Pursuant to Law on Higher Education dated June 18, 2012; Law on amendments to Law on Higher Education dated November 19, 2018;
Pursuant to the Law on Science and Technology dated June 18, 2013;
Pursuant to Decree No. 99/2019/ND-CP dated December 30, 2019 of the Government on elaborating to Law on amendments to Law on Higher Education;
Pursuant to Decree No. 08/2014/ND-CP dated January 27, 2014 of the Government elaborating to Law on Science and Technology;
Pursuant to Decree 69/2017/ND-CP dated May 25, 2017 of the Government on functions, tasks, powers and organizational structure of the Ministry of Education and Training;

Article 1. Scope and regulated entities
1. This Circular prescribes management and organization of scientific research activities of students; responsibilities and powers of relevant organizations and individuals in scientific research activities of students in higher education institutions.
2. This Circular applies to higher education institutions and organizations, individuals related to scientific research activities of students.
Article 2. Objectives of scientific research of students
1. Form and develop scientific research capacity for students; develop and nurture potential young scientists satisfactory to high quality personnel training demand.
2. Allow students participating in scientific research to form ideas and start-up projects in order to create job opportunities for students after graduation.
Article 3. Requirements for scientific research activities of students

2. Suit objectives, contents, and training programs which students are pursuing; suit orientations of science and technology activities of higher education institutions.
3. Research results hold scientific values, novelty, creativity, and display application of acquired knowledge in reality.
4. Conform with applicable laws on science and technology activities.
Article 4. Expenditure on scientific research activities of students
Expenditure on scientific research activities of students shall be mobilized from the following sources:
1. Legal revenues of higher education institutions;
2. Donations and aids of domestic, foreign organizations and individuals;
3. Other funding sources as per the law.

Article 5. Management of scientific research activities of students
1. Plans and contents of scientific research activities of students are shown under annual and long-term plans for science and technology activities of higher education institutions.
2. Scientific research activities of students include:
a) Organize implementation of scientific research topics for students;
b) Organize knowledge, scientific research capacity, and technology transfer improvement activities for students;
c) Organize science conferences, seminars, and forums; competitions for ideas and start-up projects for students. Guide and encourage students to participate in domestic and foreign science and technology awards, exhibitions, academic competitions, and forums for students;
d) Organize communication activities regarding science and technology to boost research moral and knowledge regarding intellectual property for students; introduce ideas, start-up projects, and scientific research results of students to domestic and foreign investors and enterprises;
dd) Commend and propose commendation, praising of students and instructors having meritorious achievements in scientific research activities; honor organizations and individuals making various contributions to scientific research activities of students;
e) Other forms of science and technology activities of students as per applicable laws.

1. Students shall propose scientific research topics as per plans of higher education institutions.
2. Students shall implement their topics which have been approved. For each topic, one student shall be in charge and other members shall participate with number of participating students prescribed by higher education institutions.
3. Period of implementation shall conform to plans of higher education institutions.
Article 7. Organization of science and technology conferences for students
On an annual basis, higher education institutions shall organize science conferences for students in order to:
1. Assess results and plan science and technology activities of students.
2. Honor outstanding research results of students; share ideas and start-up ideas of students.
3. Publicize and award groups, individuals having outstanding research results, ideas, and start-up projects.

Article 9. Science and technology activities of students
1. Publish scientific journals and conference records publicizing scientific research results of students and other medium as per the law.
2. Manage, store, and utilize scientific research results of students in an effective and law compliant manner.
3. Publish scientific research results of students as per applicable laws; upload scientific results of students on website of higher education institutions and other mass media.
RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS
Article 10. Responsibilities of higher educational institutions
1. Issue documents regulating organization and scientific research activities of students, including:
a) Procedures for proposing, approving, organizing implementation, assessment, and inspection of scientific research of students;

c) Regulate penalties for students and instructors who violate regulations on scientific research of students as per applicable laws;
d) Clarify functions and tasks of entities, organizations, and individuals for scientific research activities of students; obligations and rights of students, instructors, and relevant organizations, individuals;
dd) Regulate other details relating to scientific research activities of students.
2. Issue and implement annual and long-term plans regarding scientific research activities of students to meet objectives and orientations of higher education institutions and applicable laws.
3. Issue regulations on expenditure on scientific research of students in financial regulations of higher education institutions in a manner satisfactory to applicable laws.
Article 11. Responsibilities and rights of instructors
1. Instructors are responsible for guiding students in scientific research, assuming responsibilities of the topics assigned for guidance, and complying with research moral and applicable laws.
2. Instructors shall be paid by hour of scientific research, receive salary, and receive other benefits as per regulations of higher education institutions after finishing guiding students in scientific research.
3. Instructors whose students attain successful results, achieve domestic and foreign science and technology awards, or possess research results applied and implemented in a manner that yields socio-economic effectiveness shall be prioritized in consideration of competition in all levels and other forms of awards.

1. Responsibilities of students:
a) implementing scientific research in a truthful and strict manner;
b) implementing scientific research for students; participating in conferences, science seminar, forums, and other science and technology activities in higher education institutions;
c) complying with regulations and law on intellectual property, science and technology activities, and other regulations of applicable laws.
2. Students have the rights to:
a) propose and register scientific research topics;
b) be allowed to employ facility and equipment available in higher education institutions for scientific research;
c) receive funding for scientific research with the amount regulated by higher education institutions;
d) publicize and receive assistance in publicizing research results on science journals, records, and other domestic and foreign science, technology publications as per the law;

e) receive additional scores in academic and training scores; be prioritized for scholarship and competitive titles, forms of commendations as per regulations of higher education institutions;
g) receive other benefits as per the law.
Article 13. Commendations and penalties
1. Students, instructors, and organizations, individuals attaining achievements in scientific research activities of students shall receive commendations and be commended by competent authority as per applicable laws.
2. Entities and individuals violating regulations on scientific research activities of students shall be susceptible to penalties and disciplinary actions as per regulations of higher education institutions and applicable laws depending on level of violation.
1. This Circular comes into force from November 2, 2021.

Article 15. Responsibilities for implementation
Chief of Office, Director of Department of Science, Technology, and Environment, heads of relevant entities affiliated to Ministry of Education and Training; directors of higher education institutions and academies; principals of universities; and relevant organizations and individuals are responsible for implementation of this Circular. /.
