ON ADJUSTMENTS TO LAND USE PLANNING UP TO 2020 AND LAST PERIOD LAND USE PLAN (2016-2020) OF DAK NONG PROVINCE

Pursuant to the Law on Government organization dated June 19, 2015;
Pursuant to the Law on Land dated November 29, 2013;
At the request of Dak Nong province People's Committee (Written request No.4407/TTr-UBND dated August 15, 2017 and No.1234/TTr-UBND dated March 20, 2018), the Ministry of Natural Resources and Environment (Written Request No.60/TTr-BTNMT dated October 12, 201, Official Dispatch No.6900/BTNMT-TCQLDD dated December 21, 2017 and Official Dispatch No.1679/BTNMT-TCQLDD dated April 05, 2018),
HEREBY RESOLUTES:
Article 1. Approving adjustments to the land use planning up to 2020 and last period land use plan (2016-2020) with the following norms:

Article 2. According to thisResolution, Dak Nong province People’s Committee shall:
1. adjust the land use planning up to 2020 and last-period land use plan (2016-2020), including review of planning adjustments made by other government authorities or departments that use the land in order to ensure these adjustments are consistent with its adjustments to land use planning up to 2020 and last-period land use plan (2016-2020); These adjustments shall be made in a consistent manner to satisfy the requirement of socio-economic development and ensure national defense and security in the province.
2. determine boundaries and declare the area of rice land and lands for protection forests, special-use forests require strict protection; allocate resources, firstly is state budget resources for ensuring benefits between areas with conditions for industry, urban and service development and areas for protection of rice land and forest land; work out appropriate policies and methods for reducing production costs and raising earnings so that the rice cultivators can keep their mind on their work; increase investment in social infrastructure and technical infrastructure to maintain consistency and synchronism among areas.
3. continue to provide guidelines for making and approving district-level adjustments to land use planning up to 2020 and annual land use plan as per law provisions on land as a basis for appropriating, allocating, leasing out land or granting permission for land repurposing suitable for adjustments to land use plan and planning of the province.
4. be accountable to the Government and Prime Minister for repurposing of forest land minimization of forest land repurposing and review and inspection of actual use of land for protection forests, special-use forests and production forests which are natural forests before land repurposing for construction of works and projects as regulated; send reports to the Ministry of Natural Resources and Environment for assessment purpose (in cooperation with the Ministry of Agriculture and Rural Development) which are then submitted to the Prime Minister for approval purpose before making decision on land repurposing as regulated in case of construction of works/projects with use of land for protection forests, special-use forests or production forest which are natural forests required to be notified to the Government, Prime Minister.
Dak Nong province People’s Committee shall provide guidelines, carry out inspection and shall be accountable to the Government and Prime Minister for efficient and saving use of land and compliance with law provisions.
5. intensify dissemination of the land on law for land users to have a thorough grasp of law provisions and use the land for right purposes, in an efficient and saving manner towards environment protection and sustainable development.
6. manage and use the land as specified in the land use plan/planning, especially the land to be repurposed for economic development and shift in the economic structure with the aim of developing services and urban areas in order to increase budget revenues; promote auctions for land use rights. Encourage efficient and saving use of land and handling of allocated and leased land that have been abandoned. strictly manage and control the land fund planned for development of urban areas, economic zones, industrial parks and clusters, land of non-agricultural production units for the purpose of using the land fund in an efficient and saving manner, handling unbalance in the structure of land use between residential land and land for construction of technical and social infrastructure and requirements for environment protection.
7. boost inspection of land management and use, promptly prevent and handle violations against regulations provided in the land use plan/planning; determine on not granting permission for allocation, lease, repurposing or appropriation of land not included in the land use plan/planning; check and handle lands that have been allocated or leased but not put in use or used for wrong purposes as per law provisions on land.
8. strengthen investigation into assessment of land quality and potentials; assess the land degradation and contamination; complete the establishment of the system of land information databases; provide training for human resources; study and apply science and high technology in land management, enhance the quality of forecast work, prepare, appraise, manage, implement and supervise the land use plan/planning.
9. intensify forecasting, communications and dissemination work for various-level departments and local people to proactively deal with influences of climate change and sea level rise.
10. send annual reports on implementation of the land use plan/planning to the Ministry of Natural Resources and Environment which are then consolidated and submitted to the Government and National Assembly as regulated.
Article 3. The Ministry of Natural Resources and Environment shall take charge and cooperate with relevant agencies in providing guidelines and checking repurposing of land for protection forests, special-use forests and production forest that are natural forests according to the approved plan/planning under law provisions.
Article 4. Chairperson of Dak Nong province People’s Committee, Heads of relevant ministries, departments shall take responsibility to implement thisResolution./.
