RESOLUTION
ADJUSTMENT TO THE MEDIUM-TERM PUBLIC INVESTMENT PLAN 2016-2020
THE NATIONAL ASSEMBLY
Pursuant to the Constitution of the Socialist Republic of Vietnam;
Pursuant to the Law on Public Investment No. 49/2014/QH13;
Pursuant to the Law on State Budget No. 83/2015/QH13;
Pursuant to the Resolution No. 25/2016/QH14 of the National Assembly on 05-year national financial plan 2016-2020;
Pursuant to the Resolution No. 26/2016/QH14 of the National Assembly on medium-term public investment plan 2016-2020;
In consideration of the Report No. 513/BC-CP dated October 18, 2018 of the Government; the Inspection report No. 1272/BC-UBTCNS14 dated October 18, 2018 of the Finance and Budget Committee; the Response report No. 351/BC-UBTVQH14 dated November 09, 2018 of the Standing Committee of the National Assembly and National Assembly deputies’ opinions;
HEREBY RESOLVES:
Article 1. Adjustment to capital structure and use of general provisions
1. The total foreign capital specified in medium-term investment plan 2016-2020 is increased from 300,000 billion dong to 360,000 billion dong at the maximum and the domestic loan capital is reduced in order to disburse capital for projects funded by foreign capital.
2. Capital for projects of national importance is reduced by 10,000 billion dong (from 80,000 billion dong to 70,000 billion dong).
3. The general provisions specified in the medium-term investment plan 2016-2020 may be used if the use of the general provisions does not cause budget deficit and maintains the ceiling for public investment at 2,000,000 billion dong (except for the general provisions in the 2019 state budget used to increase the expenditure on development investment in the case of increasing the state budget revenue and repurposing capital reserved for PetroVietnam and Viettel), the deficit ratio and public debt safety decided by the National Assembly.
4. In the case of balancing local government budget: local governments are allowed to assign the annual public investment plan funded by the local government budget on the basis of the actual revenue and in a way that does not increase the annual local government budget deficit ratio; a consolidated report thereon shall be made upon completion of the medium-term investment plan 2016-2020.
People’s Councils at all levels are assigned to allocate the provisions of the medium-term public investment plan 2016-2020 using their local government budget in accordance with the principles and in the order of priority prescribed by the Law on Public Investment and National Assembly’s Resolution No. 26/2016/QH14.
Article 2. Principles and order of priority given to allocating the remaining general provisions in the central government budget and increased foreign capital
1. General provisions in the central government budget shall be allocated to projects in a manner that balances the annual state budget estimate and in the following order of priority:
Comply with regulations on principles and order of priority specified in the National Assembly’s Resolution No. 26/2016/QH14. Focus on the projects funded by the central government budget on the portfolio of projects in the medium-term public investment plan 2016-2020 which are in progress or lack capital; pay debts that have to be paid by the central government budget for the projects which have been put into use; projects that owe compensation for land clearance and have yet to provide compensation on schedule under the agreements with certain public-private partnership projects in accordance with regulations of law. Pay attention to providing capital for the following projects funded by the central government budget and not included in the medium-term public investment plan 2016-2020: projects fortification of key dykes, river and coastal bank erosion control and natural disaster recovery and management; urgent projects on national defense, security, transport and irrigation which aims to connect regions, especially disadvantaged areas; for investment preparation and performance of certain tasks prescribed in the Law on Planning; implementation of policies tailored for ethnic minorities and mountainous areas; for implementation of lending social houses and houses for workers in industrial parks; premises of judicial authorities; for land clearance, relocation and construction of essential infrastructure of key projects on education, culture and high technology; for modernizing information technology in the Communist Party and State’s agencies.
2. Foreign capital shall be allocated in the following order of priority:
a) Provide additional capital for projects under loan agreements that will expire during 2018 - 2020 and cannot be extended;
b) Provide additional capital for subcomponents of joint projects not included in the medium-term public investment plan 2016-2020 according to the plan for use of capital made by the central joint project governing bodies;
c) Provide capital for projects funded by ODA loans or foreign concessional loans and already included in the portfolio of projects in the medium-term public investment plan 2016-2020 for which capital is disbursed on schedule;
d) Provide capital for projects funded by ODA loans or foreign concessional loans already specified in loan agreements or to be specified in loan agreements, which will be executed during 2019-2020 but have not yet been included in the portfolio of projects in the medium-term public investment plan 2016-2020;
Article 3. Addition to portfolio of projects and adjustment to the medium-term public investment plan funded by the central government budget 2016-2020
1. Use above-mentioned 10,000 billion dong to fund projects on fortification of key dykes, river and coastal bank erosion control and natural disaster recovery and management and relocation of people from areas at risks of huge floods, flash floods and landslides. The remaining amount is used to pay compensation for land clearance for some projects funded by the central government budget and provide assistance in land clearance for some urgent projects that need to be immediately executed. Assign the Government to balance capital, compile a portfolio of projects and estimate capital for each project and notify the Standing Committee of the National Assembly for consideration and decision.
2. Add the portfolio of projects funded by ODA loans and foreign concessional loans to the medium-term public investment plan 2016-2020 to promptly execute them under agreements with donors in accordance with the Appendices 1a, 1b and 1c enclosed herewith. Assign the Government to expeditiously complete procedures, allocate capital and assign the capital plan in accordance with regulations of law.
3. Allocate the remaining 1,766.03 billion dong from the National Target Program for Sustainable Poverty Reduction as prescribed and transfer 648.698 billion dong from the general provision of the medium-term public investment plan 2016-2020 to the National Target Program for Sustainable Poverty Reduction to assist areas that have no longer poor districts in performing the tasks in the National Target Program for Sustainable Poverty Reduction in accordance with the Appendix No. 2 enclosed herewith. Assign the Government to allocate, adjust and assign the capital plan in accordance with regulations of law.
4. Add projects to the medium-term public investment plan 2016-2020, including cooperative development assistance fund of the Vietnam Cooperative Alliance, National Population Database Project of the Ministry of Public Security and project on construction of Project on construction of grade-separated intersection at Hue - Danang City three-way crossroad under of the Ministry of Transport according to the Appendix 3 enclosed herewith. Assign the Government to adjust and assign the capital plan in accordance with regulations of law.
5. Convert PPP projects under the Quang Ninh – Nghe An coastal route planning to projects funded by the state budget in a manner that improves the efficiency, balances resources, mainly uses the local government budget, combines with other investment forms, phases investment and harmoniously executes urgent projects and ensuring comprehensiveness, appropriateness and fair in coastal areas. Assign the Government to compile a portfolio of projects, clearly determine resources and estimate capital for specific projects and notify the Standing Committee of the National Assembly for consideration and decision.
6. Use the provisions of Ministries, central and local government authorities to formulate, appraise and announce planning according to the Law on Planning.
Article 4. Responsibilities of the Government
1. Direct Ministries and central and local government authorities to strengthen the implementation of measures for rectifying shortcomings, effectively implement the National Assembly’s Resolution No. 26/2016/QH14 and speed up allocation and disbursement of public investment capital. Expeditiously review regulations of law on medium-term public investment plans and propose amendments to regulations of law, including the Law on Public Investment. Strengthen the implementation of inspection and auditing measures; prevent and control corruption, loss and wastefulness; take actions against regulations of law on public investment; improve efficiency in using capital.
2. Expeditiously complete procedures and documentation and formulate plans for disbursement of capital for projects of national importance and national target programs decided by the National Assembly. Intensify mobilization of domestic and foreign resources for investment and development and introduce regulations with a view to promoting public-private collaboration and facilitate participation by economic sectors in construction of infrastructure.
3. On the basis of the principles and order of priority specified in this Resolution and other relevant regulations of law, the Government shall review and expeditiously complete the portfolio of projects and estimate capital for each project using the general provisions in the central government budget in a transparent and fair manner and notify the Standing Committee of the National Assembly for consideration and decision.
4. Review and complete procedures and conditions for allocating capital to the Vietnam Development Bank and urban railway projects of Hanoi and Ho Chi Minh City, and submit them to a competent authority for consideration and decision. A plan for allocation of foreign capital to the Vietnam Expressway Corporation and the Vietnam Infrastructure Development and Finance Investment Joint Stock Company is not currently in place.
Article 5. Implementation
1. The Government, the Prime Minister, Ministries, ministerial agencies, Governmental agencies, People's Councils and People’s Committees at all levels shall, within their jurisdiction, provide instructions on and organize the implementation of this Resolution.
2. The Standing Committee of the National Assembly, the Finance and Budget Committee, the Ethnic Minorities Council, other Committees of the National Assembly, National Assembly delegations, National Assembly deputies and People’s Committees shall, within their jurisdiction, supervise the implementation of this Resolution.
3. The Central Committee of the Vietnamese Fatherland Front and its members and social organizations established under law shall supervise and encourage people from all social strata to implement this Resolution.
4. The State Audit Office of Vietnam shall, within its jurisdiction, audit the implementation of this Resolution in accordance with regulations of law.
This Resolution is adopted by the 14th National Assembly of Socialist Republic of Vietnam on this 12th of November 2018 during its 6th session.
