST REPUBLIC OF VIET NAM AND
THE ROYAL GOVERNMENT OF CAMBODIA ON FACILITATION OF CROSS-BORDER OF PERSONNEL, MACHINERY, VEHICLES, EQUIPMENT, MATERIAL AND FUELS SERVING FOR CONSTRUCTION OF LONG BINH - CHREY THOM BRIDGE

To implement the Credit Agreement signed between the Government of the Socialist Republic of Viet Nam and the Royal Government of Cambodia on 26 December 2013;

Desiring to facilitate the construction of Long Binh - Chrey Thom bridge connecting between An Giang province (Viet Nam) and Kandal province (Cambodia) (hereinafter referred to as "Long Binh - Chrey Thom bridge"), the Government of the Socialist Republic of Viet Nam representing by the Ministry of Transport and the Royal Government of Cambodia representing by the Ministry of Public Works and Transport (hereinafter referred to as "two Parties"),

Have agreed as follows:

ARTICLE 1

1. The construction of the Long Binh - Chrey Thom bridge shall not change water flow direction and national border.

2. Simplification procedures and facilitation measures stipulated under this Arrangement shall only be applied for personnel who are involved in the construction of Long Binh - Chrey Thom bridge (hereinafter referred to as "Personnel"), machinery, vehicles, equipment, material and fuels for the construction of Long Binh - Chrey Thom bridge.

ARTICLE 2

1. The two Parties shall establish a construction of Long Binh - Chrey Thom bridge area, including the river surface and ground excluding construction yard required for the construction (hereinafter referred to as "The project area"). The Personnel who executed duties involving in the construction of Long Binh - Chrey Thom bridge shall be move or use machinery, vehicles, equipment to carry materials and work in the project area.

2. The two Parties shall arrange necessary signs around the project area.

3. The project area is controlled and managed by respective border competent authorities.

ARTICLE 3

1. The Personnel who holds pass issued by respective competent authorities shall be crossed the border pair of Long Binh (Viet Nam) and Chrey Thom (Cambodia) shall be exempted visas to construct the Long Binh - Chrey Thom bridge.

2. The Personnel of one Party is required to comply with national laws and regulation of the other Party during the time he or she works and stays within the territory of that Party, and simultaneously work with competent authorities of each Party for management and safety process.

ARTICLE 4

1. The two Parties agreed to allow temporary import and temporary admission and exemption from any export-import taxes and levies for machinery, vehicles, equipment, materials and fuels serving for the construction of Long Binh - Chrey Thom bridge.

2. To facilitate for the monitoring and management, the two Parties shall provide lists of personnel who being granted pass, master lists of machinery, vehicles, equipment and materials used for the construction of Long Binh - Chrey Thom bridge. If one Party has a change in personnel, machinery, vehicles and equipment, it needs to be notified the other Party to cooperate in monitoring and management.

3. Machinery, vehicles and equipment which shall be used for the construction of Long Binh - Chrey Thom bridge shall bear the specific distinguishing sign. This specific distinguishing sign shall be granted by respective competent authorities and be informed each other to monitor and manage.

4. Pass shall be granted by respective competent authorities (Public security authority in Viet Nam side, the Ministry of Public Works and Transport in Cambodia side). The specific distinguishing sign for machinery, vehicles and equipment shall be granted by Customs authority for Viet Nam Side and the Ministry of Public Works and Transport in Cambodia.

5. The two Parties - in their authority, shall ensure the safety of personnel, machinery, vehicles and equipment serving for the construction of Long Binh - Chrey Thom bridge.

6. After the completion of the construction of Long Binh - Chrey Thom bridge, the project area shall be invalidated. All machinery, vehicles, equipment, remaining or unused materials and fuels of one Party shall be re-export without being used or sold in any forms in other Party.

ARTICLE 5

The two Parties agreed to establish the working group for coordination, monitoring, management and treatment of problems arose during the construction of Long Binh - Chrey Thom bridge. Within 30 days by the signing date, the two Parties shall inform each other the list of the working group.

ARTICLE 6

1. If any disputes in interpretation of any problems arose during the implementation of this Arrangement shall be solved amicably by both Parties through negotiation.

2. When necessary, the two Parties may amend this Arrangement. The amendment, supplement is made by writing.

ARTICLE 7

This Arrangement shall come into force as of the signing date and end its validity after 180 days of the Long Binh - Chrey Thom bridge in operation.
