CIRCULAR

PROMULGATION OF NATIONAL TECHNICAL REGULATION ON SAFE WORK FOR MACHINE ROOM-LESS ELECTRIC LIFT

Pursuant to the Law on Occupational Safety and Health No. 84/2015/QH13 dated June 25, 2015;

Pursuant to the Government’s Decree No. 39/2016/ND-CP dated May 15, 2016 on elaboration of some Articles of the Law on Occupational Safety and Health;

Pursuant to the Government’s Decree No. 106/2012/ND-CP dated December 20, 2012 defining the functions, tasks, powers and organizational structure of the Ministry of Labor, War Invalids and Social Affairs;

At the request of the Director General of the Department of Work Safety;

The Minister of Labor, War Invalids and Social Affairs hereby promulgates a Circular on National technical regulation on safe work for machine room-less electric lift.

Article 1. Name and code of the Regulation

Promulgated together with this Circular is the National technical regulation on safe work for machine room-less electric lift.

Code: QCVN 26:2016/BLDTBXH.

Article 2. Implementation

1. Organizations and individuals producing, importing, supplying, using and repairing machine room-less electric lifts shall strictly comply with the regulations set out in the document promulgated together with this Circular.

2. Organizations carrying out inspection and certifying conformity of machine room-less electric lifts shall strictly comply with the regulations set out in the document promulgated together with this Circular.

3. Ministries, ministerial agencies, Governmental agencies, People’s Committees of provinces and central-affiliated cities, and organizations and individuals concerned are responsible for the implementation of this Circular.

Article 3. Effect

1. This Circular comes into force from August 01, 2017.

2. Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Labor, War Invalids and Social Affairs for consideration and resolution./.

NATIONAL TECHNICAL REGULATION ON SAFE WORK FOR MACHINE ROOM-LESS ELECTRIC LIFT

Foreword

QCVN 26:2016/BLDTBXH - National technical regulation on safe work for machine room-less electric lift is developed by the Department of Work Safety and promulgated together with the Circular No. 48/2016/TT-BLDTBXH dated December 28, 2016 by the Ministry of Labor, War Invalids and Social Affairs after obtaining appraisal opinions of the Ministry of Science and Technology.

 

PROMULGATION OF NATIONAL TECHNICAL REGULATION ON SAFE WORK FOR MACHINE ROOM-LESS ELECTRIC LIFT

1. General

1.1. Scope

This Regulation applies to permanently installed machine room-less electric lifts (hereinafter referred to as “lifts”) used for the transportation of persons or persons and goods, serving defined landing levels and moving between guide rails inclined not more than 15° to the vertical.

Lifts operated under strict safety regulations, moving special objects (such as chemicals, explosive materials, etc.) and used in the unconventional environment, when being installed and used, must conform to both regulations enshrined in this document and other regulations imposed by authorities vested with occupational safety authority or those vested with fire fighting and prevention authority.

1.2. Regulated entities

This document applies to:

1.2.1. Organizations and individuals producing, importing, supplying, using and repairing lifts.

1.2.2. Regulatory bodies and relevant organizations and individuals.

1.3. Definitions

Machine room-less electric lift means an electric lift with a drive motor, mechanisms and other components placed in the well.

In addition, for the purposes of this document, the terms and definitions in the National Standard TCVN 6395:2008 Electronic lifts – Specification and installation requirements apply.

2. Technical regulations

2.1. Comply with the technical regulations set out in TCVN 6395:2008, except for the regulations in 5, 10.8 and 11.8.1.4.1.

2.2. Regulations on positions of lift machines and pulleys

2.2.1. A lift machine shall be installed so as to facilitate inspection, testing, maintenance and repair.

2.2.2. The machine and pulley rooms shall not be used for purposes other than lifts. They shall not contain ducts, cables or devices other than for the lift.

2.2.3. The temperature in the location where the machine and electrical equipment are installed is assumed to be maintained between + 5 °C and + 40 °C.

2.2.4. At the top of the well, there must be hooks with a solid structure for use on lifting appliances so as to serve disassembly of the machine and equipment of the lift.

2.2.5. Parts supporting the machine and working area inside the well shall withstand the loads and forces imposed on them.

2.3. Regulations on overspeed governors

The overspeed governor shall be installed in a position convenient for the operator.

2.4. Regulations on suspensions and ropes

2.4.1. Regarding steel wire ropes with a diameter of at least 8mm, the regulations mentioned in 7.9.1 of TCVN 6395:2008 must be complied with.

2.4.2. Other types of ropes must comply with the regulations mentioned in 7.9.1.1 and 7.9.1.3 of TCVN 6395:2008. In addition, the lift manufacture shall prove the durability of ropes and take legal responsibility for ensuring safety during the operation, inspection, maintenance, and handling of incidents in the lift using such ropes; shall specify instructions on deadline for rope replacement and signs showing that ropes that are no longer safe in the manual for installation, operation, inspection, maintenance, and incident handling.

2.4.3. The rope used must have certificates of origin and be certified conformable with safety requirements by certification bodies.

2.5. Regulations on diameter of pulleys and securing of ends of ropes

2.5.1. Regarding steel wire ropes with a diameter of at least 8mm, the regulations mentioned in 7.9.2 of TCVN 6395:2008 must be complied with.

2.5.2. Regarding other types of ropes, the lift manufacture shall lay down specifications regarding safety factors and lifetime of the ropes, requirements concerning types of pulleys, regulations on securing of the ends of the ropes for safety assurance and suitability for the ropes used, and take legal responsibility for ensuring safety during the operation, inspection, maintenance, and handling of incidents in the lift using such ropes.

2.6. Regulations on rescue operation

The lift should have both mechanical and electrical rescue systems to permit easy operations during the rescue in the event of an incident:

2.6.1. Mechanical rescue

2.6.1.1. Mechanical means shall be provided to the lift (acting bars, towbars, hooks, etc.) to move the car to the nearest landing floor.

2.6.1.2. In case of failure to gain access to the machine when carrying out mechanical rescue, a mechanism for opening the machine's brake shall be located outside the well in a position convenient for the rescue operator.

2.6.1.3. At the brake opening position, measures should be in place to permit easy recognition of the car position (marking the rope or observing the display system of the lift controller, etc.).

2.6.1.4. A mechanism for releasing the overspeed governor shall be located outside the well in a position convenient for the rescue operator.

2.6.2. Electrical rescue

Electrical means shall be provide to the lift and satisfy the following requirements:

2.6.2.1. It is required to permit the control of movement of the car from the control cabinet (the control cabinet shall be located outside the well in a position convenient for the rescue operator) by pressing the button continuously. The direction of movements shall be clearly indicated.

2.6.2.2. If the control cabinet located inside the well but is inaccessible, control equipment must be provided at such location.

2.6.3. Regulations on lift maintenance

Every lift manufacturer must establish an appropriate maintenance procedure so as to ensure safety of persons during the maintenance.

2.6.4. Rescue procedure

Every lift manufacturer must establish an appropriate rescue procedure in the event of incident.

3. Management regulations

3.1. A technical dossier of the lift consists of:

3.1.1. A catalogue, which shall contain:

- Name and address of the manufacturer, product type and code, manufacturing year, number of floors served and permissible load (number of persons);

- Main specifications of the lifting system, e.g. controlling and safety equipment, machine, safety factors and lifetime of ropes and overload protection system.

3.1.2. Copy of the certificate of sample testing of safety components.

3.1.3. Copy of certificates of other important components (ropes, chains, explosion-proof equipment, glass, etc.).

3.1.4. Operating principle diagram.

3.1.5. Layout of installation of component sets, rope and counterweight installation diagram.

3.1.6. Plan for perspective view of the lift that shows its sizes, main specifications and car dimensions.

3.1.7. Instructions for installation, operation and procedures for maintenance and emergency response.

3.1.8. Quality and manufacturing origin certificates of all of the components integral to the lift. The lift control panel in the car of a finished lift product must specify lift codes and permissible load (number of passengers).

3.2. Safety requirements applicable to domestically manufactured lifts

Every lift manufacturer shall satisfy the following quality management requirements:

3.2.1. The technical dossier specified in 3.1 of this document must be sufficiently available.

3.2.2. Domestically manufactured lifts must have their conformity certified as specified in 4.1.1 of this document.

3.2.3. Conformity of lifts must be declared as prescribed.

3.2.4. Conformity mark must be attached before putting a lift into use.

3.3. Safety requirements applicable to imported lifts

3.3.1. The technical dossier specified in 3.1 of this document must be sufficiently available.

3.3.2. When imported, lifts must have their conformity certified as specified in 4.1.2 of this document.

3.3.3. If imported lifts are not subject to any quality inspection upon import under bilateral or multilateral agreements between competent authorities of the Socialist Republic of Vietnam and exporting states, they will be exempted from import inspection.

3.4. Safety requirements applicable to lifts sold on the market

For lifts sold on the market, distributors and retailers thereof shall satisfy the following requirements:

3.4.1. The lifts have had their conformity certified and must bear the conformity mark.

3.4.2. Respective technical regulations shall be complied with during the storage and supply of lifts and manufacturer's instructions shall be followed.

3.4.3. Quality control measures shall be adopted to maintain quality of the lifts they sell.

3.5. Requirements applicable to lifts meeting installation requirements

3.5.1. Installation of lifts will be allowed only if the following requirements are met:

3.5.1.1. Have all required technical dossier referred to in 3.1 of this document.

3.5.1.2. Be accredited by certification of conformity and declaration of conformity in accordance with regulations. Imported lifts must be accredited by import customs clearance documents in accordance with regulations.

3.5.2. Requirements to be satisfied by lift installation, calibration, maintenance and repair service providers

3.5.2.1. Lift installation, calibration, maintenance and repair service providers must meet all of the following requirements:

3.5.2.1.1. They must have legal status and have their business registration in this sector granted by competent authorities in accordance with regulations of law.

3.5.2.1.2. Persons directly installing, calibrating, maintaining and repairing must be trained in accordance with regulations of the Law on Vocational Education; trained in occupational safety and health in accordance with regulations of the Law on Occupational Safety and health and its guiding documents.

3.5.2.1.3. There must be adequate equipment for installing, calibrating and repairing lifts.

3.5.2.1.4. Comply with requests and instructions of the manufacturer and regulations laid down in this document.

3.5.2.1.5. Installation service providers must apply safety measures to installation, comply with relevant national technical regulations on occupational safety and manufacturer's installation instructions.

3.5.3. Post-installation commissioning requirements

3.5.3.1. Installation service providers must take steps in making necessary arrangements for post-installation commissioning activities, including:

3.5.3.1.1. Prepare lift commissioning documents.

3.5.3.1.2. Make necessary preparations for operation of lifts.

3.5.3.1.3. Liaise with the order placement entity to make arrangement for load testing and make necessary preparations for commissioning activities.

3.5.3.2. Post-installation commissioning activity is to serve the following purposes:

Assess consistency of lift specifications and sizes with data or figures included in technical dossier as well as assess safety levels of lifts after being installed.

3.5.3.3. Technical specifications to be tested include:

3.5.3.3.1. Permissible rated load.

3.5.3.3.2. Operating speed and installation dimensions.

3.5.3.3.3. Floor landing accuracy.

3.5.3.3.4. Stability of safety, control and rescue systems.

3.5.3.4. After lifts are installed completely, installation service providers must make acceptance testing records. An acceptance testing record must clearly represent actual inspection and measurement activities and assessment of inspection and measurement results according to the technical regulations enshrined in this document. If the manufacturer’s design standards prescribe results which are greater than these ones, these standards shall be applied.

3.6. Management and safe use of lifts

3.6.1. Persons in charge of engineering and operational management of lifts must be trained in basic skills necessary for them to perform their assigned tasks, in occupational safety and health in accordance with the Law on Occupational Safety and Health and its guiding documents, including training in rescue operation in the event of lift incidents.

3.6.2. Only lifts meeting technical standards and operating within the validity period of the technical safety inspection stamp. During operation of lifts, if lifts are found unsafe, the unit using the lifts may request that an inspection be carried out ahead of schedule.

3.6.3. Only authorized persons (directly carrying out inspections, maintenance, repair and rescue) are permitted to access the drive system.

3.6.4. Logbooks for calibration, maintenance and repair must be prepared for each lift.

3.6.5. During their operation, lifts must be maintained at least every 03 months. During maintenance intervals, the unit using lifts must conduct checks to promptly detect, prevent and handle hazards that may occur during operation of the lifts.

3.6.6. Before being put into use, lifts must have clear origins and all required dossier specified in 3.1 of this document.

4. Certification of conformity and technical safety inspection of lifts

4.1. Certification of conformity of lifts

4.1.1. Certification of conformity of domestically manufactured lifts:

4.1.1.1. In the case of mass production, the certification of conformity shall be carried out using method 5: Testing a representative sample and assessing the manufacturing process; carrying out supervision by testing samples collected from the place of manufacturing or on the market in association with assessment of the manufacturing process (specified in the Appendix II of the Circular No. 28/2012/TT-BKHCN dated December 12, 2012 of the Minister of Science and Technology).

4.1.1.2. In the case of job production, the certification of conformity shall be carried out using method 8: Testing or inspecting the entire product (specified in the Appendix II of the Circular No. 28/2012/TT-BKHCN dated December 12, 2012 of the Minister of Science and Technology).

4.1.2. Certification of conformity of imported lifts:

4.1.1.2. In the case of the lifts imported in bulk, the certification of conformity shall be carried out using method 7: Testing or inspecting shipments (specified in the Appendix II of the Circular No. 28/2012/TT-BKHCN dated December 12, 2012 of the Minister of Science and Technology)

4.1.1.2. In the case of lifts imported in separate items, the certification of conformity shall be carried out using method 8: Testing or inspecting the entire product (specified in the Appendix II of the Circular No. 28/2012/TT-BKHCN dated December 12, 2012 of the Minister of Science and Technology).

4.1.3. The certification of conformity must be carried out by certification bodies designated by the Ministry of Labor, War Invalids and Social Affairs.

4.2. Technical safety inspection of lifts

4.2.1. Every lift shall undergo an initial inspection and periodic inspections during its operation or irregular inspections during in accordance with the inspection procedure issued by the Ministry of Labor, Invalids and Social Affairs and shall bear an inspection stamp as prescribed.

Technical safety inspection of lifts must be carried out by a technical occupational safety inspection body issued with the certificate for eligibility for provision of inspection services by the Ministry of Labor, War Invalids and Social Affairs.

4.2.2. Frequency of periodic inspections of lifts:

4.2.2.1. At least every 03 years for each periodic inspection of the lifts working under normal operating conditions.

4.2.2.2. At least every 02 years for each periodic inspection of the lifts that have been used for more than 10 years or work under corrosive conditions and at a high rate of work.

4.2.2.3. The inspection duration may be shortened if the manufacturer or user so requests.

4.2.2.4. Every technical occupational safety inspection may shorten the inspection duration but is required to specify the reasons therefor in the lift safety inspection record.

5. Inspection and handling of violations

5.1. The State’s labor inspectorate and occupational safety and health inspectorate are responsible for inspecting and handling violations against regulations laid down in this document.

5.2. Inspection of quality of lifts which are manufactured, imported, supplied and used must be subject to the Law on Quality of Products and Goods and this document.

6. Responsibilities of organizations and individuals

6.1. Organizations and individuals involved in manufacturing, import, supply and use of lifts shall comply with the regulations set out in this document.

6.2. This Regulation shall serve as the basis for inspection carried out by lift quality inspection authorities as well as the basis for certification of conformity granted by conformity-assessing organizations./.

7. Implementation

7.1. The Department of Work Safety affiliated to the Ministry of Labor, War Invalids and Social Affairs shall inspect and provide guidelines for the implementation of this Regulation.

7.2. Local labor authorities shall inspect and provide guidelines for the implementation of the regulations set out in this Regulation.

7.3. Difficulties that arise during the implementation of this document should be promptly reported to the Ministry of Labor, War Invalids and Social Affairs for consideration and resolution./.
