CIRCULAR

PROMULGATING NATIONAL TECHNICAL REGULATION ON WOOD ADHESIVES

Pursuant to the Law on promulgation of legislative documents dated June 22, 2015;

Pursuant to the Law on technical regulations and standards dated June 29, 2006;

Pursuant to the Law on quality of goods and products dated November 21, 2007;

Pursuant to the Government's Decree No. 127/2007/ND-CP dated August 01, 2007 providing guidelines for implementation of the Law on technical regulations and standards;

Pursuant to the Government’s Decree No. 132/2008/ND-CP dated December 31, 2008 providing guidelines for implementation of the Law on quality of goods and products;

Pursuant to the Government’s Decree No.15/2017/ND-CP dated February 17, 2017 defining functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;

At the request of the Director of the Department of Science Technology and Environment and the Director of Agro Processing and Market Development Authority;

The Minister of Agriculture and Rural Development promulgates National technical regulation on wood adhesives,

Article 1. The National technical regulation on wood adhesives – Sign: QCVN 03-01:2018/BNNPTNT is promulgated together with this Circular.

Article 2. This Circular comes into force from July 01, 2019.

Article 3. Chief of the Ministry Office, Director of Department of Science Technology and Environment, Director of Agro Processing and Market Development Authority, heads of Ministry-affiliated relevant units, Directors of Provincial Departments of Agriculture and Rural Development, and relevant organizations and individuals are responsible for the implementation of this Circular.

Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Agriculture and Rural Development for consideration./.

NATIONAL TECHNICAL REGULATION ON WOOD ADHESIVES

PART 1: GENERAL PROVISIONS

1.1. Scope

This Regulation defines quality requirements for products and goods of wood adhesives which are manufactured domestically, imported and sold in Vietnam market.

This Regulation does not govern products and goods of wood adhesives imported as test samples, product samples, exhibition goods, temporary imports for re-export and goods in transit.

1.2. Regulated entities

1.2.1 Organizations and individuals that manufacture, import, distribute, sell, store or use products and goods of wood adhesives.

1.2.2 Relevant regulatory authorities that conduct state management of quality of goods and products.

1.2.3 Organizations that are designated to assess the conformity of wood adhesives with relevant regulations.

1.3. Definitions

For the purposes of this Regulation, the terms below are construed as follows:

1.3.1

Lot

A collection of one type of products or goods of wood adhesives which have similar specifications and produced at once through one technology line.

1.3.2

Consignment

A collection of one type of products or goods of wood adhesives, in a definite quantity, which have similar label contents, are produced or imported by one entity at the same location and are distributed and sold in the market.

1.3.3

Typical sample

The sample representing a specific type of products or goods of wood adhesives which have similar design and are manufactured under similar conditions and with similar type of wood adhesives.

1.3.4

Representative sample

The sample, within the precision of the applied test methods, reflects all characteristics of the lot from which it is drawn.

1.4. Normative references

The following reference documents are necessary for the application of this document. Revisions to these standards, when adopted, shall prevail.

TCVN 2090: 2015 (ISO 15528 : 2013), Paints, varnishes and raw materials for paints and varnishes – Sampling.

TCVN 4851: 1989 (ISO 3696:1987), Water for analytical laboratory use - Specification and test method.

PART 2: TECHNICAL REQUIREMENTS

2.1 Technical indicators of wood adhesive products must be inspected and satisfy technical requirements set forth in Table 2.1

2.2 The test methods employed for inspecting technical indicators of wood adhesive products are defined in Table 2.1

NOTES: (1)- Indicators determined for solutions of wood adhesives;

- Powdered wood adhesives must be converted to solutions containing sufficient ingredients announced by the manufacturer before determining technical indicators.

- With regard to the adhesive containing multiple ingredients, all ingredients must be prepared according to the manufacturer's recommendations when determining technical indicators.

PART 3: MANAGEMENT REQUIREMENTS

3.1 Certification and declaration of conformity

3.1.1 The conformity of products and goods of wood adhesives with technical requirements specified in Table 2.1 Part 2 must be declared according to the certification of conformity by conformity assessment bodies designated or accredited by the Ministry of Agriculture and Rural Development.

3.1.2 Conformity assessment methods

3.1.2.1 Manufacturers and importers of products and goods of wood adhesives can employ the Assessment Method 5 or Assessment Method 7 according to the Circular No. 28/2012/TT-BKHCN dated December 12, 2012 of the Ministry of Science and Technology on declaration of compliance and conformity and methods for assessment of conformity with technical standards and regulations, and the Circular No. 02/2017/TT-BKHCN dated March 31, 2017 on amendments to the Circular No. 28/2012/TT-BKHCN dated December 12, 2012.

3.1.2.2 Certification of conformity through Method 5:

- It is applicable to products of a manufacturer that possesses a certificate of quality management system under ISO 9001.

- Effective duration of the certificate of conformity: 01 year for imports and 03 years for products assessed at their place of manufacturing and supervised annually by testing of samples taken from the place of manufacturing or the market.

3.1.2.3 Certification of conformity through Method 7:

- It is applicable to each lot of products/goods manufactured or imported and tested with regard to their quality through a representative sample taken from the lot.

- A certificate of conformity shall only apply to each lot of products.

3.1.3 Sampling method, specifications and amount of typical samples

3.1.3.1 Typical samples shall be taken by adopting sampling methods provided in applicable national technical standards on methods for sampling and preparation of test samples for relevant products.

3.1.3.2 Specification and amount of typical samples for each lot of products shall adhere to the tables in Part 2.

3.1.4 Procedures for certification and declaration of conformity and marking shall be governed by regulations on certification and declaration of conformity and relevant laws.

3.2 Packaging, labeling, transport and storage

3.2.1 Labels which must contain sufficient quality values must be affixed on every product packaging. Product labeling shall adhere to applicable regulations on labeling of products and goods.

3.2.2 Regulations on packaging (for products bagged, packaged or boxed), transport and storage are provided in product standards.

3.3 Supervision assessment

During the validity period of the conclusion on conformity, samples of each product declared to be conformable with relevant technical regulations shall be taken for each period of not exceeding 12 months for supervision assessment and tested with regard to every technical indicator defined in this Regulation for every 03 years.

PART 4: IMPLEMENTATION AND RESPONSIBILITY OF RELEVANT ENTITIES

4.1 Responsibility of relevant entities

4.1.1 Domestic manufacturers shall comply with regulations on certification and declaration of conformity, and labeling as prescribed in Part 2 and Part 3 of this Regulation.

4.1.2 Methods for conformity assessment shall adhere to Section 3.1 of this Regulation.

4.1.3 Organizations and individuals shall only be allowed to import, distribute or retail products of wood adhesives with certified quality, bearing conformity marking and labeled in accordance with provisions herein and relevant laws.

4.2 Implementation

4.2.1 The Ministry of Agriculture and Rural Development shall cooperate with relevant authorities to organize the implementation of this Regulation and manage conformity assessments.

4.2.2 Relevant units affiliated to the Ministry of Agriculture and Rural Development, Provincial Departments of Agriculture and Rural Development and relevant regulatory authorities shall be responsible for managing the quality of products and goods of wood adhesives produced and imported according to this Regulation and applicable laws.

4.2.3 Difficulties that arise during the implementation of this Regulation should be reported to professional regulatory authorities and the Department of Science Technology and Environment affiliated to the Ministry of Agriculture and Rural Development for consideration.

4.2.4 If any regulations referred to in this Regulation are amended, supplemented or superseded, the new ones shall apply.
