Decision No. 714/QD-TTg dated May 22, 2015, promulgating the list of national databases requiring priority development to establish the base for e-government development

DECISION

promulGATING THE LIST OF NATIONAL DATABASES REQUIRING PRIORITY DEVELOPMENT TO ESTABLISH THE BASE FOR E-GOVERNMENT DEVELOPMENT  

PRIME MINISTER

Pursuant to the Law on organization of the government dated December 25, 2001;

Pursuant to the Law on e-transactions dated November 29, 2005;

Pursuant to the Law on information technology dated June 29, 2006;

Pursuant to the Government’s Decree No. 64/2007/ND-CP dated April 10, 2007 providing for the information technology applications in operations of state agencies; 

Considering the request of Minister of Information and Communications,

DECIDES:

Article 1. This Decision is enclosed with the Annex promulgating the List of national databases requiring priority development to establish the base for e-government development. 

Article 2. The establishment of national databases which are not in the List herein shall be carried out in accordance with regulations of relevant laws.

Article 3. Implementation organization

1. The national database management authority:

a) Request competent authorities to formulate new legislative documents on the national database or approve the amended and/or supplemented ones, or promulgate legislative documents concerning its in-charge national database within its competence.

b) Establish and develop the national database:

- Provide for details on explanation and description contents about objectives, scale, scope and entities of the national database, definition and relation between basic information components, preliminary appraisal of feasibility and efficiency of the establishment of the national database;

- Determine data characteristics and attributes of the national database on the principle of avoiding overlapped information of an existing national database. In case of overlapped information, the national database management authority shall carry discussion and agreement with the agency in charge of managing that existing national database on the preliminary design and data model of its national database, and report to the Prime Minister to consider and make decision on unsolved matters;

- Preside over and coordinate with Ministry of Information and Communications and relevant agencies in formulating and promulgating national regulations for national database in terms of contents, structure and types of information of the database, and data access methods;

- Consider projects on the establishment of national database for approval, except for cases where regulations of relevant laws apply;

- Provide documents about design and functional requirements of the national database and technical solutions applying standards and/or regulations to Ministry of Information and Communications for monitoring and summation;

- Check and compare data with data components of national databases which are not under its management.

c) Manage and operate the national database:

- Establish operational processes and methods for monitoring and maintaining the national database;

- Check, modify and update the national database on a regular basis through administrative processes and procedures (not through summing-up and statistical operations) in order to ensure the timeliness, accuracy and adequate reflection of revised information and time element of data;

- Adopt measures for ensuring the authentication and protecting data integrity, retain tracks of creating, changing or deleting data; carry out the periodical inspection of implementation of solutions and/or measures for protecting security of the national database; comply with the national standards and technical regulations for information safety and security in conformity with characteristics, features and value of stored information;

- Adopt synchronous solutions for backing up, preventing problems, troubleshooting and restoring data, and other technical solutions for ensuring the operational efficiency and availability of the system at a high level;

- Establish the organizational structure and adopt regulations on management and operation of the national database.

d) Organize the use and update on the national databases:

- Receive and handle requests for use of the national database under the forms of retrieving information online and obtaining electronic templates from the official portal or via written request forms for provision of information at the request-receiving division; promulgate specific regulations and notify in the public the conditions for restricted access (if any) to the database's components and contents;

- Instruct organizations and individuals in connecting their information systems with the national database for accessing, exchanging and sharing data;

- Use data exploited from checked and compared component databases to update the national database;

- Inspect and report discovered violations against regulations on the use of the national database to competent authorities for consideration;

- Make and send annual reports and irregular reports on the management, operation and use of the national database to Ministry of Information and Communications for summation.

2. Ministries, ministerial-level agencies, the Government’s affiliates and people's committees of provinces:

a) Participate in the operation, use and update on the national database within the ambit of assigned rights and duties.

b) Instruct subordinate units to provide information and updated data to the national database management authority and assume responsibility for the accuracy and integrity of provided information and data.

c) Establish and organize their databases in conformity with the national databases referred to in the Annex enclosed to this Decision; ensure the availability and connect existing information systems to the national database as requested and instructed by the national database management authority.

3. Ministry of Information and Communications:

a) Instruct the enforcement of laws on the national database.

b) Monitor and summarize the establishment, update, management, operation and use of the national database in order to request the Prime Minister to adjust contents of this Decision in a timely manner and in conformity with real situation.

c) Coordinate with the national database management authority in establishing and promulgating technical regulations, standards and plans, and instructing the connection between information systems, databases and the national database for the purpose of ensuring the compatibility and safety of information. 

d) Appraise preliminary designs of projects on establishment of the national database.

dd) Carry out regular inspection of the compliance with regulations of the laws on establishment, update, management, operation and use of the national database.

e) Evaluate operational results, inspect and verify the compliance with preliminary design and/or construction design of the national database.

g) Establish the key information system for connection and facilitating the access to the national databases.

4. Ministry of Finance:

a) Preside over and coordinate with Ministry of Planning and Investment in instructing and inspecting the use and statement of expenditures of projects on the establishment of the national database in accordance with regulations of the Law on state budget.

b) Provide for recurrent expenditure for collecting information and training in use and maintenance/operation of information systems of the national database.

c) Preside over and coordinate with Ministry of Information and Communications in instructing the collection of fees for using data from the national databases.

5. Ministry of Planning and Investment:

Allocate investment funding from the state budget for establishing, expanding and upgrading the national databases.

Article 4. Implementation clause

1. This Decision comes into force from the date on which it is signed.

2. Ministers, Heads of ministerial-level agencies, Heads of the Government’s affiliates, Chairpersons of People’s Committees of central-affiliated cities or provinces, and relevant entities shall implement this Decision./.
