AMENDING ARTICLE 7 AND REPLACING APPENDIX II AND APPENDIX III TO CIRCULAR NO. 13/2021/TT-BGDDT DATED APRIL 15, 2021 OF THE MINISTER OF EDUCATION AND TRAINING ON CONDITIONS AND PROCEDURES FOR AND COMPETENCE IN RECOGNITION OF DEGREES AWARDED BY FOREIGN EDUCATIONAL INSTITUTIONS FOR USE IN VIETNAM

Pursuant to the Education Law dated June 14, 2019;

Pursuant to the Law on Higher Education dated June 18, 2012 and Law on Amendments to Law on Higher Education dated November 19, 2018;

Pursuant to the Government’s Decree No. 86/2022/ND-CP dated October 24, 2022 on functions, duties, powers and organizational structure of the Ministry of Education and Training;

At the request of the Director General of the Vietnam Education Quality Management Agency;

The Minister of Education and Training hereby promulgates a Circular amending Article 7 and replacing Appendix II And Appendix III to Circular No. 13/2021/TT-BGDDT dated April 15, 2021 of the Minister of Education and Training on conditions and procedures for and competence in recognition of degrees awarded by foreign educational institutions for use in Vietnam.

Article 1. Amending Article 7 and replacing Appendix II And Appendix III to Circular No. 13/2021/TT-BGDDT dated April 15, 2021 of the Minister of Education and Training on conditions and procedures for and competence in recognition of degrees awarded by foreign educational institutions for use in Vietnam:

“Article 7. Applications and procedures for degree recognition

1. Each applicant shall provide information on the degree using the form in Appendix I to this Circular and upload the application on the online public service portal of the Ministry of Education and Training or Department of Education and Training (hereinafter collectively referred to as “recognition authority”), and pay fees and charges as prescribed.

2. An application includes:

a) A copy of the degree or copy from the master degree register together with a notarized Vietnamese translation;

a) A copy of the degree or copy from the master degree register together with a notarized Vietnamese translation;

c) Copies of directly relevant degrees and certificates (if any);

d) Proof of overseas study (if any): decisions on enrollment in overseas training courses; passport, visa pages with visas, entry/exit stamps appropriate to the overseas study period or other documentary proof;

d) A letter of authorization of verification of degree’s information (if requested by the verifying unit).

3. The application shall be uploaded on the online public service portal as follows:

b) If the applicant does not possess any information or proof for direct verification, certified true electronic copies of the originals of the documents specified in points a, b, c and d clause 2 of this Article, enclosed with a letter of authorization of verification of degree’s information (if requested by the verifying unit) are required and shall be uploaded on the online public service portal.

c) In case of failure to upload the application on the online public service portal, the applicant shall submit the documents mentioned in clause 2 of this Article to the recognition authority, whether in person or by post.

4. Within 20 working days, the recognition authority shall notify the applicant of the degree recognition result. In the case where information on the degree needs to be verified by the foreign educational institution or a foreign verifying unit, this deadline may be extended to no more than 45 working days in total starting from the date of receipt of the degree recognition application.

5. The degree recognition result shall be written on a certificate according to Appendixes II and III to this Circular. If a degree is not eligible for recognition or there are insufficient grounds to verify information on the degree by the deadline mentioned in clause 4 of this Article, the recognition authority must give a response to the applicant in writing or via email. If the recognition authority is unable to determine the qualification equivalent to the degree in the Vietnamese Qualifications Framework, it shall provide information and recognize the degree’s value according to the education system of the home country of the awarding institution.

6. The recognition authority shall prepare a degree recognition certificate issuance book, which includes full name and date of birth of degree holders; name of the awarding institution; mode of study; equivalent qualification in the Vietnamese Qualifications Framework or qualification according to the education system of the home country of the awarding institution; and book entry number.

7. Higher education institutions shall self-assess degrees for use in provision of training in preparation of degree assessment dossier and archiving as prescribed.”.

2. Appendix II and Appendix III are replaced.

Article 2. Grandfather clause

The Circular No. 13/2021/TT-BGDDT dated April 15, 2021 of the Minister of Education and Training on conditions and procedures for and competence in recognition of degrees awarded by foreign educational institutions for use in Vietnam shall apply to the applications for degree recognition submitted before the effective date of this Circular.

GUIDELINES FOR FILLING OUT CERTIFICATE FORM

(1) Name of supervisory body of recognition authority.

(2) Name of recognition authority.

(3) Full name of the applicant for recognition of degree/certificate.

(4) Name of foreign educational institution awarding the degree and home country thereof.

(5) Year in which the degree/certificate is issued.

(6) Full name of the degree/certificate holder in case of possessing for direct verification by the awarding institution or the verifying authority.

(7) Name of foreign educational institution providing training and home country thereof (if any).

(11) The following information: equivalent educational level according to Vietnam's national education system or Vietnamese Qualifications Framework or according to the education system of the home country of the awarding institution; higher educational level(s) (if determinable) that the degree holder may pursue; major (if determinable) and other comments.

(12) Address of web portal where the certificate’s validity may be checked.

(13) Name of province/central-affiliated city where the recognition authority is headquartered.

(14) Title of person with competence in degree recognition.

(15) Certificate issuance book entry number written according to regulations of the recognition authority.
