DECISION
EXTENSION OF SAFEGUARD MEASURES AGAINST IMPORTED LONG STEEL PRODUCTS
THE MINISTER OF INDUSTRY AND TRADE OF VIETNAM
Pursuant to the Law on Foreign Trade Management No. 05/2017/QH14 dated June 12, 2017;
Pursuant to the Government’s Decree No. 10/2018/ND-CP dated January 15, 2018 on guidelines for the Law on Foreign Trade Management regarding trade remedies;
Pursuant to the Government’s Decree No. 96/2022/ND-CP dated November 29, 2022 defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade of Vietnam;
Pursuant to the Circular No. 37/2019/TT-BCT dated November 29, 2019 of the Minister of Industry and Trade elaborating on trade remedies;
Pursuant to the Decision No. 2968/QD-BCT dated July 18, 2016 of the Minister of Industry and Trade on imposition of safeguard measures;

Pursuant to the Decision No. 918/QD-BCT dated March 20, 2020 of the Minister of Industry and Trade on extension of safeguard measures imposed on imported semi-finished steel and long steel products;
Pursuant to Decision No. 1726/QD-BCT dated July 07, 2021 of the Minister of Industry and Trade of Vietnam providing amendments to the Decision No. 918/QD-BCT dated March 20, 2020 of the Minister of Industry and Trade of Vietnam;
Pursuant to Decision No. 2957/QD-BCT dated December 30, 2022 of the Minister of Industry and Trade of Vietnam providing amendments to the Decision No. 918/QD-BCT dated March 20, 2020 of the Minister of Industry and Trade of Vietnam and Decision No. 1726/QD-BCT dated July 07, 2021 of the Minister of Industry and Trade of Vietnam;
Pursuant to the Decision No. 2323/QD-BCT dated November 04, 2022 of the Minister of Industry and Trade on expiry review of safeguard measures imposed on imported semi-finished steel and long steel products;
At the request of the Director of the Trade Remedies Authority of Vietnam;
HEREIN DECIDES:
Article 1. Safeguard measures imposed on long steel products bearing the following HS codes: 7213. 10. 10; 7213. 10. 90; 7213. 91.20; 7214.20.31; 7214.20.41; 7227.90.10; 7227.90.90; 7228.30.10; and 9811.00.10, referred to HS codes: 7227.90.10; 7227.90.90; 7228.30.10, imported into Vietnam shall be extended. Further details on this extension are provided in the Announcement enclosed herewith.
Article 2. Safeguard measures imposed on semi-finished steel products bearing following HS codes: 7207. 11.00; 7207.19.00; 7207.20.29; 7207.20.99; 7224.90.00; and 9811.00.10, referred to HS code of 7224.90.00, shall not be extended.
Article 3. Procedures for imposition of extended safeguard measures shall be followed in accordance with law regulations on trade remedies against imports into Vietnam.

Article 5. Chief of the Ministry’s Office, Director of Trade Remedies Authority of Vietnam, and heads of relevant agencies and related parties are responsible for the implementation of this Decision./.

ANNOUNCEMENT
EXTENSION OF
SAFEGUARD MEASURES IMPOSED ON IMPORTED LONG STEEL PRODUCTS
(Enclosed with the Decision No. 691/QD-BCT dated March 21, 2023 of the
Minister of Industry and Trade of Vietnam)
Pursuant to the Law on Foreign Trade Management No. 05/2017/QH14 dated June 12, 2017 and the Government’s Decree No. 10/2018/ND-CP dated January 15, 2018 on guidelines for the Law on Foreign Trade Management regarding trade remedies, the Ministry of Industry and Trade of Vietnam herein provides detailed contents about the extension of safeguard measures imposed on long steel products imported into Vietnam (case: ER02.SG04) as follows:
1. Imports subject to safeguard measures

Regarding HS code of 9811.00.10, the safeguard measures shall only be imposed on imports referred to the following original HS codes: 7227.90.10; 7227.90.90; 7228.30.10, and shall not be imposed on imports referred to other original HS codes.
Long steel products which present one of the following characteristics shall be excluded from the scope of safeguard measures:
(1) Plain round bars of steel whose nominal diameter exceeds 14 mm;
(2) Steel products that contain one of the following elements in the specified proportions (%) as follows: C > 0,37%; Si > 0,60%; Cr > 0,60%; Ni > 0,60%; Cu > 0,60%; (3) Wires of alloy steel bearing HS codes of 7227.90.10; 7227.90.90, used for producing soldering sticks (soldering materials).
In order to have their imported long steel products, which are specified in Sections (1), (2), excluded from the scope of safeguard measures, importers shall be required to present valid documents to satisfy customs authorities as to the eligibility of their imports to be excluded from the scope of safeguard measures as mentioned above.
With regard to steel wires specified in Section (3), importers shall follow procedures for exemption from the safeguard measures in accordance with the provisions of Article 4 hereof.

3. List of countries/territories from which imports are deemed negligible and thus exempted from safeguard measures
List of developing countries/territories from which imports are exempted from safeguard measures is provided in the Appendix enclosed herewith. In case the quantity of imports from any of developing countries/territories listed in this Appendix exceeds 3% of total imports into Vietnam or total quantity of imports from all listed developing countries/territories exceeds 9% of total imports into Vietnam, the Ministry of Industry and Trade of Vietnam shall issue a decision to revise this Appendix.

4. Exemption from safeguard measures
In case importers believe that their imports are eligible to be exempted from trade remedies as prescribed in Section (3) Article 1 of this Announcement and Article 10 of the Circular No. 37/2019/TT-BCT dated November 29, 2019 of the Ministry of Industry and Trade of Vietnam elaborating on trade remedies, they shall have the right to submit applications for exemption from safeguard measures to the Trade Remedies Authority of Vietnam affiliated to the Ministry of Industry and Trade of Vietnam. Procedures for application for exemption from safeguard measures shall be followed in accordance with the provisions of the Circular No. 37/2019/TT-BCT.
