CIRCULAR

PROMULGATING NATIONAL TECHNICAL REGULATION ON LABOR SAFETY FOR HAND-HELD MOTOR-OPERATED ELECTRIC TOOLS

Pursuant to the governmental Decree No. 186/2007/ND-CP dated December 25, 2007 stipulating functions, duties, authorities and organizational structure of the Ministry of Labor, Invalids and Social Affairs;

Pursuant to the Government's Decree No. 127/2007/ND-CP dated August 01, 2007 detailing the implementation of a number of articles of the Law on Technical regulations and standards;

Pursuant to the Government's Decree No. 132/2008/ND-CP dated December 31, 2008, detailing the implementation of a number of articles of the Law on Product and goods quality;

Upon receipt of valuation opinions from the Ministry of Science and Technology in the Official Dispatch No. 2162/BKHCN-TDC dated August 01, 2012, the Minister of Labor, Invalids and Social Affairs promulgates National technical regulation on labor safety for hand-held motor-operated electric tools,

Article 1.Promulgate this Circular enclosed with the National technical regulation on labor safety for hand-held motor-operated electric tools (hereinafter referred to as the National technical regulation).

Code: QCVN 09: 2012/BLDTBXH

Article 2.The National technical regulation shall take effects after six months since the effective date of this Circular.

Article 3.The Ministries, ministerial-level agencies, Governmental agencies, People’s Committee of central-affiliated cities and provinces, relevant organizations and individuals shall be responsible for executing this Circular./.

THE NATIONAL TECHNICAL REGULATION

ON LABOR SAFETY FOR HAND-HELD MOTOR-OPERATED ELECTRIC TOOLS

Foreword

QCVN 09: 2012/BLDTBXH- The National technical regulation is compiled and submitted for approval by the Department of Labor Safety and promulgated by the Ministry of Labor, Invalids and Social Affairs according to the Circular No. 34/2012/TT-BLDTBXH dated December 24, 2012 after receiving valuation opinions from the Ministry of Science and Technology.

 

THE NATIONAL TECHNICAL REGULATION  

ON LABOR SAFETY FOR HAND-HELD MOTOR-OPERATED ELECTRIC TOOLS

1. General provisions

1.1. Governing scope

The National technical regulation applies to hand-held motor-operated, or magnetically driven electric tools with rated voltage being not more than 250 V for a single-phase a.c or d.c tools and 440 V for three-phase a.c tools (hereinafter referred to as hand-held electric tools).

Hand-held electric tools which can be mounted on a support for use as fixed tools without any alteration of the tool itself are within the scope of this regulation.

This regulation does not apply to:

- Hand-held electric tools intended to be used in the presence of explosive atmosphere (dust, vapor or gas);

- Hand-held electric tools used for preparing and processing food;

- Hand-held electric tools for medical purposes;

- Heating tools that are mentioned in TCVN 5699-2-45 (IEC 60335-2-45).

For hand-held electric tools intended to be used in transport vehicles, besides the provisions set out in this regulation, requirements of labor safety laid down by competent agencies may be necessary.

1.2. Regulated entities

This regulation applies to:

1.2.1. Manufacturers, importers, sellers and users of hand-held electric tools (hereinafter referred to as manufacturers, importers, sellers and users).

1.2.2. Regulatory agencies and relevant organizations, individuals.

1.3. Interpretation of terms

In this regulation, terms and definitions of Vietnam’s Standards (TCVN 7996-1:2009 (IEC 60745-1:2006: Hand-held motor-operated electric tools – Safety – General requirements) and the set of TCVN 7996-2 (IEC 60745-2) shall be used.

2. Technical regulations

2.1. Hand-held electric tools as defined above must meet the requirements of technical safety set out in TCVN 7996-1: 2009 (IEC 60745-1: 2006).

2.2. For particular hand-held electric tools, besides general requirements of technical safety, other particular technical requirements set out in the set of TCVN 7996, Part 2 (IEC 60745-2) may be necessary.

2.3. In case all the aforesaid TCVNs are modified or supplemented, the latest regulation shall be applied.

3. Regulations on labor safety management during manufacture, import, sale and use of hand-held electric tools.

3.1 Regulation on safety for hand-held electric tools in manufacture and import before being launched into the market.

Manufacturers and importers of hand-held electric tools must meet quality management requirements as follows:

3.1.1. Apply the quality control system to ensure that quality of the product manufactured or imported by themselves conform to the applicable standards.

3.1.2. Declaration of applicable standards:

Manufacturers and importers must declare basic specifications, warnings and number of applicable standards on the product, or:

- On product packages;

- On product labels;

- On materials attached to the product.

3.2 Regulation on safety for hand-held electric tools to be sold in the market

3.2.1. Comply with respective technical standards during the sale of the product in the market;

3.2.2. Apply their own quality control measures during the sale of the product in the market;

3.3 Regulation on safety for hand-held electric tools in use.

3.3.1 Storage and transport

3.3.1.1. Ensure satisfaction of storage requirements stated in the documentation of the hand-held electric tool.

3.3.1.2. Ensure availability of supports for placing hand-held electric tools in the store. Do not pile up hand-held electric tools when they are not yet packaged.

3.3.1.3. To transport hand-held electric tools, protective measures should be taken to prevent any damage caused.

3.3.2. Prepare hand–held electric tools before working

3.3.2.1. When handing a hand-held electric tool to a user, both user and giver must:

- Check compactness and firmness of joints of hand-held electric tools.

- Have a look at the outside of components of the hand-held electric tool (power cable, cable sheath, plugs, insulation, handles, cover of carbon brush...)

- Check if a circuit breaker works.

- Test non-loading operation.

- For grade I hand-held electric tools, check protective wiring circuit.

3.3.2.2 Do not deliver or put into use any hand-held electric tool found even minor damage, failing to meet safety standards or any hand-held electric tool with regular inspection time limit being expired.

3.3.3 Regulation on safety for the operation of hand-held electric tools.

3.3.3.1. Only those who are trained in electricity safety and operation of hand-held electric tools and granted safety card are allowed to use such tools.

3.3.3.2 Only hand-held electric tools that meet the provisions set out in this regulation are put into use.

3.3.3.3. Each hand-held electric tool must have its own logbook. Any person who is in charge of storing and repairing hand-held electric tools must take notes of the results of regular inspection, maintenance and repair.

3.3.3.4. Keep working place tidy and well-lit while operating hand-held electric tools.

3.3.3.5. Do not operate hand-held electric tools in explosive atmosphere (liquid, dust, vapor, gas or any substance most likely to cause damage to electrical insulation of the tools).

Do not operate any hand-held electric tool without built-in spray and water proof features in the presence of water drops and mist.

3.3.3.6. Do not let children and off-duty persons come closer to hand-held electric tools while in operation.

3.3.4 Regulation on electrical safety

3.3.4.1. Plugs must fit into sockets. Do not alter plugs in any way. Do not use multi-function plug of any kind for earthing hand-held electric tools.

3.3.4.2. When operating grade II hand-held electric tools, additional personal protective kit (insulated gloves, boots and mats...) should be used.

3.3.4.2. Do not let yourself come into contact with earthing surfaces.

3.3.4.3 Do not use wrong power cables. Do not use power cables to carry, drag or unplug hand-held electric tools. Keep power cable away from heat source, oil, sharp iron edges or motor driven machines.

3.3.4.4. When operating hand-held electric tools outdoors, suitable power cable should be used.

3.3.4.5. In case use of hand-held electric tools in wet area is a must, a residual-current device (RCD) should be used to protect the power supply.

3.3.4.6. Attention must be paid to the protection of electrical cable against damage caused to insulation, against stain of oil or contact with hot objects.

3.3.4.7. Tasks of connecting electrical equipment such as transformers, frequency inverters...with the grid must be done by professional staff.

3.3.4.8. Testing hand-held electric tools and attached spare parts (transformers, frequency inverters, circuit breakers, power cable...) must be conducted at least every six months. Regular testing includes:

- Examine the outside of hand-held electric tools.

- Measure insulation resistance by means of an insulation resistance meter (not lower than 2MΩ).

- Examine protective circuit.

3.3.5 Regulation on safety for mechanical hazards

3.3.5.1 Do not abuse stimulants while operating hand-held electric tools.

3.3.5.2. Use suitable personal protective kit such as masks, anti-slip shoes, hard caps, earplugs, and glasses while operating hand-held electric tools.

3.3.5.3. Do not start a hand-held electric tool while in the state of distraction and ensure that position of cutting is set in place before being connected to the power supply.

3.3.5.4. Ensure all repair tools are taken out of the hand-held electric tool before it into operation.

3.3.5.5. Do not operate a hand-held electric tool in a reaching-out position, keep your body in balance wherever you operate the hand-held electric tool. 3.3.5.6. If a hand-held electric tool has a hook-up to a dust collector or similar mechanism, ensure that it is properly connected and operated.

3.3.5.7. For any hand-held electric tool weighing more than 10 kilograms, some supports and hangers should be installed to ease the operation.

3.3.5.8. Do not force operation of a hand-held electric tool beyond its function.

3.3.5.9. Do not use a hand-held electric tool when the off-and-on switch does not work.

3.3.5.10. Disconnect power supply before making adjustments or replacement of worn parts, pausing some time or putting away hand-held electric tools.

3.3.5.11. Store a hand-held electric tool in a place out of reach of children and do not let those who are not trained in such tool operate it.

3.3.5.12. Use of hand-held electric tools, accessories and other details should conform to their functions and the manufacturer’s instructions including working conditions and tasks to be performed.

3.3.5.13. When using a hand-held electric tool, pay attention to the requirements stated in the instruction manual, protect it from collision, overload of work or impact of dust, fats and oils, water drops, rainwater or other liquids.

3.3.6. Repair and maintenance

3.3.6.1. Users of hand-held electric tools must carry out regular examination, maintenance and enumerate what has been done by a hand-held electric tool. If a hand-held electric tool is damaged, it should be fixed before use and be cleaned after use. After a hand-held electric tool is repaired, it must be tested under TCVN 7996, Part 2 (EIC 60745-2)

3.3.6.2. Maintenance of hand-held electric tools must be performed by qualified experts and only similar spare-parts are used for replacement.

4. Investigation, inspection and handling of violations

4.1. Investigation and handling of violations of this Regulation shall be done by State Labor Inspectorate.

4.1. Quality inspection of manufacture, import, circulation and use of hand-held motor-operated electric tools shall be done under the Law on Product quality and this Regulation.

5. Responsibilities of organizations, individuals

5.1. Organizations, individuals as manufacturers, importers, exporters, sellers and users of hand-held electric tools shall be responsible for complying with the provisions set out in this Regulation.

5.2. This Regulation shall serve as the basis for the related quality inspection agency to perform quality inspection of hand–held electric tools and for conformity-assessing organizations to issue certificate of standard conformity on hand-held electric tools according to technical requirements set out in Section 2 of this Regulation.

Certification of technical –regulation conformity shall be done according to Method 7 if hand-held electric tools are mass-produced or imported in large quantity, or according to Method 8 if they are manufactured or imported a lower volumes (Methods 7, 8 are set out in Points g and h, Clause 1, Article 5 of the Minister of Science and Technology’s Decision No. 24/2007/QD-BKHCN dated September 28, 2007).

6. Implementation

6.1 The Department of Labor Safety, the Ministry of Labor, War Invalids and Social Affairs shall be responsible for instructing and inspecting the implementation of this Regulation.

6.2 State administration agencies for labor at local level shall be responsible for instructing and inspecting the implementation of this Regulation.

6.3. Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Labor, Invalids and Social Affairs for consideration and handling./.
