CIRCULAR
AMENDMENTS TO A NUMBER OF ARTICLES OF CIRCULAR NO. 04/2017/TT-BXD DATED MARCH 30, 2017 OF THE MINISTER OF CONSTRUCTION ON OCCUPATIONAL SAFETY MANAGEMENT IN CONSTRUCTION WORKS
Pursuant to Law on Construction dated June 18, 2014;
Pursuant to the Law on Occupational Safety and Hygiene dated June 25, 2015;
Pursuant to Decree No.81/2017/ND-CP dated July 17, 2017 of the Government on functions, tasks, powers, and organizational structure of the Ministry of Construction;
Pursuant to Decree No. 46/2015/ND-CP dated May 12, 2015 of the Government on quality control and maintenance of construction works;
Pursuant to Decree No. 59/2015/ND-CP dated June 18, 2015 of the Government on construction project management;
Pursuant to Decree No. 44/2016/ND-CP dated May 15, 2016 of the Government on elaboration to a number of the Law on Occupational Safety and Hygiene on technical inspection regarding occupational safety, occupational safety, hygiene training and occupational environment monitor;
At the request of the Director General of the State Agency for Construction Quality Inspection,
The Minister of Construction promulgates Circular amending a number of Articles of Circular No. 04/2017/TT-BXD dated March 30, 2017 of the Minister of Construction on Occupational Safety Management in Construction Works.
Article 1. Amendments to Article 16 of Circular No. 04/2017/TT-BXD dated March 30, 2017 of the Minister of Construction on Occupational Safety Management in Construction Works as follows:
“Article 16. Management of information on technical inspection of occupational safety
1. The information of the organizations issued with the licence to conduct the technical inspection of occupational safety that is uploaded on the online software managing the technical inspection of occupational safety (hereinafter referred to as “the software”) includes: name, address, code of the organization conducting technical inspection of occupational safety; the list of provided machinery, equipment and parts according to the licence to conduct technical inspection of occupational safety; issuance date, expiration date of the licence to conduct technical inspection of occupational safety; the violations of the inspecting organizations (if any).
2. The information of the individuals issued with the inspector certificate that is uploaded on the software includes: full name; inspector code; ID/Citizen Identity Card number; the list of machinery, equipment and parts eligible for conducting technical inspection of occupational safety; issuance date, expiration date of the inspector certificate; the violations of the inspectors (if any).
3. The application of information technology in technical inspection of occupational safety shall be regulated as follows:
a) Software address: http://cucgiamdinh.gov.vn/CSDL-kiem-dinh-duoc-cong-bo.aspx
b) The specialized agencies shall have the responsibilities to develop, upload and provide updates on information of the organizations and individuals specified in Clause 1, Clause 2 of this Article for the software; instruct the organizations and individuals conducting technical inspection of occupational safety to use the software;
c) The organizations and individuals conducting technical inspection of occupational safety shall have the right to use the software specified in Point a of this Clause during their operation to manage and carry out technical inspection of occupational safety with regard to machinery, equipment and parts subject to stringent occupational safety requirements that are used in construction works.
Article 2. Entry into force
1. This Circular comes into force from September 15, 2019.
2. Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Construction for consideration and solution./.
